DECISION 100/2008, DATED 18 JUNE, OF THE PLENARY SESSION OF THE CATALAN AUDIOVISUAL COUNCIL

1. Decision 295/2007, dated 19 December, which approved the Catalan Audiovisual Council’s General Directive on the presence of the Catalan language and culture and of Aranese in the audiovisual media, reproduces the obligations concerning language normalisation and the promotion of the use of the Catalan language and culture and of Aranese in the audiovisual media which are explicitly set out in Law 1/1998, of 7 January, on language policy and Law 22/2005, of 29 December, on audiovisual communication in Catalonia. In addition to these obligations, the General Directive referred to above also states that private radio stations whose programming is more than 75% music and which do not specialise in classical music may have access to specific adjustments in terms of the broadcasting of music sung in Catalan.

2. Furthermore, section 2 of article 6 of the General Directive on the presence of the Catalan language and culture and of Aranese in the audiovisual media includes the requirement set out in section 5 of article 26 of the Law on language policy that providers of privately run radio services must ensure that there is an adequate presence of songs produced by Catalan artists in their sung music programming and that as a minimum at least 25% of songs must be performed in Catalan or Aranese.

With respect to this obligation, section 3 of article 6 of the General Directive allows private radio stations whose programming is more than 75% music the option of a specific adjustment of the requirement for 25% of songs that are broadcast to be performed in Catalan or Aranese.

3. The providers of private radio services which are listed in the Annex to this Decision, and which had previously demonstrated to the Catalan Audiovisual Council that they actually do devote more than 75% of their broadcasting time to music, filed an application in April 2008 in order to obtain, if required, the aforementioned specific adjustments.

4. The Council has assessed the documentation submitted in line with the conditions laid out in section 3 of article 6 of the General Directive on the presence of the Catalan language and culture and of Aranese in the audiovisual media, and which are worded as follows: a) the type of music that the radio services provider mostly broadcasts; b) the commitments entered into in the operating licence in terms of songs sung in Catalan; and c) the ratio between the types of music which the radio services provider mostly broadcasts and the market production of recorded songs in Catalan.

Based on its assessment, the Council holds that in view of the type of music broadcast by the providers listed in the Annex to this Decision (domestic and foreign pop music, hits in English, ballads, rock, Eighties oldies, Latino music, etc.), and the volume of record production by musical genre, the providers of privately-run radio services are entitled to a specific adjustment of 12% in terms of the broadcasting of songs performed in Catalan, under the terms of section 2 of article 6 of the General Directive on the presence of the Catalan language and culture and of Aranese in the audiovisual media.

In the light of the foregoing, and in compliance with letter e) of article 10 of Law 2/2000, of 4 May, on the Catalan Audiovisual Council, letter f) of article 115 of Law 22/2005, of 29 December, on audiovisual communication in Catalonia and section 3 of article 6 of the General Directive on the presence of the Catalan language and culture and of Aranese in the audiovisual media, the Plenary Session of the Catalan Audiovisual Council has adopted the following:

DECISIONS

1. To sustain the applications for specific adjustments in terms of the broadcasting of music sung in Catalan made by the holders of the FM radio broadcasting frequencies listed in the Annex to this Decision.

The aforementioned holders must guarantee that in their programming of sung music there will be an adequate presence of songs produced by Catalan artists and that at least 12% of all songs are performed in Catalan during a period of three years from the reception of the notification of this Decision.

2. To notify the interested parties of this Decision.
