VILLAGE OF EMPRESS

BY-LAW No.8-2014
ABYLAWOFTHEVILLAGE OF EMPRESSFORTHEPURPOSEOFREGULATINGDOGSANDACTIVITIESINRELATIONTOTHEM.
WHEREASsection7(h)oftheMunicipalGovernmentAct,RSA2000,c.M-26,asamended,authorizesmunicipalitiestopassbylawsformunicipalpurposesrespectingwildanddomesticanimalsandactivitiesinrelationtothem;
WHEREASCouncilconsidersitadvisabletopassabylawtoregulateandcontrolAnimalsandactivitiesinrelationtothemintheVillage of Empress;
NOWTHEREFORETHEMUNICIPALCORPORATIONOFTHEVILLAGE OF EMPRESSINCOUNCILASSEMBLEDENACTSASFOLLOWS:
1.ThisBylawmaybecitedasthe“DogBylaw”.
2.
(1)InthisBylaw,unlessthecontextotherwiserequires:
(a)“Animal”means a dog, male or female neutered, spayed orunaltered
(b)“AnimalControlShelter”meansafacilitydesignatedbytheVillage forthehousingofanimalsasprovidedforinsection41.
(c)“AnimalShelterSupervisor”meansanyperson,firmorbodycorporate,orservantsandemployeesofaperson,firmorbodycorporate,appointedoremployedbytheVillage tomanageandoperatetheAnimalControlShelterandtocarryoutthedutiesprescribedbythisBylaw.
(d)“BylawEnforcementOfficer”means an employee or independent contractor appointedbythevillage to enforce the provisionof thevillage Bylaws,andincludes a memberof the RoyalCanadian Mounted Police,andwhenauthorized aPeace officer. A Bylaw EnforcementOfficer isa DesignatedOfficerfor the purposes of s.210(5) ofthe MunicipalGovernmentAct, and as such may be the CAO or designate of the CAO.
(e)“ControlledConfinement”meanstheconfinementofadoginapen,cageorotherstructurehaving:
(i)securesidesandasecuretop;
(ii)thebottomsecuredtothesidesorthesidesembeddedinthegroundtoaminimumdepthofthirty(30)centimeters;
(iii)minimumdimensionsof1.5metresby3.0metres;and
(iv)aminimumheightof1.5metres.
(f)“DogTag”meansadevicebearingadistinctiveserialnumberintendedtobeattachedtothecollarofadogandissuedbytheVillage uponpaymentofalicensefeeasprescribedinthisBylaw.
(g)“GuideDog”meansaguidedogasdefinedintheBlindPersons’RightsAct,R.S.A.2000c.B-3.
(h) “InfectiousPhysicalCondition”meansanyabnormalphysicalconditionwhichisliabletobepassedontootherAnimalsorhumansbyinvasion of anorganism emanatingfrom the Animalsuffering fromtheabnormalphysicalcondition.
(i)“Judge”includesajusticeofthepeace.
(j)“Leash”meansaleashthatis:
(i)adequatetocontrolthedogtowhichitisattached;and
(ii)securely attached to the dog by a collar, choke collar orharness.
(k) “Microchip”meansatraceablemicrochipimplantedinadogbyalicensedveterinarianorananimalhealthtechnician.
(l)“Muzzle”meansadeviceofsufficientstrengthplacedoveranAnimal’smouthtopreventitfrombiting.
(m)“NuisanceAnimal”meansanyAnimalinrespectofwhichtherehavebeentwoormoreconvictionsforoffencesunderthisBylaw.
(n)“Owner”meansanynaturalpersonorbodycorporate:
(i)whoisthelicensedOwneroftheAnimal;
(ii)whohaslegaltitletotheAnimal;
(iii)whohaspossession orcustodyoftheAnimal,eithertemporarilyorpermanently;or
(iv)whoharbourstheAnimal,orallowstheAnimaltoremainonthatperson’spremises.
