· The consequence of Incarceration on Compensation/ Pension is more straight forward. The 38 CFR (Code of Federal Regulations 3.665 outlines the impact incarceration it has on veterans who are in receipt of Compensation. A veteran with a service connected disability will have his/her rating reduced upon 61st. day of incarceration after conviction of a felony in one or two ways. First, if the veteran has a 20% or more disability rating, the payment is reduced to the rate of 10%. If 10% service connected it will be reduced to half the rate of 10%. The 38CFR (Code of Federal Regulations) 3.666 states that the Pension benefits will be discontinued effective on the 61st. day of imprisonment following conviction of a Felony or Misdemeanor.
· The National Defense Authorization Act for fiscal Year 2006 expands TRS Coverage to all qualified members of the Selected Reserves.
