413HARASSMENT AND VIOLENCE

[Note:Statelaw(Minn.Stat.§121A.03)requiresthatschooldistrictsadoptasexual, religious,andracialharassmentandviolencepolicythatconformswiththeMinnesota HumanRightsAct,Minn.Stat.Ch.363A(MHRA).Thispolicycomplieswiththat statutoryrequirementandaddressestheotherclassificationsprotectedbytheMHRA and/orfederallaw.Whiletherecommendationisthatschooldistrictsincorporatethe otherprotectedclassifications,inadditiontosex,religion,andrace,intothispolicy, theyarenotspecificallyrequiredtodosobyMinn.Stat.§121A.03.TheMinnesota DepartmentofEducation(MDE)isrequiredtomaintainandmakeavailableamodel sexual,religious,andracialharassmentpolicyinaccordancewithMinn.Stat.§ 121A.03.MDE’spolicydiffersfromthatofMSBAandimposesgreaterrequirements uponschooldistrictsthanrequiredbylaw.Forthatreason,MSBArecommendsthe adoptionofitsmodelpolicybyschooldistricts.Eachschoolboardmustsubmitacopy ofthepolicytheboard has adopted to theCommissioner ofMDE.]

I.PURPOSE

Thepurposeofthispolicyistomaintainalearningandworkingenvironmentthatisfree fromharassmentandviolenceonthebasisofrace,color,creed,religion,nationalorigin, sex,gender,age,maritalstatus,familialstatus,statuswithregardtopublicassistance, sexual orientation, ordisability.

II.GENERAL STATEMENT OFPOLICY

A.Thepolicyoftheeducation districtistomaintainalearningandworking environmentthatisfreefromharassmentandviolenceonthebasisofrace,color, creed,religion,nationalorigin,sex,gender,age,maritalstatus,familialstatus, statuswithregardtopublicassistance,sexualorientation,ordisability.The education districtprohibitsanyformofharassmentorviolenceonthebasisofrace, color,creed,religion,nationalorigin,sex,gender,age,maritalstatus,familial status, status with regardto public assistance,sexual orientation, ordisability.

B.Aviolationofthispolicyoccurswhenanystudent,teacher,administrator,or othereducation districtpersonnelharassesastudent,teacher,administrator,orother education districtpersonnelorgroupofstudents,teachers,administrators,orother education districtpersonnelthroughconductorcommunicationbasedonaperson’s race,color,creed,religion,nationalorigin,sex,gender,age,maritalstatus, familialstatus,statuswithregardtopublicassistance,sexualorientation,or disability,asdefinedbythispolicy.(Forpurposesofthispolicy,education district personnelincludesschoolboardmembers,schoolemployees,agents,volunteers, contractors, orpersons subject to thesupervision and control ofthedistrict.)

C.Aviolationofthispolicyoccurswhenanystudent,teacher,administrator,or othereducation districtpersonnelinflicts,threatenstoinflict,orattemptstoinflict violenceuponanystudent,teacher,administrator,orothereducation district personnelorgroupofstudents,teachers,administrators,orothereducation district personnelbasedonaperson’srace,color,creed,religion,nationalorigin,sex, gender,age,maritalstatus,familialstatus,statuswithregardtopublicassistance, sexual orientation, ordisability.

D.Theeducation districtwillacttoinvestigateallcomplaints,eitherformalorinformal, verbal or written, ofharassment orviolencebasedon aperson’srace,color, creed, religion,nationalorigin,sex,gender,age,maritalstatus,familialstatus,status withregardtopublicassistance,sexualorientation,ordisability,andtodiscipline ortakeappropriateactionagainstanystudent,teacher,administrator,orother education district personnelwho is found to haveviolated this policy.

III.DEFINITIONS

A.“Assault”is:

1.anactdonewithintenttocausefearinanotherofimmediatebodilyharm ordeath;

2.theintentionalinflictionoforattempttoinflictbodilyharmuponanother; or

3.thethreattodobodily harmtoanotherwithpresentabilitytocarry outthe threat.

B.“Harassment”prohibitedbythispolicyconsistsofphysicalorverbalconduct, including,butnotlimitedto,electroniccommunications,relatingtoan individual’sorgroupofindividuals’race,color,creed,religion,nationalorigin, sex,gender,age,maritalstatus,familialstatus,statuswithregardtopublic assistance, sexual orientation, ordisabilitywhen the conduct:

1.hasthepurposeoreffectofcreatinganintimidating,hostile,oroffensive workingor academicenvironment;

2.hasthepurposeoreffectofsubstantiallyorunreasonablyinterferingwith an individual’s work oracademicperformance; or

3.otherwise adversely affects an individual’s employment or academic opportunities.

