This is to inform staff that DCFS and the Probation Department, in consultation with the Presiding Judge of the Juvenile Court have collaborated to establish a protocol in accordance with the provisions of AB 129, which amended Welfare and Institutions Code Section 241.1. The amendments to WIC 241.1, permit a dependent of the court under WIC 300 supervision to also be declared a ward of the juvenile court under WIC 602 and have dual status under both DCFS and the Probation department.
The protocol will be implemented with cases referred for a WIC 241.1 Joint Assessment from Juvenile Delinquency Court in Pasadena out of Departments 270 and 271. Joint assessment referrals from other Delinquency Courts are not included in the pilot at this time, but will be phased in at a later date.
The protocol establishes a Multi-Disciplinary Team (MDT) that will consist of representatives from DCFS (241.1 Unit), Probation, DMH and an Education Advocate who will conduct an assessment of the youth and make a recommendation to the Juvenile Court as to the agency, either Probation or DCFS that can meet the needs of the youth. The MDT representatives will be co-located at Edmund Edelman Children’s Court in D422.
The case-carrying CSW will still be required to follow the instructions as directed by the staff in the WIC 241.1 Unit and complete the 241.1 Memo (See Procedural Guide 0300-311.05, Preparing The WIC 241.1 Joint Assessment Court Report Ordered by the Dependency Court) and retain the report (241.1 memo report) in the CWS/CMS database.
After the disposition hearing, the MDT will continue to follow the cases that are in the pilot project to ensure that each youth is receiving the appropriate services and will request updated information from the CSW as to the youth’s current status and progress.