(v)“Owner’sProperty”meansanypropertyinwhichtheOwnerhasalegalorequitableinterestorwhichisotherwiseunderthecontrolorisinthepossessionoftheOwner,andwhichpropertyshallincludeland,buildingsandvehicles.
(w)“Park”meansaParkorRecreationalArea
(x)“Runningat Large” means an Animal which is not under the controloftheOwnerbymeansofaLeashandisuponpropertyotherthanthepropertyinrespectofwhichtheOwnerhastherightofoccupation,oruponanyhighway,thoroughfare,street,road,trail,avenue,parkway,lane,alley,square,bridge,causeway,trestleway,sidewalk(includingtheboulevardportionofthesidewalk),Parkorotherpublicplace.
(y)“ServiceDog”meansaservicedogasdefinedintheServiceDogsAct,R.S.A.2000c.S-7.5.
(z)“SevereInjury”meansanyphysicalinjurythatresultsinbrokenbonesorlacerationsrequiringmultiplesuturesorcosmeticsurgery.
(aa)“ViciousDog”meansadogdeclaredtobeaViciousDogundersubsection23ofthisBylaw.
(2)EachprovisionofthisBylawisindependentofallotherprovisionsandifanyprovisionisdeclaredinvalidforanyreasonbyaCourtofcompetentjurisdiction,allotherprovisionsofthisBylawremainvalidandenforceable.
(3)NothinginthisBylawrelievesapersonfromcomplyingwithanyprovisionofanyfederalorprovinciallaworregulation,orotherbylaworanyrequirementofanylawfulpermit,orderorlicense.
(4)Anyheadingsorsub-headingsinthisBylawareincludedforguidancepurposesandconvenienceonly,andshallnotformpartofthisBylaw.
(5)WherethisBylawreferstoanotherAct,bylaw,regulationoragency,itincludesreferencetoanyAct,bylaw,regulationoragencythatmaybesubstitutedtherefore.
(6)AlltheschedulesattachedtothisBylawshallformpartofthisBylaw.
LICENSINGREQUIREMENTS
DOGLICENSING
3.
(1)Subjecttosubsection3(3),theOwnerofadogshallapplyforandobtainorrenewalicenseforthedogfromtheVillage inaccordancewithsection 4,andshallpaythelicensefeeassetoutinSchedule“A”.
(2)UponreceiptofthelicensefeetheVillage shallissuealicenseandaDogTagifaDogTaghasnot previouslybeenissuedtotheOwnerofthedog inrespectofwhichthefeewaspaid.
(3)Notwithstandingsubsection3(1),theOwnerofaGuideDogorServiceDogisnotrequiredtopayafeeforalicenseunderthisBylaw.
(4)ADogTagissuedunderthisBylawisvalidforthetermofthelicensewithwhichtheDogTagisissuedandforeverysubsequentyear,ifapplicable,wherethelicenseisrenewedbythedatethatitisrequiredtoberenewedunderthisBylaw.
(5)TheOwnerofadogshallprovidethedogwithasecurecollartowhichshall be securelyattached the DogTag andensure that boththe dog collarandDogTagarewornbythedogatalltimeswhenthedogisnotontheOwner’sProperty.
(6)Nopersonshallaffixorpermittobeaffixedtoadog’scollaraDogTagwhichhasbeenissuedinrespectofanotherdog.
(7)AdoglicenseissuedpursuanttothisBylawshallbevalidforthelengthoftimeidentifiedinSchedule“A”.
(8)Theprovisionsofthissectionandofsections4and5ofthisBylawshallnotapplytoaHumaneSocietyoranypersonholdingavalidlicensetooperatearetailpetsales,groomingorboardingbusinesswithintheVillage.
