ConsideringthesubstantialsupportprovidedbyHaitiansoverseastothenationaleconomythroughthesteadystreamsofaidthattheyfurnishtotheirrelativeslivinginHaiti,throughtheirparticipationandinvolvementincarryingoutundertakingsofahumanitarianandsocialnatureinthemostdisadvantagedregionsofthecountry;
Consideringtheirimportantcontributiontotheenrichmentofthenationalculturalheritageasmuchthroughtheexerciseoftheirtalentsasthroughtheirliteraryandartisticcreations,therebyenhancingandaddingvaluetotheprestigeandinfluenceofthenationthroughouttheworld;
ConsideringthatitisduetothepressureofspecialcircumstancesofhistorythatagreatnumberofHaitiansnowlivingoutsidethecountryhaveoverthecourseofthe1960s,'70sand'80shadtofleethecountryandadopt,despitetheirattachmenttothecountryandtothenation,aforeignnationality,andthattheyfindthemselves,upontheirreturn,subjectedwithoutanyconsideration,totherequirementofobtainingaResidencePermitasisrequiredofanyforeigner;
ConsideringthatbyreasonoftheirstatusaspersonsofHaitianorigin,theymaybe,byspecialprivilege,exemptedfromhavingtoundergocertainformalitiesandnolongersubjectedtocertainconstraints,suchastheobligationimposeduponthembyArticle30oftheDecreeofDecember26,1978onImmigrationandEmmigration;
UpontheproposaloftheMinisterofHaitiansLivingabroad,afterdeliberationoftheCouncilofMinisters,
TheExecutiveBranch
hasproposed
andtheLegislativeBodyhasvotedtoadoptthefollowinglaw:
Article1.-AnypersonofHaitianorigininpossessionofanothernationalityandhis/herdescendantsare:
a)ExemptedfromhavingtoobtainaHaitianvisatoenterorleaveHaiti
b)ExemptedfromundergoingtheformalitiesofaResidencePermit,andthepaymentofrelatedtaxes;
c)ExemptedfromundergoingtheformalitiesofaWorkPermit,anemploymentpermitandthepaymentofrelatedtaxes;
d)ExemptedfromundergoingtheformalitiesassociatedwiththeForeigners'licenseandthepaymentofrelatedtaxes;
e)Eligibleforboththecivilserviceandtheemploymentmarket,exceptwhereexpresslyforbiddenbytheConstitution;
f)ExemptedfromhavingtoobtaintheauthorizationoftheMinistryofJusticetoacquireanyrealproperty;
g)Authorizedtoacquireinurbanareasanyrealpropertyhavingasurfaceareanotexceeding3.87hectares,ortheequivalentofthree(3)carreauxofland;
h)EmpoweredtoenjoyinfullthesamerightsofsuccessionasallHaitians;
i)Authorized,intheeventofsalebyliveauction,todeclarethemselvespotentialpurchasersofitemsofrealpropertytobeacquireduponpaymentoftheamountowedandbidsmaybemadeontheirbehalf.
