STEP1- The Spouse that has decided to file for divorce must complete the following forms and be sure to have them filed with the Circuit Court Clerk's Office in the County where you reside:
· Alabama Complaint for Divorce
· Affidavit of Testimony in Support of Decree
· Divorce Information Sheet
· Pay $324 filing fee with the court.
STEP2- You must inform your spouse of the filing by sending copies of the filed documents (above) and theAnswer, Waiver, and Agreement for Taking of Testimony. You andyour spouse will have to meet or you will have to have your spouse send theAnswer, Waiver, and Agreement for Taking of Testimonyback to you so that you can deliver the form to the clerk.
*IFYOUHAVEMINORCHILDREN-Schedule a time to meet with your spouse in order to fill out the following forms:
· Child Support Obligation Income Statement
· Child Support Guidelines
· Child Support Guidelines Worksheet
· Child Support Guidelines Notice of Compliance
*File all 4 forms with the clerk once completed.
STEP3-You will have to negotiate the terms of the assets and debts the both of you have by jointly filling out and completing theSeparation Agreement. Using the completed Separation Agreement you will then need to complete theFinal Decree and Judgment of Divorce.
STEP4-At this time the spouse that filed for divorce will be required to file the completedSeparation AgreementandFinal Decree and Judgment of Divorce. While at the clerk's office, you will be able to schedule a court hearing date (if necessary). You will either be instructed that a hearing is necessary, or, that the Judge will authorize yourFinal Decree and Judgment of Divorceand the court will send it in the mail.
Whether you get theFinal Decree and Judgment of Divorcein the mail or at the end of your court hearing, you will have to file it with the clerk and your divorce in the State of Alabama is complete.