4.AnOwnershall:
(1)subjecttosubsection4(2),applyforalicenseforadog:
(a)onthedaythepersonbecomestheOwnerofthedog;or
(b)ifthedogisnotthree(3)monthsofageonthedaythepersonbecomestheOwnerofthedog,onthedaythedogbecomesthree
(3)monthsofage;
(2)applyforalicensefortheOwner’sdognotwithstandingthatthedogisundertheageofthree(3)months,ifthedogisfoundRunningatLarge;
(3)annuallyapplyforandrenewthelicensefortheOwner’sdog,ifapplicable,priortotheexpiryofthelicense.

5.AnOwnermayberequiredtoprovideproofsatisfactorytotheVillage toestablishoneormoreofthefollowingfacts,priortoalicensebeingissued:
(a)thatadogisbetweenthree(3)tosix(6)monthsofage;
(b)thatadogisaGuideDogorServiceDog;
(c)that a dog has been spayed or neutered and/or marked with amicrochip.
6.
(1)Subjecttosubsection6(2),theOwnerofaViciousDogshall,withinthree
(3)daysofthedoghavingbeendeclaredtobeaViciousDog:
(a)applytotheVillage foralicensefortheViciousDog;
(b)haveaMicrochipimplantedintotheViciousDog;
(c)provideacopyoftheinformationcontainedontheMicrochiptotheOyen RCMP Detachmentpriortoalicensebeingissued;and
(d)paythelicensefeeforaViciousDogsetoutinSchedule“A”.
(2)IftheOwnerofadogdeclaredaViciousDogunderthisBylawappealsthedeclarationoftheRCMPpursuanttosubsection23(3),theOwnershallnotberequiredtoapplyandpayforalicensefortheViciousDogunlessanduntiltheappealcommitteeupholdsthedeclarationoftheRCMP,inwhichcasetheOwnershallhavethree(3)daysfromthedateofreceiptofthedecisionoftheappealcommitteetoapplyandpayforthelicense.
(3)TheOwnerofaViciousDogshallrenewthelicensefortheViciousDogpriortotheexpiryofthelicense.
LICENSINGINFORMATION
7.AnOwnershallforthwithnotifytheVillage ofanychangeswithrespecttoanyinformationprovidedinanapplicationforalicenseunderthisBylaw.
LOSTDOGTAG
8.UponlosingaDogTag,theOwnerofthelicenseddogshallpresentthereceiptforpaymentofthelicensefeetoaBylawEnforcementOfficer,whowillissueanewtagtotheOwnerforthefeesetoutinSchedule“A”ofthisBylaw.
NOREFUND
9.Norefundshallbemadeofanylicensefeeforanyreasonwhatsoever.
NON-TRANSFERABLE
10.AlicenseissuedpursuanttothisBylawisnottransferable.
RESPONSIBILITIESOFOWNERS
RUNNINGATLARGE
11.
(1)TheOwnerofanAnimalshallensurethatsuchAnimalisnotRunningatLarge.
(2)NopersonshalldoanythingoromittodoanythingwheresuchactoromissionhasormayhavetheeffectofcausingorpermittingtheRunningatLargeofanAnimalwithintheVillage.
THREATENINGORNUISANCEBEHAVIOURS
12.AnyOwnerofanAnimalwhich:
(a)bitesorchasesapersonorotheranimal;
(b)bitesorchasesanymotorvehicleorbicycle;
(c)barks,howlsorotherwisecomportsitselfinsuchafashionastodisturbanyperson,orintheopinionofaBylawEnforcementOfficerislikelytodisturbanyperson;
(d)barks,howlsorotherwisecomportsitselfinsuchfashionastoalarmorcauseanypersontofearfortheirphysicalsafety;
(e)bitesapersoncausingaSevereInjury;
(f)causesthedeathofanotherAnimal;
(g)causesanydamagewhatsoevertoanypropertyoranyinjurywhatsoevertoanypersonorotherAnimal;
(h)isatanytimewithinthefloralareaofanyParkordisturbsordestroysanyvegetationorAnimalhabitatinanyPark;
(i)isatanytimeinanywadingpoolorwaterparkintendedforpublicuseorinanybodyofwaterthatislocatedinorflowingthroughanyPark;
(j)isatanytimeuponanypropertywheretheAnimalisprohibitedasindicatedbyasignorothermarking;or
(k)upsetsanywastereceptacleorscattersthecontentsthereof,whetherornottheAnimalisthenRunningatLarge,isguiltyofanoffence.
