REQUEST FOR ZONING PERMIT
Zoning requests cannot be reviewed until the property owner, or their agent as the applicant, provides, the required documents and fees and all information requested on the application, to the Zoning Office.
Required documents and fees for zoning approval. Contact the Construction Office for their requirements
· Completed application, on reverse side, and fee - $30 residential, $60 commercial.
· If the Planning Board or Board of Adjustments approved the request, a copy of the resolution is needed.
· Homeowner Association approval letter, if applicable.
· A plot plan or survey of the property showing placement and dimensions of the proposed structure and its distance from all property lines. The plot plan or survey shall include all existing structures and improvements.
· For sheds less than 100 square feet or fences no other items are required for zoning approval.
· A construction folder signed by a construction office staff member.
· For signs, a diagram showing the dimensions and placement of the proposed sign.
· Except for single or two family dwellings site plan approval is required if, Zoning and Construction permits are to be issued, and, for a change of use of land or structure where the standards are more restrictive.
· A Grading Plan based on the following:
o A notarized Grading Exception, for property not in a Flood Zone, may be allowed for:
q Installation of a pool, spa, hot tub, or deck.
q Reconstruction of an existing structure on the same footprint.
q Construction of an addition or accessory structure on an existing concrete slab.
q Construction of an upper level addition that does not extend beyond the lower level.
q An addition or accessory structure less than 144sf that meets the schedule of requirements for the respective zone.
o If a Grading Exception is not allowed, a Grading Waiver from Strict Compliance may be allowed for additions or accessory structures if the structure meets the schedule of requirements for the respective zone. A plot plan or survey showing all existing and proposed structures is required. As this form needs to be notarized all information and calculations are to be completed and entered by the Property Owner or the Applicant. The fee is to be collected by the construction office after application review by the Zoning Office.
o A full grading plan is required for all other proposals or if an Exception or Waiver is not allowed. Four sealed copies, supplied by an engineer, are required. The fee is to be collected by the Construction Office.
After zoning and construction permits are issued for any new principal structure, addition or accessory structure, four copies of a Foundation As-Built plan is required prior to framing, placing the modular unit or prefabricated unit on the foundation. A Final As-Built plan is required prior to issuance of a Certificate of Occupancy.
For the construction of a new principal structure, whether for commercial or residential use, or commercial property renovations in excess of $15,000, a mandatory development fee, to be determined by the tax assessor, needs to be paid; fifty percent upon issuance of construction permits and the balance upon issuance of certificate of occupancy.
A legal non-conforming structure cannot be enlarged, extended or increased without approval from Board of Adjustments, even though the proposed alteration may conform to current zoning requirements.
