Be it know that Bella Vista storage (Owner) does hereby lease to the named Lessee the above numbered storage space on a month to month basis with all rent payments due and payable on the first calendar day of each month. The first rent payment shall be prorated for the balance of the first month. It is the responsibility of the Lessee to send the payment to the proper address on time. This lease shall automatically renew for additional months unless Lessee gives written notice to Owner of intention to terminate this lease at least five (5) days prior to the end of each month. Lessee must give written or verbal intention to terminate this lease at least five (5) days prior moving out in order to discontinue payment obligations.

LATE RENT PENALTY AND RETURNED CHECK CHARGES: All rent is due on the first day of each month. Failure to make payment by the fifteenth (15) day of the month will result in a late charge of fifteen ($15) dollars. Lessee agrees to pay Twenty-Five ($25) plus applicable bank charges for each returned NSF check. Payments will be applied to late charges & other fees first.

DAMAGE - BREACH: Lessee acknowledges that he has inspected the storage space and finds it to be clean and fit for the purpose of storing moveable property. Lessee hereby tenders and Owner acknowledges receipt of damage and breach of contract. Lessee agrees to pay any unpaid rent, damages, and fees to Owner.

Lessee agrees NOT TO OPERATE a gas or electrical heater on the premises, NOT TO CONNECT any equipment using electricity, and NOT TO STORE any toxic or flammable materials in the storage facility. Lessee agrees that Owner may dispose of any property left in the leased space or on the premises by Lessee after the termination of this contract, and Lessee shall be liable for any cost in incurred by Owner in the disposal if such property.

ACCESS: Lessee’s access to the premises may be conditioned to any manner deemed reasonably necessary by Owner to maintain order of the premises. Such measures may include, but is not limited to verification of Lessee’s identity and limiting hours of operation.

RELEASE OF OWNER’S LIABILITY: ALL PROPERTY KEPT STORED IN OR IN THE SELF STORAGE FACULITY SHALL BE AT THE LESEE’S SOLE RISK. Lessee shall furnish his own locks for each space rented which in the Lessee’s sole discretion is sufficient to secure the leased space. Lessee assumes responsibility for the condition of the leased storage space and Owner will not be responsible for any damage thereto of moveable property stored therein or thereon arising from any cause whatever, of the active or passive acts on omission of negligence of Owner or Owner’s Agent. Lessee further waives and discharges the Owner from all warranties imposed by Utah State Laws.

INSURANCE AND INDEMNFICTIONS: Lessee acknowledges that Owner carries no insurance covering any property stored on the premises. Lessee shall at his own expense obtain insurance on his stored property for protection against fire, burglary, and vandalism, in an amount no less than the actual cash value of the property. Lessee expressly agrees that the carrier of such insurance shall not be subrogated to any claim of Lessee against Owner or Owners agent or employees. Lessee agrees to indemnify and to hold Owner or Owner’s agent harmless and free of any claims, demands, actions, damages, and cost of any kind as a result from Lessee’s use of storage space.

OWNER’S PRIVILEGE AND LOCKOUT PROVISIONS: If Lessee fails to pay rent for 30 days, Owner shall be entitled to take possession of all articles inside the rental unit at which time title shall be transferred to Owner, and Lessee will be denied any access to personal property. Lessee agrees to pay all attorney fees and court costs if assigned for collection, as well as any other collections costs (including but not limited to mailing fees and auction advertising fees). Owner shall give Lessee 15 days notice of intent to sell Lessee’s property. No authority needs to be present for Owner to remove property left in unit for failure to pay rent. Upon breach of this contract by Lessee, Lessee agrees that Owner shall have the right to place Owner’s lock on the storage unit door, lockbox, or stored vehicle.

NO ORAL AGREEMENTS: Lessee agrees to follow all of the Owner’s rules now in effect or may be put into effect from time to time in the future. This agreement contains the entire agreement between Owner and Lessee, and no other agreement shall be of any effect whatsoever. Lessee agrees not to rely upon any oral representation made by Owner or employees. Lessee agrees that this agreement may by modified only in writing and signed by both parties, in order for such modifications to have any effect. This agreement shall be interpreted and construed under the laws of Utah.

Yard Sales anywhere on the Bella Vista Storage Property are prohibited.

I HAVE READ AND FULLY UNDERSTAND THE COVENANTS, TERMS, AND CONDITIONS OF THE RENTAL AGREEMENT. I ACKNOWLEDGE THAT I HAVE RECEIVED A COPY OF THE SAME.