ANIMALSINVEHICLES
13.NopersonshallleaveanAnimalunattendedinamotorvehicleunlesstheAnimalisrestrainedsoastopreventitfromcomingintocontactwithanyotherpersonorAnimaloutsidethemotorvehicle.
14.AnypersonleavinganAnimalunattendedinamotorvehicleshallensurethatsuitableventilationisprovidedfortheAnimal.
15.NopersonshallleaveanAnimalintheopenboxareaofatruckoropentrailerwhilethetruckortrailerisinmotionunless the animal is restrained in such a manner so as to prevent the animal from reaching the sides of the box.
16.NopersonshallleaveanAnimalunattendedintheopenboxareaofatruckoranopentrailerwhilethetruckortrailerisparkedunless the animal is restrained in such a manner so as to prevent the animal from reaching the sides of the box.
17.The ownerofa vehicleinvolvedin anoffencereferred toin sections13-16 isguiltyoftheoffence,unlessthevehicleownersatisfiestheCourtthatthevehiclewas:
(1)notbeingdrivenorwasnotparkedbytheownerofthevehicle;and
(2)thatthepersondrivingorparkingthevehicleatthetimeoftheoffencedidsowithoutthevehicleowner’sexpressorimpliedconsent.
UNATTENDEDANIMALS
18.TheOwnerofanAnimalshallensurethatsuchAnimalisnotleftunattendedwhiletetheredortieduponpremiseswherethepublichasaccess,whethertherightofaccessisexpressorimplied.
19.TheOwnerofanAnimalshallensurethatsuchAnimalisnotlefttetheredortiedupinaresidentialyardwhennooneatthatresidenceishome.
20.TheOwnerofanAnimalshallnotallowtheAnimalwhentetheredortiedupinaresidentialyardtogetcloserthan1.5metrestothepropertyline.
NUISANCEANIMALS
21.ABylawEnforcementOfficermay,onhavingreasonableandprobablegroundstobelieveanAnimalisaNuisanceAnimal,directtheownerinwritingtotakesuchactionsasdeemednecessarybytheBylawEnforcementOfficertoensurethisBylawisnotfurthercontravened.
22.The Ownerof aNuisanceAnimal whofails tocomplywith thewritten directionofaBylawEnforcementOfficerpursuanttosection21isguiltyofanoffence.
VICIOUSDOGS
23.
(1)IfaBylawEnforcementOfficerbelievesonreasonableandprobablegroundsthatadoghas:
(a)chased,injuredorbittenapersonorotherAnimal;
(b)damagedordestroyedanyproperty;
(c)threatenedorcreatedthereasonableapprehensionofathreattoapersonorotheranimal;or
(d)been previously determined to be a Dangerous Dog under the
DangerousDogsActR.S.A.2000c.D-3,
theBylawEnforcementOfficermayseizeandimpoundthedogattheAnimalControlShelterandrecommendtotheRCMPthatthedogbedeclaredaViciousDog.
(2)Upon receiptof arecommendation fromaBylawEnforcement OfficerPursuanttosubsection23(1),theRCMPmaydeclarethedogto beaViciousDog.
(3)IftheRCMPhasdeclaredadogtobeaViciousDog,aBylawEnforcementOfficershallprovidewrittennotificationofthedeclarationtothedog’sOwner.
