APPENDIX 1

Conditions Attached to 06/00369/FULL

  1. Unless otherwise agreed in writing, no part of the development that is authorised by this planning permission may be taken into use prior to (i) the completion of the infrastructure requirements referred to in (a) to (e) hereof in accordance with plans and specifications that have been approved by the Council and (ii) the implementation of the proposals for incorporating public art in the development approved by the Council in accordance with (f).

a)The design and construction of an appropriately sized roundabout at the junction of the A908 Hallpark and Fairfield Road, Sauchie.

b)The design and construction of a controlled pedestrian crossing where the mixed leisure route (former Alloa to Tillicoultry rail line) crosses Fairfield Road, Sauchie.

c)The design and installation of streetlightingstreet lighting columns along the length of the mixed leisure route between Fairfield Road and the site of the proposed Alloa Railway Station to the south and west of the development, to a standard suitable for adoption by the Council.

d)The design and installation of closed circuit television cameras at or in close proximity to all entrances and associated public routes to the proposed development.

e)Proposals for the reinstatement of the existing redundant vehicle access at Hallpark in association with the proposed remote footway which is hereby approved.

f)Proposals for incorporating public art in the development in accordance with the parameters set out in Policy INF13 of the Clackmannanshire Local Plan.

  1. No part of the development that is authorised by this planning permission may be taken into use prior to, a Travel Plan having been submitted to and approved in writing by the Council. The Plan shall accord with the principles in SPP17 “Planning for Transport” and shall set out strategic transport aims and objectives, identify the measures to be implemented and the associated monitoring and management review arrangements to be introduced to ensure that the objectives of sustainable development are achieved.
  2. The principal vehicle access to the car park off the A908 Hallpark Road shall be constructed generally in accordance with Drawing No. L(PA) 4020A and in accordance with the Council’s Development Roads Guidelines and Specification.
  3. Before any work starts on site, a scheme of landscaping shall be submitted to and approved in writing by the Council. The scheme shall include:-
    (i) A plan of the development showing all existing trees to be removed and all existing trees, shrubs and hedgerows to be retained as part of the overall site layout.
    (ii) Details of the type, number and location of proposed trees, shrubs and other plants.
    (iii) A specification for the preparation of ground and soil conditions associated with tree and shrub planting.
    (iv) Arrangements for implementation and future maintenance.

(v) The developer will implement the scheme of landscaping in accordance with the arrangements, including timescales, approved by the Council in accordance with Condition 5(iv).

  1. Further to Condition 6, the scheme of landscaping shall incorporate the following changes to Drawing No. L(PA) 501 Revision A which is otherwise approved:-
    a) The provision of additional shrub planting alongside the palisade fencing on the southern site boundary.
    b) The provision of additional shrub planting within the area of open space between the car park and Hallpark.
    c) A survey of the existing shrub planting along those sections of the mixed leisure route within the application site, and the scope to maximise the retention of existing shrub planting. Where this is not possible, shrub planting will be favoured to the proposed grass seeded areas, particularly on the steeply sloping sections adjacent to the cemetery.
    d) The provision of avenue tree planting on either side of the main pedestrian access from Hallpark to the ground floor entrance to the Health Centre.
  1. Before any work starts on site, details of all outside building materials shall be submitted to and approved in writing by the Council. The details may include arrangements for the construction of sample panels of materials for inspection during the construction phase of the development. Unless otherwise agreed in writing the development will be completed only using such materials as have been approved by the Council in accordance herewith.
  2. Before any work starts on site, a further plan identifying all existing walls, fences and other means of enclosure, proposed changes to such features and proposals for new walls and fences shall be submitted to and approved in writing by the Council. Such proposals shall include:-
    a) The adaption and/or retention of existing stone walls.
    b) The scope to recover stone from redundant walls within the development to provide a new boundary wall with rounded coping stones on the Hallpark site frontage and associated vehicle entrance radius.
    c) The provision and enclosure of cycle parking, providing 42 cycle parking spaces.
    d) An examination of the scope to remove and replace the existing metal palisade fencing along the southern site boundary.
    d) Clarification of the retention of and relationship of the development to the existing cemetery boundary fence.
    e) The method of delineating the boundary between the proposed staff car park and adjacent college annexe building extending to Fairfield Road.
  3. Before any work starts on site, a Drainage Impact Assessment, including additional details of the surface water run off from the development site to the receiving culverted water course shall be submitted to and approved in writing by the Council. The details shall demonstrate that the post development run off is attenuated within the site boundary to the pre-development run off rate and in a manner that ensures that the development does not increase the risk of flooding in any surrounding land. The assessment will also examine overland flows within the site and measures to safeguard adjacent property.
  4. All mechanical plant and equipment, including equipment installed for heating, ventilation and air conditioning shall not exceed noise rating curve 25 at any noise sensitive property, as prescribed in the Noise Assessment from Charlie Fleming Associates which accompanied the planning application.
  5. Before any work starts on site, amended elevational details of the facilities management building, incorporating a hipped roof on its northern elevation, shall have been submitted to and approved in writing by the Council. The development shall thereafter proceed in accordance with the approved amended elevations.
  6. The existing lodge house at the Parkhead Road entrance to the site shall be used only in association with the healthcare facilities approved as part of this development.
  7. Construction work, and associated use of vehicles, machinery and equipment shall only take place between the hours of 0800-1800 hours Monday to Friday, 0800-1300 hours on Saturday and at no time on Sundays or Scottish Bank Holidays.
  8. Before any work starts on site, a remediation statement shall be submitted to and approved in writing by the Council. The statement shall, as a minimum, include the following elements:-
    a) A remediation scheme to ensure the site is fit for the proposed use.
    b) A methodology and timescales for the approved remediation works.
    c) Measures to deal with unexpected or unidentified contamination.
    d) Remediation targets such as capping depths and locations.
    e) Measures to deal with contamination within and off site during the construction phase, including the movement of contaminated materials.
    f) Details of a validation scheme and post remedial model. The details shall thereafter be implemented in accordance with the approved statement.

REASONS

  1. In the interests of road and pedestrian safety, to ensure that the existing road infrastructure can accommodate increased traffic and ensure also the safe use of the mixed leisure route associated with the hospital development.
