CALL TO ORDER

Mayor Donald B. Lockhart called the Regular Meeting of the Marengo City Council to order at 7:00 P.M.

PLEDGE OF ALLEGIANCE

Mayor Lockhart asked Army Veteran Gene Boxleitner to lead everyone in the Pledge of Allegiance.

ROLL CALL

Present are Mayor Donald Lockhart; Aldermen: Carole Bartman, Matt Keenum, Michael Smith, Nicole DeBoer, Dennis Hammortree, Gretchen Samuelson, Todd Hall and Steve Mortensen. Also present are City Administrator Gary Boden, Assistant City Administrator Joshua Blakemore, Chief of Police Joseph Hallman, Public Works Director Jayson Shull, City Engineer David Johanson, Finance Director Jennifer Snelton, and City Attorney Carlos Arevalo.

PUBLIC PARTICIPATION

None

APPROVAL OF MINUTES

Alderman Nicole DeBoer made a motion, seconded by Alderman Todd Hall, to approve the minutes of the July 8, 2013 Regular Meeting. The motion passed with an aye vote by Aldermen: Keenum, Mortensen, DeBoer, Hall, Bartman, Smith, Hammortree and Samuelson.

CONSENT AGENDA

a.  List of Bills

b.  Authorization to Execute Lease Renewal for 180 8th Avenue

c.  Consent to appoint Dawn Wagner to the Police Pension Board

Alderman Nicole DeBoer made a motion, seconded by Alderman Steve Mortensen, to approve the consent agenda items as listed. The motion passed with an aye vote by Aldermen: Bartman, Smith, Keenum, Mortensen, DeBoer, Samuelson, Hall and Hammortree.

NEW BUSINESS

a.  Public Hearing – FY 2013/2014 Appropriations Ordinance and Certification of Estimated Revenues

ROLL CALL

Present are Mayor Donald Lockhart; Aldermen: Todd Hall, Nicole DeBoer, Michael Smith, Matt Keenum, Steve Mortensen, Gretchen Samuelson, Dennis Hammortree and Carole Bartman.

MOTION TO OPEN THE PUBLIC HEARING

Alderman Nicole DeBoer made a motion, seconded by Alderman Carole Bartman, to open the Public Hearing on the FY 2013/2014 Appropriations Ordinance and Certification of Estimated Revenues. The motion passed with a voice vote.

Finance Director Snelten verified that publication of this public hearing was made in the Northwest Herald.

COMMENTS FROM PUBLIC

None.

MOTION TO CLOSE THE PUBLIC HEARING

Alderman Nicole DeBoer made a motion, seconded by Alderman Todd Hall, to close the Public Hearing. The motion passed with a voice vote.

Finance Director Jennifer Snelten then answered questions from the Council on the information presented.

Alderman Carole Bartman made a motion, seconded by Alderman Todd Hall, to approve the Appropriations Ordinance. The motion passed with an aye vote by Aldermen: Samuelson, Hall, Keenum, Mortensen, Bartman, DeBoer and Smith. Alderman Dennis Hammortree voted no.

b.  Public Hearing – An Ordinance Authorizing Execution of an Annexation Agreement Concerning 143 acres located on Harmony Road, East and West of State Rt 23.

ROLL CALL

Present this evening are Mayor Donald Lockhart; Aldermen Todd Hall, Nicole DeBoer, Michael Smith, Matt Keenum, Steve Mortensen, Gretchen Samuelson, Dennis Hammortree and Carole Bartman.

MOTION TO OPEN THE PUBLIC HEARING

Alderman Gretchen Samuelson made a motion, seconded by Nicole DeBoer, to open the public hearing on an Ordinance Authorizing Execution of an Annexation Agreement concerning 143 acres located on Harmony Road, East and West of State Rt 23. The motion passed with a voice vote.

Attorney Arevalo advised that publication of this Public Hearing was in the Northwest Herald on July 4th, 2013.

PUBLIC COMMENTS

Dave Diamond, 602 Bauman Street, Marengo, spoke on the annexation and questioned if this will bring prosperity to the City of Marengo. Reminded the City that talks between the various entities that might be approached for funding should be done as soon as possible.

