A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-7-375 SO AS TO REQUIRE A HOSPITAL, NURSING HOME, OR OTHER LICENSED FACILITY TO INCLUDE AND MAINTAIN INCIDENCE AND OCCURRENCE REPORTS PERTAINING TO PATIENTS IN THE PATIENT’S MEDICAL RECORD.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

“Section 44-7-375. Notwithstanding any other provision of law, a hospital, nursing home, or other facility licensed under this chapter by the Department of Health and Environmental Control shall include and maintain as part of a patient’s medical record any incidence or occurrence report that the hospital, nursing home, or facility makes that involves or in any way is related to the diagnosis, care, or treatment of a patient.”

SECTION 2. This act takes effect upon approval by the Governor.