C.“Immediately”means assoon as possiblebut in no event longerthan 24 hours.

D.Protected Classifications; Definitions

1.“Disability”meansanyconditionorcharacteristicthatrendersapersona

disabled person.Adisabled person is anypersonwho:

a.hasaphysical,sensory,ormentalimpairmentwhichmaterially limits oneormoremajorlife activities;

b.has a record ofsuch an impairment; or

c.is regardedas havingsuch an impairment.

2.“Familialstatus”meanstheconditionofoneormoreminorsbeing domiciled with:

a.theirparent orparents ortheminor’s legalguardian; or

b.thedesigneeoftheparentorparentsorguardianwiththewritten permissionoftheparentorparentsorguardian.Theprotections affordedagainstharassmentonthebasisoffamilystatusapplyto anypersonwhoispregnantorisintheprocessofsecuringlegal custodyofan individual who has not attained theageofmajority.

3.“Maritalstatus”meanswhetherapersonissingle,married,remarried, divorced, separated,orasurviving spouseand,inemploymentcases, includesprotectionagainstharassmentonthebasisoftheidentity, situation, actions, orbeliefs ofaspouseor formerspouse.

4.“Nationalorigin”meanstheplaceofbirth ofanindividualorofanyofthe individual’s lineal ancestors.

5.“Sex”includes,butisnotlimitedto,pregnancy,childbirth,anddisabilities related to pregnancyorchildbirth.

6.“Sexualorientation”meanshavingorbeingperceivedashavingan emotional,physical, orsexualattachmenttoanotherpersonwithoutregard tothesexofthat personorhavingorbeingperceivedashavingan orientationforsuchattachment,orhavingorbeingperceivedashavinga self-imageoridentitynottraditionallyassociatedwithone’sbiological malenessorfemaleness.“Sexualorientation”doesnotincludeaphysical orsexual attachment to children byan adult.

7.“Statuswithregardtopublicassistance”meanstheconditionofbeinga recipientoffederal,state,orlocalassistance,including medicalassistance, orofbeingatenantreceivingfederal,state,orlocalsubsidies,including rental assistanceorrent supplements.

E.“Remedialresponse”meansameasuretostopandcorrectactsofharassmentor violence,prevent actsofharassmentorviolencefrom recurring,andprotect, support,andinterveneonbehalfofastudentwhoisthetargetorvictimofactsof harassment orviolence.

F.Sexual Harassment; Definition

1.Sexualharassmentconsistsofunwelcomesexualadvances,requestsfor sexualfavors,sexually motivatedphysicalconductorotherverbalor physicalconduct orcommunication ofasexual nature when:

a.submissiontothatconductorcommunicationismadeatermor condition,eitherexplicitlyorimplicitly,ofobtainingemployment or an education; or

b.submissiontoorrejectionofthatconductorcommunicationbyan individual is used as a factorin decisions affectingthat individual’s employment oreducation; or

c.thatconductorcommunicationhasthepurposeoreffectof substantiallyorunreasonablyinterferingwithanindividual’s employmentoreducation,orcreatinganintimidating,hostile,or offensive employment oreducational environment.

2.Sexual harassment mayinclude, but is not limitedto:

a.unwelcomeverbal harassment or abuse;

b.unwelcomepressureforsexual activity;

c.unwelcome,sexually motivated,orinappropriatepatting,pinching, orphysicalcontact,otherthannecessaryrestraintofstudent(s)by teachers,administrators,orothereducation districtpersonneltoavoidphysicalharm to personsorproperty;

d.unwelcomesexualbehaviororwords,includingdemandsfor sexualfavors,accompaniedbyimpliedorovertthreatsconcerning an individual’s employment or educational status;

e.unwelcomesexualbehaviororwords,includingdemandsfor sexualfavors,accompaniedbyimpliedorovertpromisesof preferentialtreatmentwithregardtoanindividual’semployment or educational status; or

f.unwelcomebehaviororwordsdirectedatanindividualbecauseof gender.

G.Sexual Violence; Definition

1.Sexualviolenceis aphysical act ofaggressionorforceorthethreat thereofwhichinvolvesthetouchingofanother’sintimateparts,orforcing apersontotouchanyperson’sintimateparts. Intimateparts,asdefinedin

Minn. Stat. § 609.341, includes theprimarygenitalarea, groin, inner thigh, buttocks, orbreast,as well as the clothingcoveringtheseareas.