(4)ApersonwhoreceivesanoticefromaBylawEnforcementOfficerpursuanttosubsection23(2)mayappealthedeclarationbygivingwrittennoticeoftheappealandthereasonsthereforetotheVillage CAOwithinten(10)daysofreceivingthedeclarationfromtheBylawEnforcementOfficer.
(5)Uponreceiptofanappealpursuanttosubsection23(3),Councilshallestablishanappealcommitteebyresolution.
(6)Theappealcommittee,uponhearingtheappeal,mayupholdthedecisionoftheRCMPorallowtheappeal.
24.TheOwnerofaViciousDogshallatalltimesensurethat:
(1)theViciousDogdoesnot:
(a)threatenorcreatethereasonableapprehensionofathreattoapersonorotherAnimal;
(b)chaseapersonorotherAnimal;
(c)biteapersonorotherAnimal;
(d)otherwiseinjureapersonorotherAnimal,or
(e)damageordestroyanyproperty,
(2)whenaViciousDogisontheOwner’sProperty,either:
(a)theViciousDogshallbeconfinedindoors,inamannerthatshallnotallowtheViciousDogtoescapetheresidenceorotherindoorstructure;or
(b)theViciousDogshallbeconfinedoutdoorsinControlledConfinementthatshallnotallowtheViciousDogwithinone(1)metreofthepropertylineorwithinfive(5)metresofaneighboringresidenceandwhichshallprovidetheViciousDogwithshelterfromtheelements.
25.TheOwnerofaViciousDogshallatalltimesensurethatwhentheViciousDogisnotontheOwner’sPropertytheViciousDogis:
(1)muzzled;and
(2)securedonaLeashnotlongerthanone(1)metre,heldbyapersonatleasteighteen(18)yearsofage,inamannerthatpreventsitfromthreatening,chasing,injuringorbitinganypersonorotheranimalandfromdamagingordestroyinganyproperty.
26.TheOwnerofaViciousDogshallatalltimesensurethattheViciousDogisnotRunningatLarge.
27.
(1)TheOwnerofaViciousDogshallobtainandmaintainliabilityinsurancesatisfactorytotheCAO,specificallycoveringanydamagesforpersonalinjuryandpropertydamagecausedbytheViciousDoginanamountnotlessthantwomilliondollars($2,000,000.00)peroccurrence.
(2)Subjecttosubsection27(1),theOwnerofaViciousDogshallprovideproofoftheinsurancerequiredbysubsection(1)totheCAOnotlaterthanfifteen(15)daysfollowingthedeclarationofthedogasaViciousDog.
(3)IfanOwnerappealsa declarationofthe RCMP pursuanttosubsection23(3),theOwnerisnotobligedtoobtaininsuranceunlessanduntil the appeal committee upholds the declaration of the RCMP,inwhichcasetheOwnershallhavefifteen(15)daysfollowingreceiptofthedecisionoftheappealcommitteetoprovideproofofinsurancetotheCAO.
REMOVINGEXCREMENT
28.
(1)IfanAnimaldefecatesonanypublicorprivatepropertyotherthantheOwner’sProperty,theOwner of the Animalshallremovethefecesimmediately.
(2)AnOwnerofadogshallcarryasuitablemeansofremovingdogfecesatalltimeswhilethedogisinthecustodyoftheOwneronpropertyotherthantheOwner’sProperty.
(3)All feces collected shall be taken and disposed of in the Owner’s Garbage in a manner that complies with the garbage bylaw.
OWNER’SPROPERTY
29.AnOwnershallatalltimeskeepthepropertywhereanAnimaliskeptinacleanandtidycondition.Forpurposesofthissection,“cleanandtidycondition”meanscleanandtidyintheopinionofaBylawEnforcementOfficer,actingreasonably.TheOwner ofaDogis guiltyofan offenceif theyallow anyfecal matterto remain on theirpropertyor toaccumulate to suchan extent as to, in the opinion of aBylaw EnforcementOfficer,constitute anuisancebywayof odor, unsightliness, or detrimentalimpacton the use,enjoyment, orvalue ofnearbyproperties.
