WHEREAS, this session is anticipated to last approximately one hour; and

In accordance with the rules and regulations of the New Jersey State Green Acres Program, the Mayor and Council of the Borough of Woodcliff lake will be conducting a public hearing to discuss the potential acquisition of the Freedman Property located at 63 Werimus Road (Block 1202, Lot 1) and the Hatheway Estate at 75 Werimus Road (Block 1401, Lot 6) as part of a regularly scheduled public meeting in Borough Hall, 188 Pascack Road, Woodcliff Lake, NJ held on November 5, 2008 at 8:00 p.m. or as soon thereafter as the matter can be reached.

RESOLUTION REQUESTING COAH REVIEWING AND APPROVING THE AMENDED DEVELOPMENT FEE ORDINANCE OF THE BOROUGH OF WOODCLIFFLAKE (Consent Agenda - 3)
WHEREAS, the Borough of Woodcliff Lake has previously endorsed the Fair Share Plan adopted by the Woodcliff Lake Planning Board and has authorized the filing with the council on Affordable Housing (“COAH”) of the Housing Element and Fair share Plan dated October, 2008 prepared by Burgis Associates, Inc. (Donna Holmqvist, P.P., (Principal Planner) and other related and required documentation, pursuant to COAH’s Third Round Regulations (“Regulations”), in order that the Borough seek Third Round substantive certification; and
WHEREAS, the Regulations at N.J.A.C. 5:96-5.1(a) require that amendments to the Borough’s current development fee ordinance be made to conform to the current Regulations; and
WHEREAS, the Regulations at N.J.A.C. 5:96-5.1(b) require that the Borough request that COAH approve the proposed amended development fee ordinance submitted on behalf of the Borough to COAH with the filing of the Housing Element and Fair Share Plan.
NOW, THEREFORE, BE IT RESOLVED, that the Borough of Woodcliff Lake does hereby request that COAH review and approve the amended development fee ordinance so submitted, with the intention of adopting the same once approved by COAH.

Resolution Requesting That COAH Review and Approve the Borough of WoodcliffLake’s Spending Plan as Submitted (Consent Agenda - 4)
WHEREAS, the Borough of Woodcliff Lake has previously endorsed the Fair Share Plan adopted by the Woodcliff Lake Planning Board and has authorized the filing with the New Jersey council on Affordable Housing (“COAH”) of the Housing Element and Fair Share Plan dated October, 2008 prepared by Burgis Associates, Inc. WHEREAS, the Regulations at N.J.A.C. 5:97-8.1 (d) require that a municipality with an affordable housing trust fund receive approval of a spending plan from COAH prior to spending any of the funds in its housing trust fund; and
WHEREAS, the Borough has submitted to, and requested that, COAH approve an amended development fee ordinance pursuant to the Regulations, which amended ordinance would also amend the Borough’s previously approved affordable housing trust fun; and
WHEREAS, the Borough of Woodcliff Lake has prepared a spending plan consistent with N.J.A.C. 5:97-8:10 and P.L. 2008, c.46, and has submitted the same to COAH with the filing of the Housing Element and Fair Share Plan.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Woodcliff Lake does hereby request that COAH review and approve the Borough’s spending plan, as submitted.

RESOLUTION REQUESTING APPROVAL OF ITEMS OF REVENUE AND APPROPRIATION – CHAPTER 159 – NJSA 40a:4-87 – PROSECUTOR FORFEITURE FUNDS (Consent Agenda - 5)
WHEREAS, NJSA 40A:87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount was not determined at the time of adoption of the budget; and
WHEREAS, the Director may also approve the insertion of an item of appropriation for equal amount.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Woodcliff Lake in the County of Bergen, New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2008 in the sum of $29,134.00 from the office of the County Prosecutor, Forfeiture Funds, which is now available from the County of Bergen, Office of the Prosecutor in the amount of $29,134.00 (8-01-10-704-000).
BE IT FURTHER RESOLVED, that the like sum if $29,135 is hereby appropriated under the caption of Prosecutor Forfeiture Funds (8-01-41-790-0999).
BE IT FURTHER RESOLVED, that the above is the result of funds from the Office of the CountyProsecutor, County of Bergen, New Jersey.

Resolution Authorizing Release of Escrow Balance and Building Permit Fees

WHEREAS, a request has been made for the release of the escrow balance and Building Permit Fees related to the proposed construction of a house at 55 Woodcliff Avenue, and
WHEREAS, the property owner, Ronald Rasmussen has advised the Construction Official that they have decided not to construct the swimming pool at this time, and
WHEREAS, the Borough Construction Official has confirmed that all is satisfactory and has recommended that the escrow balances and Building Permit Fees in accordance with the following be released;

RESOLUTION AUTHORIZING PAYMENT OF TAXES DUE NOVEMBER FIRST, TO BE DELETED DUE TO APPLICATION FOR 100% PERMANENT DISABILITY BY THE U.S. DEPARTMENT OF VETERAN AFFAIRS ACCORDING TO NJSA 54:4-3:30 (Consent Agenda – 11)
WHEREAS, the owner of Block 508 Lot 22, 16 SOMERSET DRIVE, Thomas S. Malone. has been approved for 100% disability as of May 17, 2006, and
WHEREAS, this approval has resulted in all taxes to be exempt, and
WHEREAS, Thomas S. Malone has been awarded this exemption, and therefore are entitled to this exemption of taxes levied by the county for the years of 2006, 2007, & 2008 on Block 508 Lot 22, and
WHEREAS, the tax collector, Lois Frezza is authorized to exempt his taxes due for November 2008 and delete the first half 2009 estimated taxes levied by the County
