Mayor Tasker presided and led the Pledge of Allegiance.
Mayor Tasker presented the 2012-2013 proposed balanced budget of $ 759,547.
Mayor Tasker received no questions on the proposed 2012-2013 budget.
Motion to adjourn the meeting by Miller seconded by Kapustka. Voted six (6) yeas; zero (0) nays. Motion carried.

ESTABLISHMENT OFREVISEDORDINANCE
47.101TITLE.ThisRevisedOrdinanceshallbeknownastheConsumersEnergyCompany ElectricFranchiseOrdinance.[OriginalenactedonJuly24,1979,thenan exclusivefranchise approved inaspecialcityelectiononSeptember12,1979]
47.102AUTHORITY.TheauthorityforthisRevisedOrdinanceis setforth intheMichigan Constitutionof1963,Article7,Sections25and29;MCL460.501etseq; MCL247.183;and Chapter2Section2.3(e)(f)(I);Chapter7;andChapter14oftheCharteroftheCityofCarson City.
47.103NECESSITYOFREVISION.ThisOrdinanceis revisedtopreserveandprotectthe health,safetyandgeneralwelfareoftheresidentsoftheCityofCarsonCitybyregulatingand grantinganelectricalfranchisewithinthecitylimitsofCarsonCity.
CHAPTER47.2
PURPOSEANDINTENT
Itistheintent oftheCityCouncilandthisChaptertobeliberallyconstruedforthe purposeofprovidingfortheright,power,andauthoritytoConsumersEnergyCompanyto construct,maintain,andcommerciallyuseelectricallinesconsistingoftowers,masts,poles,cross-arms ,guys, braces,feeders,transmissionanddistributionwires,transformersandother electricalapplianceson, under,alongandacrossthehighways ,streets,alleys,bridges ,and otherpublicplaces,withinthejurisdictionof theCityofCarsonCity.
CHAPTER47.3
GRANT
47.301GRANT.TheCityofCarsonCity, inMontcalmCounty,Michigan,herebygrants theright,powerandauthoritytotheConsumersEnergyCompany,aMichigancorporation, its successorsandassigns, toconstruct, maintainandcommerciallyuseelectriclinesconsistingof towers,masts,poles,cross-arms, guys, braces,feeders, transmissionanddistributionwires, transformersandotherelectricalappliancesforthepurposeof transmitting,transformingand distributingelectricity on,under,alongandacrossthehighways,streets,alleys,bridges, waterways,andotherpublicplaces,andtodoalocalelectricbusinessintheCITYOFCARSON CITY,MONTCALMCOUNTY,MICHIGAN.
47.302TERM.Thisfranchiseshallbeforatermofthirtyyearssubjecttorevocation uponsixty(60)dayswrittennoticebythepartydesiringsuchrevocation.
47.303CONSIDERATION.Inconsideration of the rights,powersandauthoritygranted, ConsumersEnergyCompanyshallfaithfullyperformallthingsrequiredbyhisfranchise.
47.304CONDITIONS.Nohighway,street,alley,bridge,waterwayor otherpublicplace usedbyConsumersEnergyCompanyshallbeobstructedlongerthannecessaryduringthework ofconstructionorrepair,andshallberestoredtothesameorderandconditionaswhensaid workwascommenced,allofConsumersEnergyCompany'sstructures andequipment shallbesoplacedoneithersideofthehighwaysasnottounnecessarilyinterferewiththeusethereof forhighwaypurposes.All ofConsumersEnergyCompany'swirescarryingelectricityshallbe securelyfastenedsoasnottoendangerorinjurepersonsorpropertyinsaidhighways. ConsumersEnergyCompanyshallhavetherighttotrimtreesifnecessaryintheconductingof suchbusiness,subject, however,tothesupervisionofthehighwayauthorities.
