Agreement concerning admission – For External institutions Part c

§ 1-2 Objective

This agreement aims to ensure that the doctoral student has satisfactory working conditions for completion of doctoral education and dissertation.

In addition to this agreement, Parts A and B between Buskerud University College and (doctoral candidate name), and the Regulations for the degree of Philosophiae Doctor (PhD) at Buskerud University College apply as additional provisions.

§ 1-3 Additional partner institutions

In the event of collaboration with two external institutions (financing institution and the institution providing workplace), an agreement for each institution must be entered into.

§ 1-4 Definition of parties

The parties included in this agreement are

  1. The PhD candidate: (full name), (title), (date of birth), (date) of admission to the PhD program (degree)
  2. Buskerud University College, Department (name), represented by (dean name), dean
  3. (External party/company), represented by (Chairman/CEO/Managing Director)

Chapter 2 – Rights, obligations and cooperation

§ 2-1 The university college’s rights and obligations

The university college undertakes to:

  • provide a supervisor for the student throughout the contractual period
  • providetheoretical and methodologicaltraining

The university college may also:

  • Hire the student during the contractual period. The employment is subject to the Civil Service Act and regulations, guidelines for employment in educational positions established by the Ministry of Education and Research on June 10, 2003, and the supplementary provisions of the policy that apply at all times. In case of employment, a separate employment agreement must be entered into to regulate the employment relationship
  • Provide work and the necessary equipment for the student

§ 2-2 The external party’s rights and obligations

The external party undertakes to:

  • Finance thedoctoraleducation

and/or

  • Provide work and the necessary equipment for the student. In the event the student is provided work at the institution, the related costs will be included in the financing of the PhD program. If the salary/scholarship and equipment are split between the institution and the external party/parties, such shall be included in the contract.

The external party may also:

  • Hire the student during the contractual period. During the employment period, the student will be guaranteed satisfactory working conditions, so that he/she is guaranteed a total research period of three years, and so the research period constitutes at least 50% of the work period.
  • Provide a supervisor for the student during the contractual period.

§ 2-3 Collaboration among parties

The Parties undertake to closely cooperate and to contribute to the implementation of the doctoral program. The Parties shall keep one other informed of all matters relevant to the implementation of the program. All matters relating to the parties’ obligations, as set forth in this chapter, which may affect the implementation of the agreement or of the aforementioned rights and obligations, shall as early as possible be brought to the other party’s attention.

The Parties shall, when the information and conditions specified in the first paragraph have been imparted to the other party, work together to find a solution to the problem.

Chapter 3 – General provisions

§ 3-1 Equipment

The student shall have at his/her disposal the necessary equipment for the implementation of the research project, see § 3-5 in PhD regulations. The dean determines what constitutes necessary equipment and funding, at the corresponding department, in consultation with the external party involved in the research project. The department where the student works is responsible for fulfilling the obligations in this respect. The university college and the external party shall negotiate any agreement on funding for extra equipment and assets.

§ 3-2 Rights regarding the use of results

In accordance with the agreement with the student, the school has the right to gratuitously make use of the results for research and educational purposes. This applies to the doctoral dissertation and to other academic works that are the result of the thesis work and upon which the student holds the copyright.

The university college, the student and the external party shall enter into a separate agreement on the extent to which the external party has the right to use the results presented in a doctoral thesis.

The external party may not impose conditions that all or parts of the doctoral thesis may not be released or published.

There shall be no restrictions on the publication of a PhD thesis, with the exception of a previously agreed brief postponement of the date of release/publication so that the external party, in the event that usage rights are transferred to it, can decide any patenting/commercialization.

§ 3-3 Expenses

Student is employed by (external party/university college) during the contractual period, from (date) to (date). All payments shall be made to the account (number). During the contractual period, the student will work at (department/university college/external party).
During the contractual period, the student will require additional expenses for the following purposes:

  • (purpose).

Total costs are estimated at NOK (amount), which is paid/made ​​available by the (department/university college/external party).

§ 3-4 Final provisions

Any changes or additions to this agreement must be made in writing.
Disputes concerning the interpretation of this agreement shall be resolved by negotiations.

§ 3-5 Signature

The agreement hereunder falls under the prevailing rules of research. Each party has received an original executed copy of the contract. The university college’s original is filed at the relevant department.
