The real estate is indivisible, situated in Jefferson County, Ky., and described as follows:
Being Unit Number 29, a Condominium Unit in the Village at Wildwood, Single-Family Homes in a condominium community, as created by and more fully described in that certain Master Deed and Declaration dated November 12, 2002, of record in Deed Book 8000, Page 637; First Amendment filed of record in Deed Book 8152, Page 134, Second Amendment filed of record in Deed Book 8179, Page 550; Third Amendment filed of record in Deed Book 8200, Page 220; and Fourth Amendment filed of record in Deed Book 8213, Page 350, and as shown on Plans filed in Condominium or Apartment Ownership Book 96, Pages 18 thru 21, Clerk’s File No. 1647, and as shown on Plans filed in Condominium or Apartment Ownership Book 96, Pages 44 thru 48, Clerk’s File No. 1657, and as shown on Plans filed in Condominium or Apartment Ownership Book 97, Pages 8 thru 14, Clerk’s File No. 1661, all in the Office of the Clerk of Jefferson County, Kentucky, together with said Unit’s respective undivided percentage interest in the common elements of The Village at Wildwood Condominiums appurtenant to said Unit, said Unit’s interest in the Class I Limited Common Elements Class II Limited Common Elements of The Village at Wildwood Condominiums Appurtenant to said Unit, all as defined and more fully described in said Master Deed.
Being the same property conveyed to Jean M. Sanders, unmarried, and Mary T. Sanders, married, from Dominion Homes of Kentucky, LTD, by Deed dated 07/31/2003, recorded 08/06/2003, Deed Book 8205, page 435, and re-recorded 10/02/2003 in Deed Book 8262, page 686, Jefferson County Clerk’s Records.
The subject real estate shall be sold free and clear of all liens, encumbrances and interest of the parties, but sold subject to: A) Easements, restrictions and stipulations of record; B) Any matters which would be disclosed by an accurate survey or inspection of the property; and C) Any current assessments for public improvements levied against the property. The plaintiff, the Commissioner and the Court shall not be deemed to have warranted title of the real estate to the purchaser.
The amount to be raised by the judgment is $145,282.89, plus interest at 4.5% per annum and costs. If the judgment debtor(s) seek(s) to pay off the amount to be raised, said amount may be paid to the Commissioner.
The sale terms are: 1) The purchaser shall deposit 10% of the bid and post a KRS 426.705 bond or make full cash payment at the sale. If the deposit is not made immediately, the Commissioner shall reject the bid and resell the property. 2) The full balance is payable within 30 days from sale date, with the unpaid balance bearing interest at the above rate. 3) When the purchase price is paid, and upon proper motion, the Commissioner will execute a deed.
