The Local Authorities (Alcohol Consumption in Designated Public Places) Regulations 2007
Notice is hereby given that Newcastle City Council proposes subject to consultation, to make a Designated Public Places Order under Section 13 Criminal Justice and Police Act 2001 and The Local Authorities (Alcohol Consumption in Designated Public Places) Regulations 2007 designating all that area bounded by A69 (part), Drove Road (part), Hill House Road, south across open land to the edge of Seven Acre Field, east along the perimeter of Tyne Riverside Country Park, Grange Road, Station Road, High Street, Lemington Road (part), south to the bank of the River Tyne, west along the bank of the River Tyne to Ryton Island, north along the boundary between Castle Morpeth and Newcastle upon Tyne across open land to the A69.
This area will be designated for the purposes of the Order and is shown on the attached map delineated in red, or if no map is attached to this notice, may be viewed at the Customer Service Centre, Newcastle City Council, Civic Centre, Newcastle upon Tyne during normal business hours or on the Council’s website www.newcastle.gov.uk
The effect of the proposed Order will be to grant a police officer or other accredited person, such as a Community Protection Officer under section 41 and Schedule 5 to the Police Reform Act 2002, the power to require any person drinking alcohol in the designated place to stop drinking and/ or to surrender any container of alcohol in that person’s possession. Any person who, without reasonable excuse fails to comply with a police officer’s request may commit an offence and be liable to prosecution.
The Order will not prevent drinking in the designated area, but will eliminate anti social drinking and the associated nuisance, annoyance and disorder.
The following places are excluded from the Designated Public Places Order:
- Premises where a premises licence or club premises certificate is in force for the sale or supply of alcohol under the Licensing Act 2003 and any place within the curtilage of these premises.
- Premises subject to a premises licence issued in respect of a Temporary Event Notice under the Licensing Act 2003. This exemption applies only during the times of operation of the licence when alcohol is being sold or supplied and 30 minutes thereafter. Such premises will not be exempt from the Order at any other time when they are not licensed to sell or supply alcohol.
- Places where the sale or consumption of alcohol is permitted on public highways by virtue of permission granted under S115E of the Highways Act 1980.