47.305HOLDHARMLESS.TheConsumersEnergyCompanyshallatalltimeskeepand savetheCityofCarsonCityfreeandharmlessfromallloss, costsandexpensetowhichitmay besubjectbyreasonofthenegligentconstructionandmaintenance of the structures and equipment herebyauthorized.IncaseanyactioniscommencedagainsttheCityofCarsonCity onaccountofthepermissiongranted, theConsumersEnergyCompanyshall,uponnotice, defendtheCityofCarsonCityandsaveitfreeandharmlessfromallloss, costanddamage arisingoutofsuchnegligentconstructionandmaintenance.
47.306EXTENSIONS.ConsumersEnergyCompanyshallconstruct andextenditselectric distributionsystemwithintheCityofCarsonCity,andshallfurnishelectricservicetoapplicants residingthereininaccordancewithapplicablelaws, rulesandregulations.
47.307FRANCHISENOTEXCLUSIVE.The rights,powerandauthoritygrantedbythisFranchise arenotexclusive.
47.308RATES.TheConsumersEnergyCompanyshallbeentitledtochargethe inhabitantsof theCityofCarsonCityforelectricityfurnishedtherein,theratesasapprovedby theMichiganPublicServiceCommission,towhichCommissionoritssuccessor'sauthorityand jurisdictiontofixandregulateelectricratesandrulesregulatingsuchserviceintheCityof CarsonCityareherebygrantedforthetermofthisfranchise. Suchratesandrulesshallbe subjecttoreviewandchangeatanytimeuponpetitionthereforbeingmadebyeithertheCity ofCarsonCity,actingbyitscouncilorbyConsumersEnergyCompany.
47.309RIGHTSOFTHECITYOFCARSONCITY.Thefranchiseshall besubjecttotherights oftheCityofCarsonCity:

Torequireproperandadequateextensionofplantandservice maintenanceatthehighestpracticalstandardofefficiency;
TorequireserviceinaccordancewiththetermsofthefranchiseThroughouttheentireperiod;
ConsistentwithSection47.402,noprovisionofthisRevised Ordinanceshall beexercisedorconstruedinamannerwhich conflictswiththeexpresstermsandconditions ofthisfranchise, norwiththerulesandregulations setforthbytheMichiganPublic ServiceCommissiongoverningtheprovisionofelectricservicebyConsumersEnergyCompany.
CHAPTER47.4
JURISDICTION
47.401EXISTINGCITYORDINANCES.RULESANDREGULATIONS.ConsumersEnergy Companyshallbeandremainsubjecttoallordinances,rulesandregulations oftheCityof CarsonCitynowineffectorwhichmightsubsequentlybeadoptedfortheregulationofland usesorfortheprotectionof thehealth,safetyandgeneralwelfareofthepublic;provided, however,thatnothingshallbeconstruedasawaiverbyConsumersEnergyCompanyofanyof it'sexistingorfuture rightsunderstateorfederallaworalimitationupontheexistingorfuture powersoftheCityofCarsonCitypursuanttoitscharterorstateorfederallaw.
47.402MICHIGANPUBLICSERVICECOMMISSION, JURISDICTION.ConsumersEnergy Companyshall,astoallotherconditions andelementsofservicenothereinfixed,beand remainsubjecttothereasonablerulesandregulationsof theMichigan PublicService Commissionoritssuccessors,applicabletoelectricserviceintheCityofCarsonCity.
CHAPTER47.5
CONFLICTINGORDINANCESREPEALED
Ontheeffectivedateoftheadoption of thisRevisedOrdinance,allother conflictingordinances,resolutionsorrulesregardingthisnon-exclusivefranchisearehereby repealed,rescindedandsupersededbytheprovisionsof thisRevisedOrdinance, including but notlimitedtothatOrdinanceandamendments,ifany,adoptedbytheCityofCarsonCityon July24,1997.
CHAPTER47.6
SEVERABILITY
Ifanychapter,section,subsection, paragraph, sentence,clause,phraseor portionofthisRevisedOrdinanceis,foranyreason,heldinvalidorunconstitutionalbyany courtofcompetentjurisdiction,suchportionshallbedeemedaseparate,distinct andindependentprovision andsuchholdingshallnotaffectthevalidityoftheremainingportion thereof.
