UNICEF Tbilisi requestsproposalsto select the company Strengthening Multidisciplinary Mechanism for the Implementation of the Juvenile Justice Code

Accordingly, we enclose our Request for Proposal No. P-GEO-2016-005and you are requested to:

(a)Submit your proposal with unit price(s) in GELtogether with vendor registration form, as instructed, on or before closing time.

(b)Note that failure to submit proposal in GEL, or in accordance with the requested terms, will result in automatic invalidation of your application.

In addition, please note that:

(a) UNICEF and its implementing partners are VAT exempt. Kindly ensure that all price(s) quoted in GEL are excluding VAT;

(b)For transparency of the process we require that the proposals are received in the sealed form (sealed envelopes);

(c)It is important that you read all of the provisions, to ensure that you understand UNICEF’s requirements and can submit an offer in compliance with them. This includes submission of ALL documents requested. Note that your proposals should be submitted in English using the enclosed format. Proposals received in any other manner or after the indicated above deadline will be INVALIDATED.

(d)Evaluation criteria will be based on reliability of the organization, suggested methodology and approach, best price and proposal terms.The ratio between the technical and price criteria is 70:30.

(e)In case of pre-payment request, bank guarantee letter should be submitted

SUBMISSION TERMS:

In order to be considered for an award, your technical and price proposals should be hand delivered in separate sealed envelopes and placed in the locked Tender Box located at the Ground Floor of UN House, 9 Eristavi Street, Vake, Tbilisi 0179, Georgia NO LATER than 15:00 of 18 May2016.

While the price proposals remain sealed until the technical evaluation is completed, the technical envelopes will be opened immediately after the closing time and forwarded to the unit designated to manage the selection process. One representative from each bidding company may attend the opening process.

The sealed envelopes should be labeled as follows: (1) P-GEO-2016-005- Technical Proposal and (2) P-GEO-2016-005 - Price Proposal.

Technical Proposal should include:

Company’s profile; Project proposal; Description of the proposed work plan, timeline, and working methodology; CV s of suggested experts; Information regarding organization’s bank account issued by Bank (stamped); filled VMIP Vendor Registration form (template is attached)

Price Proposal should include: Cover letter;proposed budget with indication of proposed fees; (in GEL).

Strengthening Multidisciplinary Mechanism for the Implementation of the Juvenile Justice Code

Georgia is a party to the Convention on the Rights of the Child (CRC). The Convention requires State Parties to develop and implement a comprehensive juvenile justice policy in the “best interest of the child”. In that particular context, the best interest of the child means that the traditional objectives of the criminal justice, such as repression/retribution, must give a large way to rehabilitation and restorative justice objectives in dealing with child offenders.

According to CRC children in conflict with the law should be treated in a manner consistent with the promotion of the child's sense of dignity and worth, which reinforces the child's respect for the human rights and fundamental freedoms of others and which takes into account the child's age and the desirability of promoting the child's reintegration and the child's assuming a constructive role in society (CRC art. 40). International standards also urge states to recognize the particular vulnerability of child victims and witnesses and their need for protection within justice systems.

Taking into account all above mentioned and in order to better consider the best interests of the child in the justice system, the Committee on the Rights of the Child, requires a separate juvenile justice system and different treatment for children, and further obliges the States Parties to establish a separate juvenile justice policy, legislation and system.

In 2013, the Ministry of Justice in cooperation with the EU funded project “Support to the Criminal Justice System Reform in Georgia” and UNICEF initiated the process of the development of the Juvenile Justice Code was adopted in June 2015.

The Code is a comprehensive document covering issues concerning children in conflict with the law, child victims and witnesses of crime as well as children participating in administrative violations proceedings and brings Georgian Juvenile Justice Legislation close to international standards.

The implementation process is the most important and challenging phase which has to guarantee application of a child friendly approach in practice. The implementation process requires reaching a common understanding of the new approaches and principles among all professionals involved, the development of secondary legislation, protocols and guidelines, the establishment of different mechanisms and strengthening capacity of justice and other professionals.

UNICEF therefore seeks to engage a local organization in order to support the establishment of common practices and monitor the implementation of JJ code.

Specific tasks:

Attend and support the organization of a multidisciplinary workshop in Tbilisi with the participation of a senior representative of major stakeholders such as the Chief Prosecutor’s Office, the Court, the Ministry of Justice, the Ministry of Internal Affairs, the Ministry of Corrections, the Social Service Agency, the Legal Aid Service, and the Georgian Bar Association. By the end of the workshop, it is expected to agree on a common understanding and interpretation of all challenging provisions of the Code;

Based on the outcomes and discussions of the multidisciplinary workshop, assist UNICEF with the preparation of a Guiding Document to be disseminated among all justice professionals during the “regional workshops”;

Prepare a pool of facilitators in order to co-facilitate multidisciplinary workshops in all regions;

Organise multidisciplinary workshops in all regions in order to facilitate discussion between specialized professionals at the local level, identify potential problematic issues and provide relevant guidance;

Based on the outcomes of the regional workshops, develop a document which will outline existing practical problems to inform policy makers, develop further guidance and disseminate among specialized professionals

Monitor the implementation of the Juvenile Justice Code.

Deliverables

Methodology for the facilitation of the regional workshops;
Reports outlining major outcomes of each of the regional workshops;
A final report with recommendations outlining practical problems to inform policy makers and develop further guidance for specialized professionals

Qualifications

Intensive experience of working in criminal justice and juvenile justice fields;
Extensive experience in developing legal documents concerning children in the justice system;
Experience in conducting workshops on Juvenile Justice and Child’ Rights;
Comprehensive knowledge of local criminal justice and juvenile justice fields including policy, legislation and implementation levels.

Supervision

The work of the organization will be directly supervised and guided by UNICEF Juvenile Justice

Officer. The overall supervision will be provided by the Chief of Child protection Section.

Duration

The work will be conducted over a period of 6 months.

IMPORTANT – ESSENTIAL INFORMATION

Proposals must be received by latest 15:00hrs on 18th May 2015.

Proposals received after the stipulated date and time will be invalidated. Technical Proposal for the requested services must be enveloped separately and corresponding financial proposal must also be enveloped separately.

The reference RFP 005 must be shown on the envelopes containing the financial & Technical proposals with a label financial proposal or Technical proposal.Proposals Deliveredincorrectly will be invalidated, even if received before the stipulated deadline.

Price Proposals will only be accepted in the currency stated in the enclosures to this LRPS (GEL). Any Proposal received in any currency other than the stated currency will be invalidated.
