Sexual Misconduct

I.Purpose:Alljailpersonnel,swornandcivilianareempoweredwithauthoritybytheir governmentto performtheir duties freeofcriminalactivity. Whenany staffusesthis authorityforsexualpurposes, andviolates anotherperson,thestaffnot only commits a crimeagainstthevictim,butdamagesthecredibility andtrustoftheentirejailwiththe public. The purpose of this policy is to establish zero tolerance for any sexual misconduct andcautionallstaff, contractors,vendors,volunteers,interns thatany violation of the public trust involving sexual misconduct will result in severe consequencesincluding,dismissal,any authoritytobepresent onthejailproperty, termination ofcontractandprosecutiontothefullest extentpossible.

II.Policy: Itisthepolicyofthisjailtotrainallpersonnelconcerningthepotentialforsexual misconductwithinthejail,how torecognizeit,andtherequirementsforreporting any violation totheappropriateauthorities. Staff Sexual Misconduct KRS510.120(1c) personis guiltyofsexual abuseintheseconddegreewhen;

a.Sexualactsorsexualcontactbetweenanystaffpersonandanoffender,evenif theoffenderconsents,initiatesorpursues,arealwaysprohibitedandalways illegal.

b.Sexual misconductis:

i.Anysexual advance bystaffmembers

ii.Requestsfor sexualfavors bystaff members

iii.Threatsbystafffor refusingsexual advances

iv.Verbalorphysicalconductofasexualnaturetowardanoffenderbystaff members, contractsstaffor volunteers oftheDepartmentofCorrections,

v.Invasionofprivacybeyondwhatisreasonablynecessaryforsafetyand security.

c.Being an employee, contractor, vendor, or volunteer of the Department of Corrections,orDetentionFacility asdefinedinKRS520.010,orofanentity under thecontractwitheitherthedepartmentoradetentionfacilityforthecustody,

incarcerated,supervised,evaluated,ortreatedbyDepartmentofCorrections,the detentionfacility, or thecontractingentity,tosexual contact.

III. Definitions:

A. CriminalSexualMisconduct: Theabuseofauthoritybyanyjailpersonnelforsexual purposes thatviolatethelaw.

B. SexualMisconduct:Anysexualactivitywhileon-dutyorstemmingfromofficialduty.

Sexual misconductincludesbutis notlimitedto useofofficialpositionandofficial resources toobtaininformationfor purposesofpursuingsexual conduct.

C. IntimatePart:Genital area,inner thigh,groin,buttocks or breasts ofa person.

D. Actor:Thepersonaccused ofsexual assault

E.SexualContact:Anycontactforthepurposeofsexualgratificationoftheactorwith theintimateparts ofapersonnotmarried to the actor.

IV. Procedure:

A. Sexual activityofanynature while ondutyis prohibited.

B. Sexualactivityinthejailfacility,jailvehicleorjailpropertywhileondutyoroffdutyis prohibited.

C. Employeesshallnotenterintoanintimatepersonalrelationshipwhiletheinmateis incarcerated atthesamejail thattheemployeeis employed by.

D. Employeesshallnotenterintoandintimatepersonalrelationshipwitha formerinmate

withinsixmonths oftheinmate’s release.

E.Sexual Misconduct is prohibited and shall be disciplined up to and including terminationand prosecutiontothefullestextent.

F.Anycontactforthepurposeofsexualgratificationoftheactorwiththeintimateparts ofapersonwhile on dutyis prohibited.

G. All swornjailemployees,paidcivilianstaffandvendors/volunteersshallnotengagein sexualcontactwithanotherpersonwhensuchstaffhassupervisory ordisciplinary authorityover such other person.

H. Indicatorsof Sexual Misconduct:

Behaviorthatconstitutessexualmisconduct can occurbetweenstaffandstaff,staff andinmates,contractorsandinmates,volunteersandinmates,etc.,whetherthe

samegenderor oppositesex. Sexual misconductis nottolerated. For a better understanding of the issue, here are some of the scenarios that may lead to allegations ofsexualmisconduct and disciplinaryand/or criminal action:

1. Touching, hugging, kissing, sexual assault, penetration, fondling, inappropriate viewing,sexual conduct,sexual harassment,sexual abuse,sexual gratification, romantic relationships,andpost-releaserelationships withinmates;

2. Tellinga dirtyjokeinfront ofaninmate;

3. Anemployeefallsinlovewithaninmate andagreestocohabitate,support ormarrieshim/her uponrelease;

housing unit;

5. Afemalestaffmemberfailstoannounceherpresencewhensheentersaman's housing unit;

6.Ajailstaffmemberunnecessarily touchesaninmatewheneverorwhereverhe/she wantsto;

7. Allowinginmatestotalkaboutsexualexperiencesorsexual fantasiesortellingsexual jokes injail staff'spresence;

8. Allowinginmates totalk or yellsexuallyexplicit commentsor suggestions;

9. Postingasexuallysuggestivecartoononthestaff bulletinboard;

10.Aninmatehas possessionofjail staff’sphotograph;

11.Jailstaffhavingin hispossessionaphotographofaninmate;

12.JailstaffwatchingTV in thedormarea oftheoppositesex;

13.Jailstaffmakingextraorextendedtimecellchecksinsecuredareawhereopposite sexinmatesarehoused;

14.Allowinganinmateinto anunauthorized area;

15.Touchingintendedtohumiliateor degrade;

16.Jailstaffcoveringfor other staffmemberswhomaybeengaginginsexual misconduct;

17.Lyingto protectapeeraboutpossiblesexual misconduct;

