The Nizamabad Municipal Corporation proposes to “Develop a park at Maruthi Nagar in Nizamabad Municipal Corporation”.Therefore, NMC invites RFPs for preparation of DPRs from agencies that have experience in wall design, drawing and layout of greenery in public/ private places and who have experience in the field of greenery consultancy not less than atleast 5 years. Interested agencies who are having technical competency to perform this assignment can obtain thedetails and the Request For Proposal (RFP) documents from the Engineering section of Nizamabad Municipal Corporation, Nizamabad by paying Rs.1,000/- (Rupees One Thousand Only) Non-refundable in the form of D.Ds drawn in favour of the Commissioner, MunicipalCorporation, Nizamabad payable at any nationalized/Scheduled bank in Nizamabad. The RFP can also be downloaded from the NMC website i.e.,https://www.mcnizamabad.in. The DDs shall be enclosed along with the tender schedules.

INSTRUCTION TO BIDDERS
1) INTRODUCTION
Nizamabad Municipal Corporation (NMC) is one of the major cities in Telangana with 3.48 Lakhs population extended in 40.63 Sq.Kms of area with 50 political wards .
Now the GoI has sanctioned the a Park project for Nizamabad Municipal Corporation costingRs.135.00Lakhs. under AMRUT.
Hence the NMC requires the consultancy services for preparation of DPR for Development of Park against the AMRUT sanction.
2) INVITATION TO SUBMIT PROPOSALS
NMC invites detailed proposals from eligible agencies having experience in the Greenery / Parkssector. (“Bidder”) to Prepare a DPR for Preparation of Detailed Project Report for “Development of Park at Maruthi Nagar in Nizamabad Municipal Corporation. (“The Assignment”), in prescribed format set out in the RFP.
MINIMUM ELIGIBILITY CRITERIA FOR BIDDERS
a) The participating agency shall have experience in wall design, drawing and layout of greenery in public/ private places and should have experience in the field of greenery consultancy not less than 5 years.
b) The bidder shall have at least five years of experience in the field of consultancy in Infrastructure projects.
c) The bidder must have undertaken and completed at least One DPR services for Development of Park / Green Spaces not less than Rs. 1.35crores each under any State Government/ GoI/PSU/ULB,s or any central or State govt. undertaking in India in last five financial years.
d) The Bidders shall have average annual turnover of not less than Rs. 50.00 lacs in similar nature of work in the last three financial years prior to 31st March 2016.
e) Must have valid registration for GST, and last 3 years income tax returns along with PAN card.
3) GENERAL:
a) Interested agencies who are having technical competency to perform this assignment can obtain the details and the Request For Proposal (RFP) documents from the Engineering section, NMC, Nizamabad by paying Rs.1,000/- (Rupees One Thousand Only)(Non-refundable) in the form of D.Ds drawn in favour of the Commissioner, Municipal Corporation, Nizamabad payable at any nationalized/ Scheduled bank in Nizamabad. The RFP can also be downloaded from the NMC website i.e.,https://www.mcnizamabad.in. The DDs shall be enclosed along with the tender schedules.
b) NMC intends to appoint a single entity for the assignment.The scope of work is prescribed in TOR for preparation of DPR of Development of Park. However, NMC shall have the discretion to increase or decrease the scope of services under the assignment.
c) The DPR stage shall comprise of Preparation of Greenery Layouts, planning, Preparation of BOQs, Preparation of Cost Estimates, Structural Designs, compliance of remarks and approval of the schemes.
d) NMC intends to select a consultant for preparation of DPR of Development of Park as per the ToR and the scope of services are set out in Section 4.

f) The Proposals received from eligible technical consultants will be evaluated on the basis of the criteria set out in this RFP document. Each Bidder shall submit a maximum of one (1) Proposal for the Assignment. Any Bidder who submits more than one Proposal for the Assignment shall be disqualified.
g) The Bidder shall also be responsible and shall pay for all of the costs associated with the preparation of its Proposal and its participation in the bidding process.
f) The Successful Bidder is required to enter into a Consultancy Agreement with NMC and the draft of the same is set out in Section 5.
g) The fees shall be paid to the Successful Bidder by NMC in the manner as set out in the Draft ConsultancyAgreement.
h) The Consultancy period for survey & DPR preparation shall be 2 months.
i) The Proposal shall remain valid for a period not less than 60 days from the Proposal
Due Date (Proposal Validity Period). NMC reserves the right to reject any Proposal,
which does not meet this requirement. The proposal validity period may further be extended on mutual consent.
