[Note to Contract Manager: contract cancellation is a serious matter. The usual enforcement process works through verbal/written warnings then progresses to Notice to Comply (NRS1301) and then to Stop Work Order (NRS1302) and then to Contract Cancellation (NRS1303). However, some situations may call for immediate SWO and then to cancellation or immediate cancellation. It is highly recommended that you speak with a CSNR Procurement Specialist before cancelling a contract.]

Pursuant to provisions contained in the above-noted contract, and further to the Notice to Comply and/or Stop Work Orderissued enter date of any enforcement letter previously issued, your contract is hereby cancelled.

As a consequence of this contract cancellation:

  1. As per enter clause/article # of the Agreement, the ministry reserves the right to recover damages through the performance security.
  2. As per enter clause/article # of the Agreement, contract payment holdbacks are subject to forfeiture in whole or in part.
  3. The ministry reserves the right to recover additional damages through set-off of future payments.
  4. The ministry reserves the right to recover additional damages through litigation.
  5. The ministry reserves the right to submit a discipline and ethics complaint to your professional association.

(Note to Contract Manager: the activity being suspended from can be a specific activity such as brushing and weeding, wildlife surveys, food and safety inspections, etc,or if the type of breach warrants it can be specific program activity such as silviculture, protection, habitat management, etc. The period of time for suspension can be modified based on Table 20-2 of the Contract Management Manual; however, in all casesit should be consistent with like contract breaches issued from the office. The area of suspension utilizing this contract cancellation notice resides with the manager of the responsibility center; disqualification outside the manager’s area of responsibility requires consultation with a CSNR Procurement Specialist who provides a template letter.)