2.Sexual violencemayinclude, but is not limited to:

a.touching,patting,grabbing,orpinchinganotherperson’sintimate parts, whetherthat person is ofthesamesexortheoppositesex;

b.coercing,forcing,orattemptingtocoerceorforcethetouchingof anyone’s intimateparts;

c.coercing, forcing, or attempting to coerce or force sexual intercourseorasexual act on another; or

d.threateningtoforceorcoercesexual acts,includingthetouchingof intimateparts orintercourse, on another.

H.Violence; Definition

Violenceprohibitedbythispolicyisaphysicalactofaggressionorassaultupon anotherorgroupofindividualsbecauseof,orinamannerreasonablyrelatedto, race,color,creed,religion,nationalorigin,sex,age,maritalstatus,familialstatus, status with regard to public assistance, sexual orientation, ordisability.

IV.REPORTING PROCEDURES

A.Any personwhobelievesheorshehasbeenthetargetorvictimofharassmentor violenceonthebasisofrace,color,creed,religion,nationalorigin,sex,gender,age,maritalstatus,familialstatus,statuswithregardtopublicassistance,sexual orientation,ordisabilitybyastudent,teacher,administrator,orothereducation districtpersonnel,oranypersonwithknowledgeorbeliefofconductwhichmay constituteharassment orviolenceprohibited bythis policytoward astudent, teacher,administrator,orothereducation districtpersonnelorgroupofstudents, teachers,administrators,orothereducation districtpersonnelshouldreportthe allegedactsimmediatelytoanappropriateeducation districtofficialdesignatedby thispolicy.Apersonmayreportconductwhichmayconstituteharassmentor violenceanonymously.However,theeducation districtmaynotrelysolelyonan anonymous report to determinedisciplineorotherremedial responses.

B.Theeducation districtencouragesthereporting party orcomplainanttousethereport formavailablefromtheprincipalorbuilding supervisorofeachbuilding or availablefrom theeducation district office, but oral reports shall beconsidered complaints as well.

C.Nothinginthispolicyshallpreventanypersonfromreportingharassmentor violencedirectly toaneducation districthumanrightsofficerortothesuperintendent. Ifthecomplaintinvolvesthebuildingreporttaker,thecomplaintshallbemadeor fileddirectlywiththesuperintendentortheeducation districthumanrightsofficerby

the reportingpartyor complainant.

D.InEachSchoolBuilding.Thebuildingprincipal,theprincipal’sdesignee,orthe buildingsupervisor(hereinafterthe“buildingreporttaker”)istheperson responsibleforreceivingoralorwrittenreportsofharassmentorviolence prohibitedby thispolicyatthebuildinglevel.Anyadulteducation districtpersonnel whoreceivesareportofharassmentorviolenceprohibitedbythispolicyshall informthebuildingreporttakerimmediately.Ifthecomplaintinvolvesthe building reporttaker,thecomplaintshallbemadeorfileddirectly withthe superintendentortheeducation districthumanrightsofficer by thereporting party or complainant.Thebuildingreporttakershallensurethatthispolicyandits procedures,practices,consequences,andsanctionsarefairlyandfully implementedandshallserveasaprimarycontactonpolicyandprocedural matters.

E.Ateacher,schooladministrator,volunteer,contractor,orotherschoolemployee shallbeparticularlyalerttopossiblesituations,circumstances,oreventsthat mightincludeactsofharassmentorviolence.Anysuchpersonwhowitnesses, observes,receivesareportof,orhasotherknowledgeorbeliefofconductthat mayconstituteharassmentorviolenceshallmakereasonableeffortstoaddress andresolvetheharassmentorviolenceandshallinformthebuildingreporttaker immediately.Education districtpersonnelwhofailtoinformthebuildingreport takerofconductthatmayconstituteharassmentorviolenceorwhofailtomake reasonableeffortstoaddressandresolvetheharassmentorviolenceinatimely mannermaybesubject to disciplinaryaction.

F.Uponreceiptofareport,thebuildingreporttakermustnotifytheeducation district humanrightsofficerimmediately,withoutscreeningorinvestigatingthereport. Thebuildingreporttakermayrequest,butmaynotinsistupon,awritten complaint.Awrittenstatementofthefactsallegedwillbeforwardedassoonas practicablebythebuildingreporttakertothehumanrightsofficer.Ifthereport wasgivenverbally,thebuildingreporttakershallpersonallyreduceittowritten formwithin24hoursandforwardittothehumanrightsofficer.Failureto forwardanyharassmentorviolencereportorcomplaintasprovidedhereinmay result in disciplinaryaction against thebuildingreport taker.