4) EARNEST MONEY DEPOSIT ( EMD)
a) Proposal should necessarily be accompanied by an Earnest Money Deposit for an amount of Rs.5,000/- (Rs. Five thousand only) in the form of Demand Draft in favour of the Commissioner, NMC, from any Nationalized/Scheduled bank,payable at Nizamabad.
b) EMD shall be returned to the unsuccessful Bidders after the finalization of tender.
c) EMD submitted by the Successful Bidder shall be adjusted towards theperformance security and retained by NMC.
d) EMD shall be forfeited in the following cases:
i. if any information or document furnished by the Bidder turns out to be misleading or untrue in any material respect; and
ii. If the successful Bidder fails to execute the Consultancy Agreement within the stipulated time or any extension thereof provided by NMC.
iii. If the bidder withdrawn its offer after submitting the proposal
5) CLARIFICATIONS AND AMENDMENTS TO RFP DOCUMENTS
At any time before the proposal due date, the NMC may, whether at its own initiative, or in response to a clarification requested by a firm, amend the RFP by issuing an amendment. The amendment shall be uploaded in the website(https://www.mcnizamabad.in) only. The amendments shall be binding on the bidders. To give bidders reasonable time to take an amendment into account in their proposals, the NMC may at its discretion, if the amendment is substantial, extend the deadline for the RFP submission by uploading a notice in the website of NMC only. In case there is a substantial change in RFP, NMC will publish the revised RFP. Revised RFP will be uploaded in the website (https://www.mcnizamabad.in) and the same should be submitted.
6) CONFLICT OF INTEREST
NMC’s policy require that selected bidders under contracts provide professional,objective, and impartial advice and at all times hold the NMC’s interests paramount, avoid conflicts with other assignments or their own corporate interests and act without any consideration for future work. Bidders shall not be engaged for any assignment that would be in conflict with their prior or current obligations of NMCs, or that may place them in a position of not being able to carry out the assignment in the best interest of NMC. Without limitation on the generality of the foregoing, bidders, and any of their associates shall be considered to have a conflict of interest and shall not be engaged under any ofthe circumstances set forth below:
(i) If a consultant combines the function of consulting with those of contracting and/or supply of equipment; or
(ii) If a consultant is associated with or affiliated to a contractor or manufacturer;
or
(iii) If a consultant is associated with or affiliated to or combines thefunction of consulting with the firm that prepared the Detailed Project Report (DPR) Architectural Planning or proof checking engineering, designfor the project(s) under assignment.
(iv) If a consultant is hired or enrolled by a contractor or a manufacturing firm for the projects(s) under assignment offering services as bidders for the consultant should include relevant information on such relationships along with a statement in the Technical proposal cover letter to the effect that the consultant will limit its role to that of a consultant and disqualify itself and its associates from work, in any other capacity or any future project within the next five years(subject to adjustment by NMC in special cases), that may emerge from this assignment (including bidding or any part of the future project). The contract with the consultant selected to undertake this assignment will contain anappropriate provision to such effect; or
(v) If there is a conflict among consulting assignments, the consultant (including its personnel) and any subsidiaries or entities controlled by such consultant shall not be engaged for the relevant assignment.
7) FRAUD AND CORRUPTION
a) NMC requires that bidders to observe the highest standard of ethics during theselection process and in execution of contracts. In pursuance of this policy, the NMC : defines, for the purposes of this provision, the terms set forth below as follows:
i. “corrupt practice” means the offering, giving, receiving, or soliciting,directly or indirectly, of anything of value to influence the action of any party in the consultant selection process or in contract execution;
ii. “fraudulent practice” means a representation or omission of facts inorder to influence a selection process or the execution of a contract;
iii. “collusive practices” means a scheme or arrangement between two ormorebidders, designed to influence the action of any party in a consultant selection process or the execution of a contract;
iv. “coercive practices” means harming or threatening to harm, directly orindirectly, persons or their property to influence their participation in aconsultant selection process, or affect the execution of a contract; and
b) NMC will reject a proposal for award if it determines that the consultant recommended for award has directly, or through an agent, engaged incorrupt, fraudulent, collusive, or coercive practices in competing for thecontract in question;
c) NMC will sanction a party or its successor, including declaring ineligible,either indefinitely or for a stated period of time, such party or successor fromparticipation in NMC -financed activities if it at any time determines that the consultant has, directly or through an agent, engaged in corrupt, fraudulent, collusive or coercive practices in competing for, or in executing an NMC financed contract; and
d) NMC will have the right to require that, in consultant selection documentation and in contracts financed by the NMC, a provision be included requiring bidders to permit the NMC or its representative to inspect their accounts and records and other documents relating to consultant selectionand to the performance of the contract and to have them audited by auditorsappointed by the NMC.
