Ms. Rebecca Livengood made a motion to accept the minutes of the July 7, 2014, meeting of the City Planning Commission. Ms. Linda Henley seconded the motion. The motion passed unanimously.

Resubdivision

Combine Three Properties into One New Lot

310 and 314 Avery Avenue and 639 Hamilton Street

314 Avery Ave., LLC and Joann Dorsey Rvcbl Trust (owners/applicants)

Business, Class A

Mr. Larry Ball, of Ball Consulting at 522 Liberty Street, Mr. Steve Dorsey, at 314 Avery Avenue, and Mr. William J. Ferraldo, of Harmony Architectural Associates at 1860 Erie Boulevard East, spoke to the Commission about the proposal, which consists of combining two properties into one new Lot for the purpose of expanding an existing restaurant on property situated at 310 and 314 Avery Avenue and 639 Hamilton Street.

Two people spoke in favor of the proposal. One neighbor voiced concerns over the proposal.

After further discussion and review, Ms. Rebecca Livengood made a motion to approve the request with a negative declaration. Ms. Linda Henley seconded the motion. The motion passed unanimously.

Special Permit-Restaurant

Expand a Restaurant and Modify the Site Plan

310 and 314 Avery Avenue and 639 Hamilton Street

Mr. Larry Ball, of Ball Consulting at 522 Liberty Street, Mr. Steve Dorsey, at 314 Avery Avenue, and Mr. William J. Ferraldo, of Harmony Architectural Associates at 1860 Erie Boulevard East, spoke to the Commission about the proposal, which consists of modifying the site plan, floor plan, and elevations to an existing Special Permit for a Restaurant in order to expand an existing restaurant on property situated at 310 and 314 Avery Avenue and 639 Hamilton Street.

Two people spoke in favor of the proposal. One neighbor voiced concerns over the proposal.

After further discussion and review, Ms. Linda Henley made a motion to approve the request with a negative declaration, and granting two waivers from the City of Syracuse Zoning Rules and Regulations, as amended, as they pertain to the parking and driveway spacing requirements. Ms. Rebecca Livengood seconded the motion. The motion passed unanimously.

Special Permit-Indoor Amusement and Recreation

Establish a Personal Fitness Center

Mr. Adam Felty, at 943 West Genesee Street, spoke to the Commission about the proposal, which consists of establishing a fitness center on property situated at 937 (935) West Genesee Street.

One person spoke in favor of the proposal. No one spoke in opposition to the proposal.

After further discussion and review, Ms. Rebecca Livengood made a motion to approve the request with a negative declaration, and granting one waiver from the City of Syracuse Zoning Rules and Regulations, as amended, as they pertain to the parking requirements, with the condition that one space be removed as shown on the submitted site plan to avoid parking in and/or backing into the City right-of-way. Mr. Arpad Kolozsvary seconded the motion. The motion passed unanimously. The Commission did not grant a waiver for a ground sign.

Special Permit-Parking Lot

Establish a Parking Lot

Mr. Kevin Gilligan, an attorney with Costello, Cooney and Fearon, PLLC at 500 Plum Street, spoke to the Commission about the proposal, which consists of establishing a surface parking lot on property situated at 316 North Townsend Street.

No one spoke in favor of or in opposition to the proposal.

After further discussion and review, whereupon the Commission noted the proposal is not in keeping with the City of Syracuse Land Use Plan, and did not receive sufficient information regarding a master parking plan with respect to the St. Joseph’s campus, Ms. Linda Henley made a motion to deny the proposal without prejudice. Ms. Rebecca Livengood seconded the motion. The motion passed unanimously.

At the request of the applicant, the Commission agreed to reschedule the Public Hearing for this request to August 18, 2014, pending revisions to the proposal.

Ms. Carol Zenzel, at 2507 James Street, Suite 210, spoke to the Commission about the proposal, which consists of modifying the site plan, floor plans, and elevations to a five0-story, mixed-use building on property situated at 710 and 712-714 East Fayette Street.

No one spoke in favor of the proposal. One person spoke in opposition to the proposal. The Commission received one letter in opposition to the proposal.

After further discussion and review, whereupon the applicant acknowledged discrepancies in the proposed elevations, the Commission agreed to continue the Public Hearing at its next regularly-scheduled meeting on August 18, 2014, pending receipt of revised elevations.

Site Plan Review

Construct a Three-Story Addition with Site Alterations

Mr. Stuart Alderman, of Design etcetera at 6170 Michaeljon Way, Cicero, New York, spoke to the Commission about the proposal, which consists of constructing a three-story addition to an existing building and implementing site alterations on property situated at 400 West Division Street and 365 Spencer Street, Rear.

No one spoke in favor of or in opposition to the proposal.

After further discussion and review, Ms. Rebecca Livengood made a motion to approve the request with a negative declaration, and granting three waivers from the City of Syracuse Zoning Rules and Regulations, as amended, as they pertain to the acceptable tree, finish material, and number of building materials requirements. Ms. Linda Henley seconded the motion. The motion passed unanimously.