G.IntheDistrict. Theschoolboardherebydesignates the Human Resource Manager astheeducation districthumanrightsofficer(s)toreceivereportsorcomplaintsofharassmentor violenceprohibitedbythispolicy.Ifthecomplaintinvolvesahumanrights officer, the complaint shall be filed directlywith thesuperintendent.1

H.Theeducation districtshallconspicuouslypostthenameofthehumanrights officer(s), includingmailingaddresses and telephonenumbers.

I.Submission of a good faith complaint or report of harassment or violence

prohibited bythispolicy willnotaffectthecomplainantorreporter’sfuture employment,grades, work assignments, oreducational or work environment.

J.Useof formal reportingforms is not mandatory.

K.Reports ofharassment orviolenceprohibited bythis policyareclassified as privateeducationaland/orpersonneldataand/orconfidentialinvestigativedata and will not bedisclosed except as permitted bylaw.

L.Theeducation districtwill respecttheprivacyofthecomplainant(s),theindividual(s) againstwhomthecomplaintisfiled,andthewitnessesasmuchaspossible, consistentwiththeeducation district’slegalobligationstoinvestigate,totake appropriateaction, and tocomplywith anydiscoveryordisclosureobligations.

M.Retaliationagainstavictim, good faith reporter, orawitness ofviolenceor harassment is prohibited.

N.Falseaccusationsorreportsofviolenceorharassmentagainstanotherpersonare prohibited.

O.Apersonwhoengagesinanactofviolenceorharassment,reprisal,retaliation,or falsereportingofviolenceorharassment,orpermits,condones,ortolerates violenceorharassmentshallbesubjecttodisciplineorotherremedialresponses forthat act in accordancewith theeducation district’s policies and procedures.

Consequencesforstudentswhocommit,orareapartyto,prohibitedactsof violenceorharassmentorwhoengageinreprisalorintentionalfalsereporting mayrangefromremedialresponsesorpositivebehavioralinterventionsuptoand includingsuspension and/or expulsion.

Consequencesforemployeeswhopermit,condone,ortolerateviolenceor harassmentorengageinanactofreprisalorintentionalfalsereportingof violenceorharassment mayresultindisciplinaryactionuptoandincluding termination ordischarge.

Consequencesforotherindividualsengaginginprohibitedactsofviolenceor harassmentmayinclude,butnotbelimitedto,exclusionfromeducation district propertyandevents and/ortermination ofservices and/or contracts.

V.INVESTIGATION

A.Byauthorityoftheeducation district,thehumanrightsofficer,withinthree(3)days ofthereceiptofareportorcomplaintallegingharassmentorviolenceprohibited bythispolicy,shallundertakeorauthorizeaninvestigation.Theinvestigation maybeconductedby education districtofficialsorbyathirdpartydesignatedbythe education district.

B.Theinvestigationmayconsistofpersonalinterviewswiththecomplainant,the

individual(s)againstwhomthecomplaintisfiled,andotherswhomayhave knowledgeoftheallegedincident(s)orcircumstancesgivingrisetothe complaint.Theinvestigationmayalsoconsistofanyothermethodsand documents deemed pertinent bytheinvestigator.

C.Indeterminingwhetherallegedconductconstitutesaviolationofthispolicy,the education districtshouldconsiderthesurroundingcircumstances,thenatureofthe behavior, past incidents orpast orcontinuingpatterns ofbehavior, the relationshipsbetweenthepartiesinvolved,andthecontextinwhichthealleged incidentsoccurred.Whetheraparticularactionorincidentconstitutesaviolation ofthispolicyrequiresadeterminationbasedonallthefactsandsurrounding circumstances.

D.Inaddition,theeducation districtmaytakeimmediatesteps,atitsdiscretion,to protectthetargetorvictim,thecomplainant,andstudents,teachers, administrators,orothereducation districtpersonnelpendingcompletionofan investigation of alleged harassment orviolenceprohibited bythis policy.

E.Theallegedperpetratoroftheact(s)ofharassmentorviolenceshallbeallowed theopportunity topresentadefenseduringtheinvestigationorpriortothe imposition ofdisciplineorother remedial responses.

F.Theinvestigationwillbecompletedassoonaspracticable.Theeducation district human rightsofficershallmakea written report to the superintendent upon completionoftheinvestigation.Ifthecomplaintinvolvesthesuperintendent,the reportmaybefiled directlywiththeschoolboard. Thereportshallincludea determinationofwhether theallegationshavebeensubstantiatedasfactualand whethertheyappearto beviolations ofthis policy.

