I. Involvement
NorD 01: Involvement of Parents
1.0Where feasible, the correctional facility shall involve parents to improve the educational achievement and prevent the further delinquency of their children.
Correctional facility is defined as a facility in which persons are confined as a result of a conviction for a criminal offense, including persons under 21 years of age. The term also includes a local public or private institution and community day program or school not operated by the state that serves delinquent children and youth.

NorD 05: Schoolsite Council (SSC) Composition
5.0In a schoolwide program (SWP), the SSC shall be comprised with a majority of classroom teachers. (California Education Code (EC) § 52852[b][3])
(a)In elementary schools, members shall consist of the principal, teachers selected by teachers at the school, other school personnel selected by other school personnel at the school, and parents or other community members selected by parents. (EC §§ 52852[a], 52852[b][1])
(b)In secondary schools, members shall consist of the principal, teachers selected by teachers at the school, other school personnel selected by other school personnel at the school, parents or other community members selected by parents, and pupils selected by pupils attending the school. Single Plan for Student Achievement (SPSA)

Description:Each SPSA should identify the school name and include budget information and evidence of required approvals by the SSC and local governing board. The reviewer will indicate which fiscal year the LEA should provide for review.

NorD 06: School Site Activities
6.0The SWP school shall develop amendments to its existing Single Plan for Student Achievement (SPSA) to reflect law provisions. The following requirements apply to a SWP: (20 U.S.C. § 6314[b][1][B])
(a)The SPSA is developed with parents, community members, teachers, principals, other school leaders, secondary students, paraprofessionals, and other interested individuals or groups as determined by the school. (20 U.S.C. § 6314[b][2])
(b)The SPSA shall remain in effect for the duration of the school's participation under this part and is reviewed and revised as necessary. (20 U.S.C. § 6314[b][3])
(c)The SPSA shall be available to the LEA, parents, and the public, and the information contained in the plan shall be in an understandable and uniform format and, to the extent practicable, provided in a language that the parents can understand.

(d)The SPSA shall include coordination and integration of federal, state, and local services and programs. (20 U.S.C. § 6314[b][5])
(e)The SPSA is based on a comprehensive needs assessment of the entire school which takes into account information on the academic achievement of children in relation to the challenging state academic standards. (20 U.S.C. § 6314[b][6])
(f)The SPSA shall include a description of methods and instructional strategies that strengthen the academic program in the school, increase the amount and quality of learning time, help provide an enriched and accelerated curriculum, and address the needs of all children in the school, but particularly the needs of those at risk of not meeting the challenging state academic standards.

6.1To assist targeted assistance schools (TAS) and LEAs to meet their responsibility to provide for all their students served under this part the opportunity to meet the challenging state academic standards, each TAS shall carry out the following: (20 U.S.C. § 6315[b])
(a)The TAS program shall use resources to help eligible children meet the challenging state academic standards. (20 U.S.C. § 6315[b][2][A])
(b)The TAS program shall serve participating students by using effective methods and instructional strategies that strengthen the academic program of the school. (20 U.S.C. § 6315[b][2][B])
(c)The TAS program shall coordinate with and support the regular education program of the school. (20 U.S.C. § 6315[b][2][C])
(d)The TAS program shall provide professional development to teachers, principals, school leaders, paraprofessionals, and other school personnel who work with eligible children. (20 U.S.C. § 6315[b][2][D])
(e)The TAS program shall implement strategies to increase the involvement of parents of eligible children. (20 U.S.C. § 6315[b][2][E])
(f)The TAS program, as applicable, shall include coordination and integration of federal, state, and local services and programs.

NorD 07: Notices in Primary Languages
7.0When 15 percent or more of students enrolled in a public school speak a single primary language other than English, as determined by language census data from the preceding year, all notices, reports, statements, and records sent to the parent or guardian of such students shall be written in English and the primary language. 8.0For all categorical programs, the LEA must maintain an inventory record for each piece of equipment, with an acquisition cost of $500 or more per unit, that is purchased with state and/or federal funds. The record describes the acquisition by:

8.1Capital expenditures for special purpose equipment are allowable as direct costs, provided that items with a unit cost of $5,000 or more have the prior written approval of the federal awarding agency or pass-through entity.

8.2Disposition of equipment purchased with Title I funds with a fair market value of $5,000 or less may be retained, sold, or disposed of with written approval of the federal awarding agency or pass-through entity.

8.3The school district must conduct a physical check of the inventory of equipment within the past two years and reconcile the result with inventory records. (2 CFR § 200.313[d][2])

III. Funding
NorD 09: Supplement Not Supplant
9.0The LEA shall use federal funds received under this part only to supplement the funds that would, in the absence of such federal funds, be made available from state and local sources for the education of students participating in programs assisted under this part, and not to supplant such funds. (20 U.S.C. § 6321[b][1])
9.1To demonstrate compliance with the above paragraph, the LEA shall demonstrate that the methodology used to allocate state and local funds to each school receiving assistance under this part ensures that such school receives all of the state and local funds it would otherwise receive if it were not receiving assistance under this part. NorD 10: Coordination with Other Funds
10.0The correctional facility shall coordinate Title I, Part D funds with the following:

IV. Standards, Assessment, and Accountability
NorD 13: LEA Program Evaluation
13.0The correctional facility shall ensure that educational programs are related to assisting students to meet the challenging state academic standards.

13.1At least once every three years, the LEA shall evaluate the NorD Program, disaggregating data on participation by gender, race, ethnicity, and age while protecting individual student privacy, to determine the program’s impact on the ability of participants for the following:

(a)To maintain and improve educational achievement and to graduate from high school. (20 U.S.C. § 6471[a][1])
(b)To complete high school (or high school equivalency requirements) and obtain employment after leaving the correctional facility or institution for neglected or delinquent children and youth. (20 U.S.C. § 6471[a][4])
(c)To accrue school credits that meet state requirements for grade promotion and high school graduation. (20 U.S.C. § 6471[a][2])
(d)To make the transition to a regular program or other education program operated by an LEA or school operated or funded by the Bureau of Indian Education. (20 U.S.C. § 6471[a][3])
(e)To participate in postsecondary education and job training programs as appropriate. (20 U.S.C. § 6471[a][5])
13.2The LEA shall use multiple and appropriate measures of student progress in evaluating NorD Programs. (20 U.S.C. § 6471[c])
13.3The LEA shall submit evaluation results to the California Department of Education. (20 U.S.C. § 6471[d][1])
13.4The LEA shall use evaluation results to plan and improve subsequent programs for children and youth. (20 U.S.C. § 6471[d][2])
