GeneralWarrantyProvisions

ODESUTVS providesthewarrantiesdescribedbelowtotheoriginalpurchaserofanynewODESUTVS vehiclepurchasedfromanauthorizedODESUTVS dealer. ODESUTVSwillrepairorreplace,at itsoption,anypartcoveredunderthis warrantythatisfoundtobedefectiveinmaterialorworkmanshipduringtheapplicable warrantyperiod.Inordertoobtainwarrantyrepairs,thepurchasermustdelivertheproduct,at thepurchaser’sexpense,alongwithproofofpurchasetoanyauthorized ODESUTVS dealer.ODESUTVS requiresthatallpurchasersexecuteandfilethis WarrantyRegistration.Effective Ver. 16.03.10 (ie, 10-03-16)

LimitedWarranty

This generalLimitedWarrantyappliestoODESUTVS forparts,labor andtimeperiodsdescribedbelow.Thewarrantyperiodbeginsonthedate ofpurchaseandis activatedbyreceiptofanexecutedVehicleWarrantyRegistration.

Limitations

TheLimitedWarrantydoesnotcoverthefollowing:Physicalabuseofmisuseoftheproductoroperationoftheproductinamannercontrarytotheprovisions ofitsowner’smanual; repairsmadeorpartsreplacedormodified byanyone otherthananauthorizedODESUTVS dealer;damagecausedbytheuseofanynon-ODES UTVS attachment,implement,accessoryorpart;damagecausedbysubmersioninwater,mud,sand, orothernaturally occurringelements.TheLimitedWarrantywill terminateifanyofthefollowingoccur:anyreplacementpartsusedonthevehicleareotherthangenuineODESUTVS brandparts;anyrepairsaremadeorpartsreplacedor modifiedbyanyone otherthananauthorizedODESUTVS dealer;regularmaintenanceandserviceisnotperformedasprescribed bytheowner’smanualduringthewarrantyterm,including, butnotlimitedto,firstscheduled

5hror100milemaintenanceandfirst5hrlessthanhalfthrottlebreakin period. Ownermustmaintainallservicerecordsofworkperformedontheproduct.All warrantyrepairsrequireauthorizationbyODESUTVS .All

ODESUTVS productsrequireadealerpre-deliveryinspectionandassemblytoensureproperoperation,safety,andwarrantyvalidation.

Anyexpresswarrantynotprovidedherein,andanyremedyforbreach ofcontract,which,butforthis provision,mightrisebyimplicationoroperationoflaw,isherebyexcludedanddisclaimed.ANYIMPLIEDWARRANTIES OFMERCHANTABILITYANDFITNESSFORAPARTICULARPURPOSEAREEXPRESSLYDISCLAIMED.Undernocircumstances shallODESUTVS beliable topurchaseroranyotherpersonforanyspecial,incidental orconsequentialdamageswhetherarisingoutofbreach ofwarranty, breach ofcontractorotherwise.Legal rightsvaryfromstatetostate,sotheabovelimitationsmaynotapplytoyouifprecludedbylocallaw.Warrantiesare transferrabletoa2ndowner,anyremainingwarrantyleftsincetheoriginalpurchasedate canbetransferredaslongasthe2ndowner doesaninspectionreportwithacertifieddealer(at theircost)uponpurchase.

AgreementandWaiverofLiability

Aslawfulconsiderationforthewarrantiesstatedabove,I,thebuyer,agreetoalltermsandconditionssetforthin this AgreementandWaiverofLiability. I,asbuyer,certifythatIamabove18yearsofage. I,asbuyer,ac- knowledgeandunderstandthatridinganall-terrain-vehicleor, UtilityVehicle,isadangerousactivitythatrequiresstrenuousexercise andvariousdegreesofskillandexperienceforindividual riders. I,asbuyer,understand, amawareofandacknowledgethattheuseoftheseproducts canresult in seriousinjuryordeathtoperson(s)anddamagetopropertyandI,asbuyer,amawareofthe risks,hazards anddangers ofpersonalinjury,deathand disabilityinherentwiththeuseofthesevehiclesaswell astheinherentrisks,hazards anddangers ofpersonalinjuryanddisabilityincreasewithinexperiencedoryoungridersandherebyvoluntarilyassumeanyandallrisk

associatedwithanyloss,damageorinjuryarisingoutoforrelated tomyownershiporuseofthevehiclespurchased.Thisspecificallyincludes,butisnotlimitedtoanyusebyminors. I,asbuyer,agreetorelease,indemnifyand foreverdischargeODESUTVS’dealer,ODESUTVS’manufacturer,ODESUTVS anditsparentcompany,agents,servants,employees,officers,directors,trusteesandallotherpersonsorentitiesactingontheirbehalf(“Release”)fromanyandallclaims,actions,damages,liabilities,costorexpensesandattorneyfees whichare related to, ariseoutof,orareinanyway connectedtomyuseorownershipofthesevehicles,useofequipmentorproperty supplied byReleases,whetherornotsuch claims,actions,damages,liability, costorexpensesarecausedbyorrelated tothenegligenceofReleases.Bythis Agreement,itismyintentionasbuyer,tosurrenderandwaiveany rights tosueorexercise anylegal rights toseekdamagesfromReleasestothe fullestextentallowedbylaw.ThisAgreementshallbeeffectiveandbindinguponmyheirs,agents,personalrepresentatives andassigns.I,asbuyer, havecarefullyread theforegoingandacknowledgethatIunderstandandagreetoalltheaboveTermsandConditions.I,asbuyer,agreetoread theowner’smanualcarefullybeforeoperatinganyODESUTVSvehicle.I,as

buyer,agreetoinspectanyODESUTVS vehicletobesure allnuts,boltsaretightandthevehicleissafe foroperationpriortoanyuse.I,asbuyer,agreetowearahelmet andprotectivegearwhenriding. I,asbuyer,acknowledge thatitismyresponsibility,toascertain andobeyalllocal,stateandfederallaws withregardtothe possessionanduseofanyproductpurchasedfromODESUTVS Dealer,ODESUTVS and/oritsparentcompany.ODESUTVS Dealer,ODESUTVS and/oritsparentcompanywill notbeliable forthemisuseofanyproductspurchasedfromODESUTVS Dealer,ODESUTVS and/oritsparentcompanyoranyofitsdistributorsoragents.This Agreement istobegovernedbythelaws oftheStateofCalifornia.Anylegal disputerelatingtothis agreementshallonlybebroughtinaStateorDistrictcourtlocatedinLosAngeles,California,andeachpartyherebyexclusivelysubmitstothejurisdictionofsaidcourt. Ifanypartofthis Agreementisdeemed unlawfulorvoid,itshallhavenoeffect ontheremainingprovisions ofthis Agreement.I,asbuyer,haveread thiswaiverofliability,assumptionof

riskandindemnityagreement,fullyunderstanditsterms,andunderstandthatI,asbuyer, amgivingupsubstantialrightsbyagreeingtothiswaiverandhaveagreedto itfreely andvoluntarilywithoutanyinduce- ment,assuranceorguaranteebeingmadetome.Myexecutionhereofistobeconsidered asacompleteanunconditionalreleaseofallliabilitytothe greatestextentallowedbylaw.
