The Governor in Council makes the following Regulations:

1 Objective

The objective of these Regulations is to amend the Public Health and Wellbeing Regulations 2009—

(a) to amend the prescribed period of time to provide a birth report; and

(b) to ensure nursing homes or other relevant aged care facilities continue to be exempt from the prescribed accommodation provisions; and

(c) to correct an inconsistency in a reference to blood lead levels; and

(d) to update and standardise notification forms.

2 Authorising provision

These Regulations are made under section 232 of the Public Health and Wellbeing Act 2008.

3 Commencement

These Regulations come into operation on 1 July 2017.

4 Principal Regulations

In these Regulations, the Public Health and Wellbeing Regulations 2009[1] are called the Principal Regulations.

5 Time to provide birth report

In regulation 11 of the Principal Regulations, for"90 days" substitute "30 days".

6 Exempt prescribed accommodation

For regulation 14(e) of the Principal Regulations substitute—

"(e) a residential care service within the meaning of the Aged Care Act 1997 of the Commonwealth; or".

7 Notification of notifiable conditions by pathology services

In regulation 72(3)(j) of the Principal Regulations, for "10µg/dL" substitute "5µg/dL".

8 Schedule 6—Notification by medical practitioners

In Schedule 6 to the Principal Regulations—

(a) in item 4 of Form 1 omit "Signature:";

(b) in item 4 of Form 2 omit "Signature:";

(c) in item 3 of Form 3—

(i) omit "Signature:";

(ii) for "Date of notification:" substitute "Date of report:";

(d) in item 3 of Form 4—

(i) omit "Signature:";

(ii) for "Date of notification:" substitute "Date of report:".
