(b)pension plans are complicated;
(c)securingtheinterestinthebenefitsisimportanttoeachofus,particularlywithrespect toprovidinguswithincomeinoldage;
(f)eachofushasreadthisformandunderstandsit;
(g)no one has put any pressure on either of us to sign this form;
(h)eachofusrealizesthat
(i)thisformonlygivesageneraldescriptionofthelegalrightseitherofushasunder theFamilyLawActandthePensionBenefitsStandardsActandtheregulationsto thoseActs,and
(ii)ifeitherofuswishestounderstandexactlywhatourlegalrightsarewemustread theFamilyLawAct,andthePensionBenefitsStandardsActandtheregulationsto thoseActs,and/orseeklegaladvice;
(i)theremaybetaximplicationstothis agreement that should be addressed;
(j)ifthepension/annuityhasalreadycommenced,theadministrator/annuityissuerwill makenoadjustmenttothepaymentsalreadymadeunderthepension/annuity.Wewill needtoaddressbetweenourselvesanycompensationforpaymentsmadebeforethe administrator/annuity issuer is able to implement the divisionof the benefits;
(k)wemustprovidefurtherdocumentsorevidenceofentitlementasreasonablyrequested by the administrator/annuity issuer;
(l)eachofusisentitledtoacopyofthisform.

Dividingbenefits underPart6 of theFamilyLaw Actrequires an agreement between the parties, or an order, that provides for thatdivision.The agreement or order mustsetout thedates tobeusedfor determining theportionof the benefits thatare subject todivision.Thisform canbeusedby theparties for thatpurpose and ifsignedby them constitutes an agreementunder section127of theFamily Law Acttodivide thebenefits.
