This is horse boarding agreement between (owner)(owner’s agent) herein referred to as Boarder, and Flying H Ranch Stables, herein referred to as Flying H. On (Date of arrival. Please do not leave blank) boarder will present the animal(s) description section of this contract.

Boarder Choice (check one):

Flying H offers several boarding options for your convenience including Full Board and Pasture.All horses must be on regular deworming and farrier programs. Horses must be up to date on vaccines and must have proof of a negative Coggins test. Our current farrier is Circle T and our veterinarian is Dr.Edwards.You are welcome to use them or your own vet and farrier.We feed top qualityCoastal grass, and use Total Equine,14% protein/2%crude fat OR 12% protein/8% crude fat and oats. All prices are subject to change with economy flux.

FULL STALL BOARD:is available for $330/month up to $385. Each horse will have a stall or paddock. Full stall board includes daily stall cleaning, feeding, and watering. Flying H will provide hay, and grain per day as per feeding contract. The amount and cost of grain is based on which choice of feed you chose.For very hard keepers, extra feedings of grain are available for an extra cost, as well as additional hay at owners expense.Supplements will be fed at no additional charge per the owner’s request. We ask that all supplements provided by the owner be in original containers, or in Smart-Paks or be pre-measured baggies that the owner will measure out.

  • Stall with run (one horse only): Will provide the Boarder’s horse with 12’x 54’ stall/run combination, water, hay, and grain daily.Feed is divided into two feedings per day. Stalls will be cleaned once a day and six days a week. All the stalls are sand, and there is a fly spray system throughout the barn and over each stall. This includes stall numbers 1-8. #
  • Stall with small pen (one horse only): Will provide the Boarder’s horse with a 12’x24’ stall with above daily cleaning and feeding arrangements. This includes stall numbers 9-16#
  • Outside Paddock (one horse only): We have 11 outside stalls with an average size of 50' X 75' with a 12' X 12' shelter. Outside stalls are cleaned once a week.This includes paddock numbers 17-22A,22B-27 #

PASTURE BOARD:is available for $255/month up to $305.This area is shared with numerous other horses (two-six horses).This may be a mixed gender environment. Pasture Board includes daily feeding andwatering. Horses will have access to a 12x16 run-in shed and, fenced with smooth-wire cablefencing. Flying H will provide hay, and grain per day as per feeding contract.The amount and cost of grain is based on which choice of feed you chose. For very hard keepers, extra feedings of grain are available for an extra cost, as well as additionalhay.Supplements will be fed at no additional chargeper the owner’s request. We ask that all supplements provided by the owner be in original containers, or in Smart-Paks or be pre-measured baggies that the owner will measure out. This includes stall numbers A/B or North Pasture

IF FLYING H CONTINUES TO HAVE TO PICK UP AFTER YOU IN COMMON AREAS

USE OF THE FACILITIES: & BARN RULES

All boarders have full use of the facilities including the2 tack rooms,sand riding arena, round pen, wash rack/vet stock, FARRIER pad, walker, arena equipment, trailer parking, and short trails.Sorry, there is not a public restroom at this time. There is an outhouse. Borders are allowed one tack boxor bin per horse (unless authorized by barn manager) and should keep their area neat and clean at all times. Possessions left all over the ranch willbecome the property of Flying H.

  1. Barn hours are 8:00 am to 10:00 pm.
    Summer months 7:00-11:00
  1. No running or yelling in the barn or around the horses. This includes spectators! It is NOT the instructor's job to supervise children not in a lesson, and others should not need to ask them to stop running and yelling on the ranch.
  2. Each person on the property must sign a release. Anyone other than you who will be riding, caring for or visiting your horse on a regular basis should be introduced to STABLE staff so that we know they have your permission to work with your horse.
  3. Protective headgear required by all those under 18 years of age.
  4. Children under 18 years of age must be supervised by a parent or guardian at ALL times, especially children not in the lesson. If your child who is not in the lesson becomes upset (screaming/crying), please remove them to a location separated from the horses and away from any ongoing lessons. Loud noises could startle or frighten the horses and pose a safety risk to anyone working around them.
  5. Dogs must be on a leash at all times and have proof of an up-to-date rabies vaccine. It is also strongly recommended that your dog be wearing his/her license and name tag. Dogs that are aggressive towards people or other animals are not welcome.
  6. No riding, mounting or dismounting in barn aisle ways.
  7. Do not leave a tied horse or a horse on the cross ties unattended. Halters should be taken off when the horses are turned out in the pasture and hung up with their lead rope back in the barn. They should also be taken off when horses are in their stalls.
  8. Do not feed, touch or handle anyone else’s horse without their written permission. Do not take a horse out of their stall or pasture without written permission to do so.
  9. Clean up after yourself and your horse in ALL common areas, including sweeping the crosstie areas and removing your horse’s manure from the arena footing. Common Areas are Barn ally, round pen, walker, WASHRACK, FARRIOR PAD and ALL GRASSY AREAS. If you horse leaves a pile of manure in the aisle way or in the arena (etc.), it should be cleaned up immediately. Do not leave your possessions around the barn or they will be donated to charity or become the property of Flying H after 90 days.
  10. Keep your tack and equipment tidy in the tack room. Treats must be in sealed containers. All tack and equipment used should be put away after every use.
  11. Do not use anyone else’s tack, equipment, supplies or treats without their permission.
  12. IF YOU OPEN THE GATE CLOSE IT, IF YOU TURN THE LIGHT ON, TURN IT OFF

