Purchase Price and Terms
Purchase price for this puppy shall be ______payable at the time of pickup by cash, cashier’s check or money order. This puppy is being sold as a show prospect.
1. (For older pups)This puppy is ______months of age. At this time his strengths and weakness are clearly recognizable and have been gone over and discussed by Buyer and Seller. This puppy is free of disqualifying faults according to the current AKC standard for the Pomeranian. The Puppy’s adult teeth are in and this puppy has a correct bite. Both testicles are descended into the scrotum. The puppy clearly displays a good, sound, outgoing temperament. This is a puppy who should be able to finish his AKC Championship. It is further noted that handling abilities of the exhibitor and grooming and conditioning of the dog are a determining factor in the success of any dog in the show ring.
2. The purchase price does not guarantee that this puppy will be able to complete the requirements for an AKC Champion. There will be no monetary refund if this puppy does not finish his AKC Championship. It is understood that Buyer will seek the advice of the Seller immediately if there are any problem with the dog’s show career. In some cases the services of a Professional Handler, may be helpful in finishing a dog’s Championship. This is not a reflection on the quality of the dog.
3. (For younger pups)This puppy is ______months of age. At this time his strengths and weakness have been gone over and discussed by Buyer and Seller, but at this early age it is impossible to know for sure that the bite will be correct and how the puppy will look as an adult. This puppy is being sold as having “show potential”, which for purposes of this agreement means that in the considered opinion of Seller, the puppy has the potential of being able to finish his AKC Championship. It is further noted that handling abilities of the exhibitor and grooming and conditioning of the dog are a determining factor in the success of any dog in the show ring.
4. The purchase price does not guarantee that this puppy will be able to complete the requirements for an AKC Champion. There will be no monetary refund if this puppy does not finish his AKC Championship. It is understood that Buyer will seek the advice of Seller immediately if there are any problems with the dog’s show career. In some cases the services of a Professional Handler may be helpful in finishing a dog’s Championship. This is not a reflection on the dog’s quality.
Additional Provisions of the Sale
v This Pomeranian shall live with the Buyer.
v All medical and legal expenses will be paid by the Buyer.
v All entry fees and other expenses for dog shows will be Buyer’s responsibility.
v If a professional handler is used, the Buyer will incur all costs.
Additional Terms for a Male Her Majesty’s Pomeranian Male
1. Seller shall have the use of this dog for stud service at no charge to any bitch which is owned or co-owned by Seller for the lifetime of the dog. Seller agrees to take care of all necessary arrangements and expenses incurred in breeding her Majesty’s Poms bitches to the above named Pomeranian
2. If Buyer does not make this Pomeranian available for stud service to bitches owned or co-owned by Seller, there shall be a $5000.00 penalty to be paid directly to the Seller immediately upon violation.
3. This dog is not to be used at stud until he completes his AKC Championship unless Seller grants specific written permission.
4. This dog is not to be used at stud to any bitches other than those owned by the Buyer or Seller unless the Seller gives specific written permission.
5. No puppies produced by this dog may be sold to pet shops, commercial kennels, puppy mills or brokers.
If Buyer at anytime is unable or unwilling to keep this Pomeranian, Seller shall be contacted first and given “the first right of refusal” for an amount which shall not exceed the original purchase price or (50% depending on age and condition of the dog). Furthermore, it is agreed that this Pomeranian is never to be sold or otherwise “placed” without contacting the Seller. Seller will be kept aware of “residence” of this Pomeranian throughout his life. Seller will take this Pomeranian back into their home if it is in need of a home at any time throughout its life.
Health Guarantee
6. The Buyer should take the puppy to a veterinarian of its choosing within three days of purchase. Buyer may return the puppy for a refund the entire purchase price.
7. The Seller provides a health guarantee against any proven congenital health defects for six months. If such a problem arises it must be verified by a veterinarian’s written and signed statement. Seller is to be notified within 24 hours of diagnosis; dog is to be returned to Seller and written statement by veterinarian is to be surrendered to Seller. The Pomeranian will then be examined by Seller’s veterinarian at no cost to Buyer to verify diagnosis. If verified, Seller agrees to replace the Pomeranian with one of the same sex and of comparable quality and color, when the Seller has such a Pomeranian available for placement. The affected Pomeranian must be returned to Seller with all papers signed over to the Seller. All Veterinary expenses incurred by the Buyer shall be Buyer’s responsibility. Seller will not reimburse Buyer for any Veterinary expenses incurred while the dog is in the Buyer’s care.
8. If Buyer does not contact Seller regarding any health problems within 24 hours of diagnosis, Seller will assume no responsibility and this guarantee is null and void.
9. This is a contractual agreement and failure to comply may result in Seller seeking legal assistance in regaining physical ownership of this Pomeranian or any other matter covered by this Agreement. Further, Buyer accepts all legal and any other expenses, both for the Seller and the Buyer, should it become necessary to enforce this contract through legal means.
Additional Terms or Conditions of Sale
Any additional terms must be written in this area, initialed and dated by both parties at the time of placement.
This is a contractual agreement and failure to comply may result in Seller seeking legal assistance in regaining physical ownership of this Pomeranian or any other matter addressed by this Agreement. Further, Buyer accepts all legal and any other expenses, both for the Seller and the Buyer, should it become necessary to enforce this contract through legal means.
Any legal action is to be conducted in the county and state where Seller resides.
This constitutes the entire agreement between the parties.
