INVITATION TO BID
Separate sealed bids for CITY OF LIVINGSTON 2009 ASPHALT OVERLAY PROJECT, will be received by THE CITY OF LIVINGSTON at THE LIVINGSTON UTILITY DEPT., 330 BENNETT ST, until 2:00 P.M. local time on Thursday, August 20th, 2009 and then publicly opened and read aloud.
Schedule A: Project work involved with the Base Bid includes the paving of approximately 2350 SY at the City of Livingston Recycling Center and Transfer Station. The paving will consist of 2-1/2” of hot mix asphalt over a City-prepared base course.
Schedule B: Project work involved with the Base Bid includes the preparation and paving of approximately 3350 SY on Carol Lane in Livingston. The preparation will consist of asphalt milling, removal of temporary trench backfill, and asphalt leveling as needed prior to paving with a full width 2” hot mix asphalt overlay.
NOTE: The City of Livingston intends to award both schedules (Schedule A and Schedule B) as a single contract. However, the City of Livingston reserves the right to exclude from award either or both schedules based on the availability of funding. Both schedules must be bid.
The contract documents consist of Drawings and Project Specifications which may be examined at THE LIVINGSTON UTILITY DEPT., 330 BENNETT ST. or obtained at the office of CTA CIVIL ENGINEERS, 121 South Main, LIVINGSTON, MONTANA 59047, PHONE: (406) 222-0104. FAX (406) 222-1007 as described in Article 2.01 of Instructions To Bidders. Required deposit is $50 per set, which is not refundable.

There will be a Pre-Bid Conference starting from the office of CTA CIVIL ENGINEERS, 121 South Main Street, at 2:00 P.M. on Thursday August 13th, 2009. Interested CONTRACTORS are encouraged to attend.
CONTRACTORS and any of the CONTRACTOR’S subcontractors doing work on this project will be required to obtain registration with the Montana Department of Labor and Industry (DLI). Forms for registration are available from the Department of Labor and Industry, P.O. Box 8011, 1805 Prospect, Helena, Montana 59604-8011. Information on registration can be obtained by calling 1-406-444-7734. CONTRACTORS are not required to have registered with the DLI prior to bidding on this project, but must have registered prior to execution of the Construction Agreement. All laborers and mechanics employed by CONTRACTOR or any subcontractors in performance of the construction work shall be paid as described in the WAGE RATE SECTION and as required by the state of Montana.
Each bid or proposal must be accompanied by a Certified Check, Cashier’s Check, or Bid Bond payable to THE CITY OF LIVINGSTON, in an amount not less than ten percent (10%) of the total amount of the bid. Bids must be delivered within a sealed envelope which has the bidders Montana Contractors License Number listed upon it and clearly visible.
The contract provides for thirty (30) calendar days for completion of the work. The contractor will be assessed liquidated damages in the amount of $500 per calendar day for time required beyond that provided.
Successful BIDDERS shall furnish an approved Performance Bond and a Labor and Materials Payment Bond, each in the amount of one hundred percent (100%) of the contract amount. Insurance is required and shall be provided by the successful BIDDER(s). A certificate(s) of that insurance shall be provided before any work begins.
The CONTRACTOR must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex or national origin.
Within ten days after the Notice of Award, the successful Bidder will be required to furnish a Performance Bond and a Labor and Materials Payment Bond guaranteeing faithful performance and the payment of all bills and obligations arising from the performance of the contract. The bonds will each be equal to 100 percent of the contract amount.
No bid may be withdrawn within a period of sixty (60) days after the scheduled time for the public opening of bids, which is 2:00 P.M., local time, Thursday, August 20th, 2009.
The right is reserved to reject any or all proposals received, to waive informalities, to postpone the award of the contract for a period of not to exceed sixty (60) days, and to accept the lowest responsive and responsible bid which is in the best interest of the OWNER.