Horsemanship Policy

This policy is to provide an enjoyable and safe horse facility. Your suggestions are always welcome.

  1. All horses shall be treated in a humane manner at all times. No cruel or unsportsmanlikeconduct will be tolerated including: roughness, roping, wrestling,intentionally causing disobedience, causing bucking, rearing, or any movementsthat endangers the health of the horse or human.
  2. Horses are to be kept under control with supervision at all times, being led byhalter or bridle, tied at designated hitch rails, and attended while tied.
  3. Injured or ill horses must be attended to immediately by owner or owner’s agent .
  4. Horses may be ridden or handled only with the horse owner’s consent. A signedwaiver must be on file.
  5. Outdoor riding arena, round pen, walker, wash rack, farrier pad is available to all boarders. Safety first!Arena may be reserved for special activities through the owner, at non-peak times. Must reserve 4-7 days in advance.
  6. All riders are required to read and sign an Acknowledgment and Waiver prior to use of horses or facilities.
  7. All visitors, riders, and boarders are responsible for proper conduct of theirfamilies, pets, guests, while on the premises. Cooperation is needed to keep thefacilities in good condition. Should damage occur to horses, equipment, orfacilities, boarder will be held responsible for the cost of repairs and maybe asked to leave, depending upon the severity. Please report, any neededrepairs or hazards to Flying H.
  8. No SMOKING in barn, paddocks and pastures!!! Smoking permitted in pavilion and personal vehicle only.
  9. No alcohol on the premise.

Care of the Horse:

Care includes hay, water and maintenance of stall and corral. Worming andvaccinations of the horse every other month will be the responsibility of the Boarder.

Animal Health and Protection:

For the protection of all boarded animals, each boarder, including the undersigned, musthave a Health Certificate from a licensed veterinarian upon presenting the horse(s) forboarding. In addition, the horse(s) must have a negative Coggins Test, Encephalitis,Tetanus, Rhino, Flu, and Potomac Horse Fever vaccination within the past year.Worming must have been done with in the last 30 days to protect all boarded animals.No horses with a positive Coggins test, or any other known health failure item that istransmittable will be permitted to board at Flying H. All boarders must continue anynecessary efforts to insure that their animal(s) are continuously free of contagious,infectious, or otherwise communicable diseases. In addition, all boarded animals arerequired to receive an annual Encephalitis, Tetanus, and Potomac Horse Fevervaccination after March and before July, and worming four times a year. February, May,August, and November. These health standards were established in conjunction with ourveterinarians. In case of illness or injury, FLYING H will contact the Boarder. The Boarder’s designatedveterinarian will also be called at the discretion of Flying H. The Boarder or his/her agentwill be responsible for all veterinary care and bills. This contract represents permissionfrom the Boarder to FLYING H to contact their veterinarian to carry out any emergencyprocedures deemed necessary by the veterinarian with or without the presence of theboarder or his/her agent.

Horse Herd Policy:

Flying H management policy includes the use of mixed gender herds.Horses maybe inmixed gender herds as much as 24 hours 7 days a week. Small pen horses, while thenumber is smaller, can still be part of a small mixed gender herd. Flying H believes herd occupancy enhances the health and well-being of horses andcontributes to their “socialization” process and is well worth any adverse outcomes.Boarder agrees that this is acceptable management policy and understands that horses inherds will, on occasion, injure one another and, on rare occasion, be injury serious enoughto require euthanization. This risk is inherent in managing herds by both Flying Hand the Boarder.

Boarder Privileges and Responsibilities:

Boarder may NOT invite outside or “guest” instructors to train horses and give lessons on thepremises. Such an instructor/trainer is already available. Boarders may invite family members, friends to spectate while Flying H instructor/trainer puts on seminars. All invitees must sign the Flying H liabilitywaiver prior to riding or interacting with horses. Boarders are responsible for the properconduct of these people and are fully responsible for damage or loss caused by theseparties.