Paulette Schardon, 22517 Grange Road, Marengo, questioned the stopping of semi trucks from exiting on Route 20, and why they would chose to pay another toll to get off on Route 23. Where is the industry and business to come from?

MOTION TO CLOSE THE PUBLIC HEARING

Alderman Nicole DeBoer made a motion, seconded by Alderman Steve Mortensen, to close the Public Hearing. The motion passed with a voice vote.

Alderman Nicole DeBoer made a motion, seconded by Alderman Todd Hall, to authorize to execute an annexation agreement concerning 143 acres located on Harmony Road, East and West of State Route 23. The motion passed with an aye vote by Aldermen: Hall, DeBoer, Mortensen, Smith, Keenum, Samuelson, Bartman, and Mayor Lockhart. Alderman Dennis Hammortree voted no.

c.  An Ordinance Annexing 143 acres of Territory located on Harmony Road, East and West of State Rt 23 to the City of Marengo

Attorney Arevalo submitted certification of mailings that were done to the Riley Township persons on this annexation and the notice of the meeting.

Alderman Gretchen Samuelson made a motion, seconded by Alderman Todd Hall, for an ordinance annexing 143 acres of territory located on Harmony Road, East and West of State Route 23, to the City of Marengo. The motion passed with an aye vote by Aldermen: Mortensen, Samuelson, Bartman, DeBoer, Keenum, Hall and Smith. Alderman Dennis Hammortree voted no.

d.  Authorization to Accept Bid for the Van Buren Storm Water management Project

Alderman Gretchen Samuelson made a motion, seconded by Alderman Nicole DeBoer, for authorization to accept the bid from Landmark Contractors to conduct the drainage enhancements on Van Buren and East Streets for $27,810.95. The motion passed with an aye vote by Aldermen: DeBoer, Mortensen, Keenum, Smith, Bartman, Samuelson and Hall. Alderman Dennis Hammortree voted no.

e.  Authorization to Execute Intergovernmental Agreement with Marengo & Riley Townships for Pace Services

Alderman Gretchen Samuelson made a motion, seconded by Alderman Carole Bartman, for authorization to execute an intergovernmental agreement with Marengo and Riley Townships for Pace Services. The motion passed with an aye vote by Aldermen: Bartman, Hall, Hammortree, Mortensen and Samuelson. Aldermen Nicole DeBoer, Michael Smith, and Matt Keenum voted no.

MAYOR’S STATEMENTS AND REPORTS

Mayor Lockhart had nothing to report this evening.

DEPARTMENT HEAD AND STAFF REPORTS

Asst. City Administrator Joshua Blakemore reported that the budget process is moving forward.

Public Works Director Jayson Shull passed out information on a loader that they are looking at, and reported that they had negotiated a price (which will include delivery to Marengo) of $32,000 that was previously approved by the Council. He will be meeting with the McHenry County Historical Commission this week with respect to the dairy barn on the public works property – pertaining to age of the building, and any other information they may have.

Finance Director Jennifer Snelton had nothing further to add.

Chief of Police Joseph Hallman had nothing further to add.

City Engineer David Johanson spoke about the Prospect Street project. The bid will be awarded this week. IDOT has been the problem with getting the project underway. A request was made by Ed Coggin (with HR Green) on the Wastewater Treatment bids to extend the deadline by 2 weeks. Mr. Coggin explained the different parts of the application for funding and permits that are required, and explained that there are adequate funds available. The hope is to start the project in November.

City Administrator Gary Boden had nothing further to add.

City Attorney Carlos Arevalo had no report.

EXECUTIVE SESSION

b.  Personnel

Alderman Gretchen Samuelson made a motion, seconded by Alderman Nicole DeBoer to go to Executive Session for the purpose of Land Acquisition and Personnel. The motion passed with an aye vote by Aldermen: Smith, Bartman, Hall, Keenum, Mortensen, DeBoer, Samuelson and Hammortree. The meeting recessed at 8:20 P.M.

The City Council returned from Executive Session, and the Regular Meeting reconvened at 9:01 P.M.

ADJOURNMENT

Alderman Carole Bartman made a motion, seconded by Alderman Steve Mortensen, to adjourn the meeting. The motion passed with a voice vote. The meeting adjourned at 9:02 P.M.
