MINUTES OF COMBINED COMMISSION WORKING & REGULAR SESSION MEETING HELD MAY 08, 2017 BEGINNING AT 9:00 A.M. IN CONFERENCE

ROOM #1, IN DUCHESNE, UTAH

Present

Commission Chairman Ronald Winterton; Commissioner Ken Burdick, Commissioner Greg Todd, Deputy County Attorney Tyler Allred, Public Works Director Ben Henderson, Uintah Basin Standard Reporter Brenda Fisher and Commission Assistant BobbiJo Casper taking minutes of the meeting.

Public Works Department Update

Director Henderson reported that the temporary bridge in Antelope is in place and the new bridge will be installed this week.

Director Henderson also reported that the Water Hollow Dam Project is finished.

Chairman Winterton stated that he received a call from Gordon Moon about the bridge on the northwest end of Hanna that was affected by the flood in 2011. He is asking for rip-rap and is willing to do the work if we supply the rock.

Director Henderson stated that he has received several calls regarding the culvert at the Bridgeland Cemetery because it needs to be cleaned out. He has been busy and hasn’t gotten to it, but John Swasey wants to put up a new fence and contacted Blue Stakes late last week so he can start the project.

Retirement System Update

Payroll & Benefits Administrator Becky Caton joined the meeting at 9:31 A.M…

Administrator Caton stated that she recently attended a comprehensive employee training for URS. A new classification has been set up for people who work less than 20 hours a week and non-benefitted. The employee would pay 100% of medical insurance costs and they would not be on our retirement plan. URS is requesting a list of non-merit protected employees. The only position that applies to right now is Building Official. Chairman Winterton asked for recommendations and a list of those positions that fall under this category. Administrator Caton stated that if we have a retired employee come back and work as a contract employee, they are subject to post-retired rules. If there are violations, the employer and employee can be held equally responsible. A statute of limitations ruling was passed in 2016 legislature; four years for defined benefit plans and one year for defined contribution. Employers can elect to waive the defense of the statute. Any employee who also receives a 1099 form, such as a firefighter, will have those wages included in retirement salary calculations.

Consideration Of A Refund Request For Interest & Penalty Fees

Treasurer Stephen Potter joined the meeting at 9:46 A.M…

Treasurer Potter stated that Bill George purchased property and a bad deed was given. He is asking for the penalty and interest fees to be waived totaling $259.19. It’s been pulled off of the tax sale. Commissioner Todd suggested that Mr. George recoup these costs from the seller. Commissioner Burdick stated that if he doesn’t receive his tax notices he follows up on it; he doesn’t wait five years. Commissioner Todd motioned to deny the request. Commissioner Burdick seconded the motion. All Commissioners voted aye and the motion passed.

Consideration Of Vouchers

Deputy Clerk Auditor Connie Sweat joined the meeting at 10:00 A.M…

The commission reviewed vouchers #138809 through 138867 dated May 07, 2017 in the amount of two hundred seventy three thousand four hundred seventy three dollars and forty eight cents ($273,473.48) as presented by the Clerk Auditor’s Office. Commissioner Todd motioned to approve the vouchers as presented. Commissioner Burdick seconded the motion. All commissioners voted aye and the motion passed.

Closed Meeting –

Commissioner Burdick moved to go into and out of closed session for the purpose of discussing personnel issues at 10:14 A.M. Commissioner Todd seconded the motion. All commissioners voted aye and the motion passed. Assistant Casper was excused.