Boarder dogs welcome. If well behaved, (which includes staying with boarder, notrunning around through horses) dog maybe off leash.

Flying H will, to the best of its ability, provide a facility free of man-made hazards bymaintaining required fencing, gates, feed bunks, watering devices, and any otherstructure necessary for the care of the animals. The boarder is responsible for the mentaland physical well-being of his/her horse(s). Boarder is further responsible for any injuryor loss to his/her animal(s) by fire, theft, escape, or natural phenomenon.

Late Payment and Returned Checks:

Board is due on the first of the month. A LATE FEE of $25 will be assessed to board payments made after the 5th of the month. If board is not paid by the 10th of the month and no special arrangements have been made, a lien shall be attached to the horse and equipment of the boarder within possession and control of and they may be sold to satisfy the lien and cost of, but not limited to monthly board. Board MUST be paid in full each month. Should a horse leave prior to the end of the month, the unused portion of the board is non-refundable.STABLE MANAGEMENT REQUIRES 30 DAYS’ WRITTIN NOTICE OF ANY BOARDER THAT CHOOSES TO REMOVE THEIR HORSE.A $100 fee per horse will be billed to any boarder who does not provide appropriate notice. Exceptions are made based on management discretion, such as sale of a horse. Postdated checks will not be accepted. A charge of $25.00 will beassessed to the Boarder for any returned checks. Should a Boarder have two returnedchecks, for any reason, by Boarder’s drawee bank without payment, Flying H may, in itssole discretion, thereafter require that all future payments by Boarder be made in cash ormoney order.

Authorization of Stables:

Boarder hereby irrevocably authorizes Flying H to contact a veterinarian and/or farrier of its choice in the event that the Boarder is unavailable or unwilling to authorize suchservices, and at the sole discretion of Flying H, when the health of the horse is in jeopardy.

This authorization includes, but is not limited to; wounds, punctures, seizures, fever,excessive coughing, foundering, and severe hoof neglect. Flying H is not responsible forthe outcome of treatment rendered and Boarder is responsible for payment of suchservices. The Covenant Not To Sue. Release, Waiver of Claims and indemnityAgreement referred to in paragraph 11, shall apply to such services.

Payment of Fees and Bill of Sale:

The Boarder agrees to pay all boarding fees and fees arising from special arrangements foruse of other services or facilities on or before the first of the month.

If Flying H shall bring suit to collect any fees/costs for services rendered in connection with this contract, the Boarder acknowledges and understands that any unpaid amounts owed to Flying H as a result of this contract establishes the right of Flying H to produce a lien in favor of Flying H on other personal property of the Boarder. Boarder will not remove saidhorse(s) OR tack prior to payment in full on all amounts due or claimed to be due.

IF ALL FEES ARE NOT PAID WITHIN THIRTY DAYS OF ORIGINALDELINQUENCY, IT IS UNDERSTOOD BY THE PARTIES TO THISCONTRACT THAT PURSUANT TO TEXAS LAW, FLYING H HAS A LIEN ONSAID HORSE(S) PROVIDED BY SECTION 70.003 OF THE TEXAS PROPERTY CODE TO SECURE PAYMENT FOR SERVICES. FLYING H MAYIMMEDIATELY TERMINATE THIS AGREEMENT UPON OCCURRENCE OFDELINQUENCY IN PAYMENT BY OWNER/AGENT. FLYING H MAY THENEXERCISE THE RIGHT TO TAKE LEGAL OWNERSHIP OF THE HEREINDESCRIBES HORSE(S) IF THE DELINQUENCY IS NOT FULLY REMITTEDWITHIN 10 DAYS OF THE DATE DUE.

Non-Payment:

If any amount payable to Flying H thereunder is not paid when due;Until such time as Boarder obligations thereunder have been met in full, Boarder herebyagrees that Boarder shall not enter Flying H’s premises, and Flying H may retain Boarder’shorse(s), equipment, and tack located on the facilities by whatever means Flying H maydeem necessary; and that Flying H shall have a lien upon such Horse(s), equipment, andtack, which shall be foreclosed pursuant to the provisions of Owner acknowledges that Flying H has a lien upon, Texas Revised Statutes, as amended from time to time; andBoarder agrees to pay all reasonable costs of collecting amounts owed FLYING H under thiscontract, including attorney’s fees.

Board Reimbursement:

No reimbursement or refund of any board and /or care payment shall be made under any circumstances for any reason, including, but not of way of limitation, the death, hospitalization, or absence for breeding or otherwise, of the Horse(s).