ANIMALHEALTH
30.AnOwnerofanAnimalwhichissufferingfromanInfectiousPhysicalCondition:
- shallnotpermitsuchAnimaltobeinanypublicplacewhetherornottheAnimalisthenRunningatLarge;
- shallnotkeepormaintainsuchAnimalincontactwithorinproximitytoanyotherAnimal;and
- shallkeeptheAnimalatalltimeslockedinasecureplace,
butnocontraventionofthissectionoccursbyreasononlyofthefactthatapersontransportsanAnimalsufferingfromanInfectiousPhysicalConditiontoaplacewheretheAnimalmayobtainveterinarytreatment,andtheprovisionsofthissectiondonotapplytoanypersondulyqualifiedandlicensedtopracticeveterinarymedicinewithintheVillage.
31.TheOwnerofadogshallensurethatthedoghasuptodaterabiesvaccinations.
32.OndemandfromaBylawEnforcementOfficer,theOwnerofadogshallproducetotheBylawEnforcementOfficerallveterinaryrecordsforthedog.
DOGOWNERSHIPLIMITS
33.
(1)Nopersonshallown,keeporharbourorallowtobekeptorharbouredonthatperson’spropertymorethanthree(3)dogsagedsix(6)monthsormore.OnthedatethisBylawcomesintoforce,apersonwhoownsmorethanthreedogs shallbepermittedtokeepthosedogs,butshallnotbepermittedtoreplacedogswhichexceedthemaximumsallowedunderthissubsection.
(2)Subsection33(1)doesnotapplytopremiseslawfullyusedforaretailpetsalesbusinessorthecare,maintenanceandtreatmentofdogsoperatedbyandinchargeofalicensedveterinarian,licensedAnimalgroomerorAnimalbreedingbusinessnoranypremisesthataretemporarilyusedforthepurposeofalawfuldogshownortoanypersoninpossessionofavalidlicensetooperateanAnimalboardingbusinesswithintheVillage.
ANIMALCONTROLOPERATIONS
SEIZURE
34.
(1)ABylawEnforcementOfficermaycaptureandimpoundanyAnimal:
(a)inrespectofwhichtherearereasonableandprobablegroundstobelievethatanoffenceunderthisBylawisbeingcommittedorhasbeencommitted;or
(b)whichisrequiredorpermittedtobeimpoundedpursuanttotheprovisionsofanystatuteofCanadaoroftheProvinceofAlberta,oranyregulationmadethereunder.
(2)ABylawEnforcementOfficermay,aftercomplyingwithsection542oftheMunicipalGovernmentAct,R.S.A.2000c.M-26,enteronprivatepropertyforthepurposeofcapturingandimpoundingabarkingdog.
ANIMALCONTROL
35.TheVillage maycontractwithanyperson,firmorbodycorporateforthepurposeofmaintaininganAnimalcontrolfacilityofsuchsizeanddesignandinsuchlocationastheChiefAdministrativeOfficeroftheVillage mayfromtimetotimedirect,andforthepurposesofthisBylawanysuchfacilityistheAnimalControlShelter.
36.TheVillage mayemployanAnimalShelterSupervisor,BylawEnforcementOfficersandsuchotheremployeesinconnectionwiththeoperationoftheAnimalControlShelterandthecarryingoutandenforcementoftheprovisionsofthisBylawastheVillage considersnecessaryandexpedient.
37.SubjecttoSection36,iftheVillage decidestooperateitsownAnimalControlShelter,theAnimalShelterSupervisorshallreportdirectlytoandbeundertheauthorityandsupervisionoftheCAO.
38.
(1)ABylawEnforcementOfficermayenteruponthelandsurroundinganybuildingforthepurposeofpursuinganyAnimalwhichhasbeenobservedRunningatLarge.
