APPLICATION TO AMEND THE WINDOW DISPLAY OF THE SEX SHOP PREMISES KNOWN AS EROTIQUE 4 YOU, 448a ASHLEY ROAD, POOLE, SITUATED WITHIN NEWTOWN WARD

1.0 / Introduction
1.1 / An application has been received to amend the window display of the Sex Shop premises known as Erotique 4 You, 448a Ashley Road, Poole. The applicant is Miss Dawn Sheppard.
2.0 / Background
2.1 / The Local Government (Miscellaneous Provisions) Act 1982 allows Local Authorities to licence Sex Shops and Sex Cinemas following the adoption of schedule 3 of the Act. Schedule 3 of the Act was adopted by the Borough of Poole with effect from 1st February 1983.
Should a sex establishment licence be granted the licence will be subject to the standard conditions relating to the control, operation and management of the premises. In addition to these standard conditions the Local Authority may prescribe special conditions to be attached to the licence.

Matter for consideration

3.1 / Miss Dawn Sheppard was granted a licence on 4th March 2010 to allow the premises Erotique 4 You at 448a Ashley Road, Poole to be used as a sex shop. The licence was granted, following a Licensing Sub-Committee hearing held on 2nd March 2010, with standard and special conditions.
A copy of the licence is attached as appendix A.
3.2 / The applicant has requested to amend the window display of the premises to include the following wording ‘Fully Licensed Adult Store.’
As per standard conditions 24 and 27 attached to the licence no change can be made to the window wording without the written consent of the council.
A copy of the request is attached as appendix B.
4.0 / Conclusion
4.1 / The Committee members are asked to consider the application and determine whether the amendment to the window display should be permitted.