18.Inmatesfightingabouttheattentions ofjail staff;

19.A missinginmateduringheadcount;

20.Jailstaffnotmakingtherequiredcellchecks;

21.Exchanging gifts orfavors betweenjailstaffandinmates;

22.Jailstaffplacingmoneyinto aninmate's commissaryaccountor providingcontraband;

23.Privateshiftparties;

24.Staffthat over-identify withtheinmate(myinmate)ortheirissues(i.e.blindtoinmate's actions);

25.Horse-playor sexual interactionbetweenstaffandinmates;

26.Staffmembers providingpersonal information toinmates;

27.Staffisolationfromother staff;

28.Inmatehas lettersor photosofstaffor viceversa;

29.Staffgrantingspecial requests or showingfavoritism;

30.Staffspending anunexplainableamount oftimewith aninmate;

31.Telephonecalls toandfromstaff andinmates;

32.Rumorsofinmateandstaffinvolvement;

33.Staffin orattempting togain entryinto thefacilityduringoff hours;

34.Aftercompletingtheintakeprocessandbeingconfinedtothejailforawhile,an inmatebecoming pregnantor being diagnosedwithasexuallytransmitteddisease [STD];

35.Staff overlyconcernedaboutaparticular inmateor viceversa;

36.Drasticchangeofbehaviororappearanceonthepartofaninmate,suchasgrooming habits,dress, make-up,or hair;

37.Staff attempting tohavesoleinvolvement orprotectionofaparticular inmate;

38.Indispensableinmate...only onewhocando thejob;

39.Suddenchangeinnumberofinmategrievances;

40.Inmatewanting togotowork earlyorvolunteeringtostaylate;

41.Staffconfrontingstaff over aninmate;

42.Staffinterceptinginmate disciplinaryinfractions or editinginfractions;

43.RepeatIsolatedposts/positions/workassignments[i.e.takinganinmateouttotrash dumpsteratnighttimeandstayingalengthoftimelonger thannecessary];

44.Staffcan'taccountfor time;

45.Staff'sfamilybeinginvolvedwithinmate'sfamily;

46.Increaseincontrabandin anarea;

47.Staffrepeatedlyisolated andworkinginasecluded areawithsameinmate(s);

48.Staff takinginmates outofcellatunusual times;

49.Staffinpersonal crisis [divorce, illhealth,bankruptcy, deathinfamily];

50.Unusualbalanceor activity,in aninmate's commissaryaccount;

51.Staffsharingfoodor snacks withinmates;

52.Staff testifyingfor aninmate,requestingspecial treatmentfor aninmate;

53.Staff delegatingtheir duties toinmates;

54.Overheardconversationsbetweenstaffandinmateswhichissexualinnatureorrefers to thephysical attributes ofstaff or inmates;

55.Inmatesexual activity;

56.Sexual or personalbanter betweenstaffandstaff or staffandinmates

Ofcourseanyoneorseveraloftheseindicatorsmaynotrisetoalevelofreasonable suspicionthatsexual misconductisthecause. However, deputiesobserving such behaviorshouldneverthelessbeconcernedanddiscusstheir observations andconcerns withthedeputyinvolved,ortheir supervisor depending ontheindividualized circumstances. Caughtearlyenoughthedeputyinvolvedmayonlyrequirecounseling, reassignment,oradditionaltraining. Theseindicators,ifconsistentlyappearingshould notbeignored or toleratedbyfellowdeputies or supervisors.

I.Training: All employees of this Jail including supervisors, contractors and volunteer/internswillreceivespecificannual training abouttheelementsofsexual misconductinvolvingjail personnel. Thetrainingwill bedocumentedandalso include all elementsofthispolicy aswell asthePrisonRapeElimination Act(PREA) policy and procedureswhichcovers sexual misconductofinmateoninmateor staffon inmate.

J.ReportingRequirements: AnyemployeeofthisJail,whoismadeawareofany violationofthis policy,isrequiredtoreport theviolationtotheir supervisor. The supervisorwillimmediatelycontacttheJailerortheirdesigneewhowillimmediately initiateaninvestigationinaccordancewiththeir establishedinvestigativepolicy. The investigationwillinvolveotherinvestigativeelementsofthejailasnecessary andany forensic evidencewillbeprotectedand processedimmediately. Theaccusedstaff member’ssupervisorwill not attempttoresolveacomplaintofthis naturewiththe complainant,andisrequiredtomakeimmediatecontactwiththeJaileror their designee. Iftheviolationinvolvessupervisorypersonnel,thereportingemployeewill notifytheJailorortheirdesignee.,Anonymousreportingcan follow his/herchain of command,godirectly totheJailerortheir designeeadditionally theanonymous reporter cangooutside thejailandreport theCountyJudge/Executive.

K. No personshallberetaliatedagainstfor reportingsexual misconduct.

L. Discipline

Any employee found to be in violation of the provisions of this policy shall be disciplineduptoandincludingterminationandcriminal charges where established.

Any employeehavingknowledgeofaviolationofthispolicy,whofailstoreportsaid violationshallalso be disciplined upto andincludingdismissal, andcriminal charges if appropriate.

M. Training:Allemployeesofthisjailincludingsupervisors,contractorsand volunteer/internswillreceivespecificannual training abouttheelementsofsexual misconductinvolvingjail personnel. Thetrainingwill bedocumentedandalso include all elementsofthispolicy aswell asthePrisonRapeElimination Act(PREA) policy and procedureswhichcovers sexual misconductofinmate oninmateor staffon inmate.