(2)Nopersonshalldoanythingoromittodoanythingwheresuchactoromissionhasormayhavetheeffectofobstructing,hinderingorimpedingtheAnimalShelterSupervisororaBylawEnforcementOfficerfromdoinganythinginfurtheranceofthecarryingoutorenforcementofanyprovisionofthisBylaw.
(1)WhenadogwearingaDogTagisimpounded,aBylawEnforcementOfficershallserveuponthepersontowhomthetagwasissuedanoticeintheformsetoutinSchedule“B”tothisBylaw,eitherpersonallyorbyleavingthenoticeatormailingittotheaddressofthatpersonasindicatedintherecordsoftheVillage.
(2)Apersontowhomanoticeismailedpursuanttotheprovisionsofsubsection39(1)shallbeconclusivelydeemedtohavereceivedsuchnoticeonthefourthdayaftermailingthereof,Saturdays,Sundaysandstatutoryholidaysexcepted.
40.OntherecommendationoftheAnimalShelterSupervisor,fromtimetotime,theVillage maysetfeesforcareandsustenanceofanAnimalattheAnimalControlShelter.
41.
(1)AnOwnerofanimpoundedAnimalmayreclaimtheAnimaluponpayment to the Animal Shelter Supervisorto an amount equal to:
(a)The total of all impoundment fees, care and subsistence charges, and reasonable veterinary expenses incurred by the Animal Shelter Supervisor in respect of the Animal during the period impounded, pursuant to section 40 and Schedule “C” of this Bylaw; and
(b)Any license fees payable under this Bylaw at the time the Animal is reclaimed.
(2)The Animal Shelter Supervisor may require the owner who claims an Animal from the Animal Shelter to provide:
(a)A receipt for the delivery of the Animal, which receipt shall set out the tag number, a brief description of the Animal, and the name and address of the Owner; and
(b)Photo identification of the Owner.
42.
(1)WhenanAnimalhasbeenintheAnimalControlShelterforseventy-two
(72)hoursormoreandtheOwneroftheAnimalhasnotreclaimeditinaccordancewithsection41ofthisBylaw,theAnimalShelterSupervisormay:
(a)destroytheAnimal;
(b)offertheAnimalforsaleatapricesetbytheAnimalShelterSupervisor;or
(c)retaintheAnimalintheAnimalControlShelterforsuchfurtherperiodoftimeastheAnimalShelterSupervisormaythinkadvisableinthecircumstances.
(2)WheretheOwnerofanimpoundedAnimalhasadvisedtheAnimalShelterSupervisorthattheOwnerhasnofurtherinterestintheAnimal,theAnimalShelterSupervisormaydestroytheAnimaloroffertheAnimalforsaletoapersonotherthantheOwner,notwithstandingthattheAnimalmaythenhavebeenintheAnimalControlShelterlessthanseventy-two(72)hours.
(3)ForthepurposeofcalculatingthelengthoftimeanAnimalhas been impounded, statutory holidays shall not be included in the calculation.
(4)TheAnimalShelterSupervisorshallnotsellanyimpoundedAnimal:
(a)toaresidentoftheVillage,unlessatthetimeofpurchasingtheAnimalthatpersonfulfilsalllicensingrequirementsunderthisBylawincludingpaymentofthelicensefeeprescribedinSchedule“A”tothisBylaw;or
(b)toanyotherperson,unlessthatpersonfurnishesprooftothesatisfactionoftheAnimalShelterSupervisorthatthepersonisnotaresidentoftheVillage andthattheAnimalwillbekeptoutsidetheVillage.
(5)UponanysaleofanAnimalbytheAnimalShelterSupervisorinaccordancewiththeprovisionsofthisBylaw,thepersonpurchasingtheAnimalshallbeconclusivelydeemedtheOwnerandallclaimsorrightsofownershipofanyotherpersonareextinguishedbyandatthetimeofthesale.