CHAPTER47.7
EFFECTIVEDATE
ThisOrdinanceshallbecomeeffective30daysafteritspublication;provided, however,
itshallceaseandbeofnoeffectafterthirtydaysfromitsadoption unlesswithinsaidperiodthe ConsumersEnergyCompanyshallacceptthesame inwritingfiledwiththeCityComptroller. Uponacceptanceandpublicationhereof, thisordinanceshallconstitute acontractbetween
saidCityandConsumersEnergyCompany.

TheRevisedOrdinancewaspublishedintheDaily Newson the 21st, of May 2012pursuant toSection7.4(b)oftheCharteroftheCityofCarsonCity,withcopiesbeingavailable attheCityComptroller's OfficeatCityHall.

ThisPerformanceResolutionisrequiredbytheMichiganDepartmentofTransportationforpurposesofissuing toamunicipalutilityan"IndividualPermitforUseofStateHighwayRightofWay,"oran"AnnualApplicationand PermitforMiscellaneousOperationsWithinStateHighwayRightofWay."
RESOLVEDWHEREAS,the,City of Carson City
hereinafterreferredtoasthe"GOVERNMENTALAGENCY," periodicallyappliestotheMichigan DepartmentofTransportation,hereinafterreferredtoasthe"DEPARTMENT,"forpermits,referredto as"PERMIT,"toconstruct,operate,useand/ormaintainutilityorotherfacilities,ortoconductother activities,on, over,andunderStateHighwayrightofwayatvariouslocations;withinandadjacenttoits corporatelimits;
NOW THEREFORE, in consideration of the DEPARTMENT granting such PERMIT,the
GOVERNMENTALAGENCYagreesthat:
1.EachpartytothisAgreementshallremainresponsibleforanyclaimsarisingoutoftheirownacts and/or omissions during the performance of this Agreement, as provided by law. 2.AnyworkperformedfortheGOVERNMENTALAGENCYwillbesolelyasfortheGOVERNMENTAL AGENCYandnotasacontractororagentoftheDEPARTMENT.TheDEPARTMENTshallnotbe subjecttoanyobligationsor liabilitiesbyvendorsandcontractorsoftheGOVERNMENTAL AGENCY,ortheirsubcontractorsoranyotherperson notapartyto thePERMITwithoutits specificpriorwrittenconsentandnotwithstandingtheissuanceofthePERMIT.Anyclaimsagainst theStateofMichigan, theMichiganTransportation Commission, the DEPARTMENT, and all officers,agentsandemployeesthereofandthosecontractinggovernmental bodiesperforming permitactivitiesfortheDEPARTMENTandallofficers,agents,andemployeesthereofwillbethe soleresponsibilityoftheGOVERNMENTALAGENCY.
3.TheGOVERNMENTALAGENCYshalltakenounlawfulactionorconduct,whichariseseither directlyorindirectlyoutofitsobligations,responsibilities,anddutiesunderthePERMITwhich resultsinclaimsbeingassertedagainstorjudgmentbeingimposedagainsttheStateofMichigan,the MichiganTransportationCommission,theDEPARTMENT,andallofficers,agentsandemployees thereofandthosecontracting governmentalbodiesperformingpermitactivitiesforthe DEPARTMENT and all officers, agents, andemployeesthereof, pursuant toamaintenance contract. Intheeventthatthesameoccurs,forthepurposesofthePERMIT,itwillbeconsidered asabreachofthePERMITtherebygivingtheStateofMichigan,theDEPARTMENT,and/orthe MichiganTransportationCommissionarighttoseekandobtainanynecessaryrelieforremedy, including,butnotbywayoflimitation,ajudgmentformoneydamages.
4. The GOVERNMENTALAGENCYItwill,byitsownvolitionand/orrequestbytheDEPARTMENT, promptlyrestoreand/orcorrectphysicaloroperating damages to any State Highway Right of Way resulting from the installation construction, operation and/or maintenance of the GOVERNMENTALAGENCY'SfacilitiesaccordingtoaPERMITissuedbytheDEPARTMENT.
