CITIZENS RESOLUTION OF APPRECIATIONTO

SENATOR JOHN UNGER

APRIL 11, 2010

WHEREASSenator John Unger heard citizen concerns that West Virginia law allows the Public Service Commission (PSC) to delegate its eminent domain power of condemnation of citizen owned land to for-profit corporations for the purpose of permanently placing significant electric transmission lines and supporting towers across the state and that the property owners are owed only a small legal notice in a regional newspaper concerning the threat of such condemnation when the corporation makes application to the PSC for approval of said transmission lines and;

WHEREASSenator Unger sought the guidance of several citizens and with that input oversaw the creation of Senate Bill 614 which requires the transmission line applicant to deliver a certified letter of possible eminent domain taking to each landowner possibly affected by said power line at the beginning of the application process and;

WHEREASwhen Senator Unger introduced SB 614 to the West Virginia Senate in February, 2010, and secured consideration by only the Senate Judiciary Committee, an amendment was immediately introduced by special interest lobbyists that gutted SB 614, Senator Unger immediately took the needed action and successfully rebuilt SB 614 to its original state of effectiveness and;

WHEREAS Senator Unger shepherded SB 614 through the legislature gaining approval votes in the Senate Judiciary Committee and on the Senate floor, followed by approval by the House of Delegates with technical amendment, and again gained approval of SB 614 a second time on the floor of the Senate during the final hours of the 2010 legislative session and;

AND WHEREAS Senator Unger caused SB 614 to gain needed legislative signatures and be presented to and signed into law by the Governor on April 2, 2010, to take effect June 12,2010, benefiting untold thousands of West Virginia land owners in the future;

THEREFORE BE IT RESOLVED that the many citizens of West Virginia who approved this resolution and whose names are attached,appreciate the significant effort and the resulting law Senator John Unger has gained for them and future generations of mountaineer landowners.

This resolution of grateful appreciation is presented to Senator John Unger this 19th Day of April, 2010.