(6)WhenevertheAnimalShelterSupervisordestroysanAnimalinaccordancewiththeprovisionsofthisBylawtheOwnershallbeliabletopaythefeefordestroyingan Animal asset by the Animal Shelter Supervisor, and in everycasewherethesaidfeehasnotbeenpaidpriortothedestructionoftheAnimal, theAnimalShelterSupervisormaypresenttheOwnerwithabillorinvoicethereforewhichshallbepaidinfullbytheOwnerwithinthirty(30)daysofreceiptofit.
(7)WhenadogwearingaDogTagisimpounded,thetimeduringwhichthedogmustbekeptintheAnimalControlShelterbeforeitmaybedestroyedorofferedforsaleshallnotcommencetorununtilaBylawEnforcementOfficerhasservedanoticepursuanttosubsection39(1)ofthisBylaw,andwheresuchnoticeismailedthetimeshallnotcommencetorununtilthenoticeisdeemedtohavebeenreceivedpursuanttotheprovisionsofsubsection39(2)ofthisBylaw.

43.Nopersonshalldoanythingoromittodoanythingwheresuchactoromissionhasormayhavetheeffectofteasing,tormentingorannoyinganAnimal.

GENERALPENALTYPROVISIONS
44.
(1)WhereaBylawEnforcementOfficerbelievesonreasonableandprobablegroundsthatapersonhascontravenedanyprovisionofthisBylawtheBylawEnforcementOfficermaycommenceproceedingsbyissuingasummonsbymeansofaviolationticketinaccordancewithPart2oftheProvincialOffencesProcedureActR.S.A.2000c.P-34.
(2)ThespecifiedpenaltyinrespectofacontraventionofthisBylawistheamountsetoutinSchedule“D”ofthisBylaw.
(3)Pursuanttosubsection7(i)(vi)oftheMunicipal Government Act,ifthesummonsissuedbyaBylawEnforcementOfficerundersubsection(1)soprovides,thepersonnamedinasummonsmaymakeavoluntarypaymentinthespecifiedamountsetoutinSchedule“D”ofthisBylaw,anduponmakingthevoluntarypayment,the person will not be prosecuted for the contravention.
45.
(1)ApersonwhocontravenesanyprovisionofthisBylawisguiltyofanoffenceand liable upon conviction topay a fine of notlessthan theminimumpenaltysetoutinSchedule“D”ofthisBylawandnotmorethanTen ThousandDollars($10,000.00)orindefaultofpaymenttoimprisonmentforaperiodofnotmorethanoneyear.
(2)Paymentofanyfineorimprisonmentforanyperiodoftime,pursuanttotheprovisionsofthisBylaw,shallnotrelieveanypersonfromtheobligationtopayanyfees,chargesorcostsforwhichthatpersonisliableundertheprovisionsofthisBylaw.
(3)PaymentofanyfineorimprisonmentforanyperiodasprovidedforinthisBylawshallnotrelieveanypersonfromanycivilliabilitywhatsoeverwhichmayarisebyreasonofthatperson’scontraventionofanyprovisionofthisBylaw.
(4)AJudge,inadditionto thepenalties otherwiseprovidedinthisBylaw,may,iftheJudgeconsidersitnecessaryinthepublicinterest,directorordertheOwnerofanAnimaltotakemeasurestoensurethattheAnimalstopsdoingorrepeatingtheactcomplainedof,ortohavetheAnimalremovedfromtheVillage,ortohavetheAnimaldestroyed.
(5)AJudge,afterconvictingtheOwnerofadogofanoffenceunderthisBylaw,may,inadditiontoanyotherpenaltiesimposedorordersmade,withoutfurthernoticeorhearing,declarethedogtobeaViciousDog.
46.Bylaw 7-63 and any amendments thereto are hereby repealed.
47.That this by-law shall take effect on the date of the third and final reading.