5.With respect toany activities authorized byPERMIT, when the GOVERNMENTALAGENCY requires insurance on its own orits contractor's behalf itshall also require that such policy include asnamed insured the StateofMichigan,theTransportationCommission,the DEPARTMENT,andallofficers,agents,andemployees thereof andthose governmentalbodies performing permit activities for the DEPARTMENT and all officers, agents, and employees thereof,pursuanttoamaintenancecontract.
6.Theincorporation bytheDEPARTMENTofthisresolutionaspartofaPERMITdoesnotprevent heDEPARTMENTfromrequiringadditionalperformancesecurityorinsurancebeforeissuanceof aPERMIT.
7.Thisresolutionshallcontinueinforcefromthis dateuntilcancelledbytheGOVERNMENTAL AGENCY ortheDEPARTMENTwith noless thanthirty (30) days prior written notice tothe other party.Itwillnotbecancelled orotherwiseterminatedbytheGOVERNMENTALAGENCY withregardtoanyPERMIT which hasalready beenissued oractivitywhich hasalready been undertaken.

WITNESSETHthattheHospitaland theCityfor theconsiderationslistedbelow,agreeasfollows:
Scope of Work:
Duringspecifiedhoursanddaysmutuallyagreedbybothparties,on-dutyofficersoftheCarsonCity PoliceDepartment (CCPD)willusedesignatedHospitalspaceasasatellitepolicestation.OfficerswillparkCCPDvehiclesinadesignatedspace onHospitalpropertyandworkwithHospitalstafftoprovidelawenforcementandsecurityservicesaccordingtospecific needs.OfficerswillwearCCPD uniformsandbadgeswhileondutyatthehospital.GoalsofthisAgreement:
1)Enhancelawenforcement/securitypresenceattheHospitalwithcertifiedofficers.
2)ProvideamorereadilyavailablepolicyservicetoHospitalstaffandCityresidents.
3)AssistHospitalstaffwithincreasedinterior/exteriorsurveillancetoursbyuniformedofficers.
Work Performed:
TheofficerwillregularlypatrolHospitaldepartmentsandgroundsandassistHospitalstaffinmaintaininga safeandsecure environmentforprovidinghealthcareservices.Assistance intheHospitalwillincludebutnot belimitedto:·
1)MonitoringtoanticipatepotentialsecuritythreatsandassistingwithresolutionincooperationwithHospitalstaff,
2)Respondingtocallsforassistanceofalawenforcementnatureinhospitaldepartments,pharmacyasneeded,and
3)VisitorControlactivitiestohelprestrictaccesstoonlythosewithalegitimateneedtobeintheHospital.
HospitalstaffwillassistResidentsoftheCityasnecessarytocontactCCPDofficers ondutyduringthespecifiedhours. HospitalandCityofficialswillcollaborativelyprovidethemosteffectivemeansforelectroniccommunications.
CCPDofficers,servingasIndependentContractors,employeesoftheCityandaccountabletotheChiefofPolice,City
AdministratorandCouncil;willmakealldecisionsregardingpriorityresponses toHospitalandCitycallsforassistance.
Contract Price:
TheHospitalshallpaytheCity$21.00perhourofserviceprovidedbetween12:00midnightand5:ooa.m.,invoicedmonthly.
Furnishings:
TheHospitalshallprovideofficespace,basicofficesuppliesandequipment,includingwirelessaccesstoallowCCPDofficers toconductpolicereportingactivitiesandothernecessarybusinessduringthespecifiedhours.
Hours of Service:
CCPDofficerswillbaseoperationsattheHospitalsatelliteclinicfivedaysperweek.Asix-monthtrialperiodbeginsJune4, 2012.Hours maybeadjustedatthemutualconsentoftheparties.
Specialized Training:
TheHospitalwillprovideandreimbursewagesforspecifictraininginprivacy,OfficeofInspectorGeneralandonother. Regulatoryissuesasneeded. CCPDofficersshallattendanysuch trainingthattheHospitaldeemsnecessary.
Cancellation:

Mark Borden reported no progress yet on walking trail and installation of street lights is beginning.