VI.EDUCATION DISTRICTACTION

A.Uponcompletionofaninvestigationthatdeterminesaviolationofthispolicyhas occurred,theeducation districtwilltakeappropriateaction.Suchactionmay include,butisnotlimitedto,warning,suspension,exclusion,expulsion,transfer, remediation,termination, ordischarge. Disciplinaryconsequenceswill be sufficientlyseveretotrytodeterviolationsandtoappropriatelydiscipline prohibitedbehavior.Education districtactiontakenforviolationofthispolicywill beconsistentwithrequirementsofapplicablecollectivebargainingagreements, Minnesota and federal law, and applicableeducation district policies and regulations.

B.Theeducation districtisnotauthorizedtodisclosetoavictimprivateeducationalor personneldataregardinganallegedperpetratorwhoisastudentoremployeeof theeducation district.Schoolofficialswillnotifytheparent(s)orguardian(s)of targetsorvictimsofharassmentorviolenceandtheparent(s)orguardian(s)of allegedperpetratorsofharassmentorviolencewhohavebeeninvolvedina reportedandconfirmedharassmentorviolenceincidentoftheremedialor disciplinaryaction taken,to the extent permitted bylaw.

C.Inordertopreventorrespondtoactsofharassmentorviolencecommittedbyor directedagainstachildwithadisability,theeducation districtshall,where determinedappropriatebythechild’sindividualizededucationprogram(IEP)or Section504team,allowthechild’sIEPorSection504plantobedraftedto addresstheskillsandproficienciesthechildneedsasaresultofthechild’s disabilitytoallowthechildtorespondtoornot to engageinactsofharassmentor violence.

VII.RETALIATIONOR REPRISAL

Theeducation districtwilldisciplineortakeappropriateactionagainstanystudent,teacher, administrator,orothereducation districtpersonnelwhocommitsanactofreprisalorwho retaliatesagainstanypersonwhoasserts,alleges,ormakesagoodfaithreportofalleged harassmentorviolenceprohibitedbythispolicy,whotestifies,assists,orparticipatesin aninvestigationofretaliationorallegedharassmentorviolence,orwhotestifies,assists, orparticipatesinaproceedingorhearingrelatingtosuchharassmentorviolence. Retaliationincludes,butisnotlimitedto,anyformofintimidation,reprisal,harassment, orintentionaldisparatetreatment.Disciplinaryconsequenceswillbesufficientlysevere todeterviolationsandtoappropriatelydisciplinetheindividual(s)whoengagedinthe harassmentorviolence.Remedialresponsestotheharassmentorviolenceshallbe tailored to theparticularincident and natureoftheconduct.

VIII.RIGHT TO ALTERNATIVE COMPLAINTPROCEDURES

Theseproceduresdonotdenytherightofanyindividualtopursueotheravenuesof recoursewhichmayincludefilingchargeswiththeMinnesotaDepartmentofHuman Rights,initiatingcivilaction,orseekingredressunderstatecriminalstatutesand/or federal law.

IX.HARASSMENT OR VIOLENCE AS ABUSE

A.Undercertaincircumstances,allegedharassmentorviolencemayalsobepossible abuseunderMinnesotalaw.Ifso,thedutiesofmandatoryreportingunderMinn. Stat. § 626.556 maybe applicable.

B.Nothinginthispolicywillprohibittheeducation districtfromtakingimmediate action to protect victims of alleged harassment, violence, orabuse.

X.DISSEMINATIONOF POLICY ANDTRAINING

A.Thispolicyshallbeconspicuouslypostedthroughouteachschoolbuildingin areasaccessibleto students and staffmembers.

B.This policyshall begiven to each education districtemployeeand independent contractorwhoregularlyinteractswithstudentsatthetimeofinitialemployment with theeducation district.

C.This policyshall appearin thestudent handbook.

D.Theeducation districtwilldevelopamethodofdiscussingthispolicywithstudents and employees.

E.Theeducation districtmayimplementviolencepreventionandcharacter developmenteducationprogramstopreventandreducepolicyviolations.Such programsmayofferinstructiononcharactereducationincluding,butnotlimited to,characterqualitiessuchasattentiveness,truthfulness,respectforauthority, diligence,gratefulness,self-discipline,patience,forgiveness,respectforothers, peacemaking, and resourcefulness.

F.Thispolicyshallbereviewedatleastannuallyforcompliancewithstateand federal law.
