16/01302/FUL Land adjacent to Bidford Road, BroomImpact on Neighbours
Following further consultation with the Council’s Environmental Health Officer, it has been confirmed that the provision in the S106 legal agreement to retain the soft planting adjacent to but outside the eastern boundary of the application site shall be omitted, and that it shall secure only the following:
- the building shall be used for storage only, but not that of pesticides, fertilisers or farm chemicals, slurry, silage or any other farm input of product likely to cause a nuisance to future occupiers of the development;
- the building shall not be used for the housing/handling of livestock or other animals.
Highways Matters
In response to the amended site layout plan and confirmation from the agent that the cul-de-sac would not be put up for adoption, additional comments have been received from WCC Highways. No objection is raised, however alternative conditions are suggested. As the road is no longer proposed to be adopted, condition 10 is no longer required. Following additional condition recommended:
‘The access to the site for vehicles shall not be used unless a bellmouth has been laid out and constructed within the public highway in accordance with the standard specification of the Highway Authority.
Reason: To ensure safe access to the site in accordance with the provisions of Policy CS.26 of the adopted Stratford-on-Avon Core Strategy (2011-2031)’

Councillor Hazel Wright - Policy CS20 states that proposal must not unacceptably detract from amenities of any neighbouring property by reason of loss of privacy. In the context of this application privacy is a sensitive amenity issue and is arguable as well as probably marginal. Whilst technically measurements may fit the agreed criteria in the Extending Your Homes Guidance Document, the reality is often very different and requires judgement. I request a site visit by the committee members to enable this to happen (e-mail Tuesday 27 September 2016)
