HEPA VACUUM RENTAL AGREEMENT

The City of Lewiston and the City of Auburn, in partnership with Atrix International, offers a HEPA vacuum loan program. HEPA vacuums are provided to assist homeowners, tenants, and rental property owners in safely removing lead-based dust and chips from their properties. Please read the following terms and conditions, and sign the agreement.

1. In consideration of the free use of the HEPA vacuum, I waive my claim for damages of any kind and

nature against the City of Lewiston or the City of Auburn, and Atrix International in the event that a dependent of mine, or myself, is injured or sustains any property damage arising from the use of the HEPA vacuum.

2. I agree to pay a $50.00 deposit prior to rental of the HEPA vacuum. I understand that the use of

the HEPA vacuum is free but there is a required filter and an administration fee. The initial filter fee is $35.00 and any additional filters can be purchased for $35.00.

3. I understand there is a 48-hour free rental use time period. I am aware that if I return the HEPA vacuum

after the free rental period, I will be responsible for a minimum late fee of $5.00 for each day past due.

4. I understand the HEPA vacuum is to be used for interior residential use only and is not intended for

exterior or commercial use. I am aware that the HEPA vacuum is to be used for collecting fine lead dust

particles or small paint chips within the home and is not for construction debris or leaves.

5. I agree not to open or empty the HEPA filter at any time. Opening the HEPA filter will expose my

family and myself to toxic lead-based paint dust.

6. I agree to remove the HEPA filter and dispose of it before returning the HEPA vacuum to the lead

center. I will also be responsible for making sure the vacuum is clean before returning it to the lead

center. I am aware that the City will not accept the return of the vacuum until I discard the filter at my home. Should I need additional time to take back the unit and dispose of the filter which exceeds the 48 hours, I understand I will be responsible to pay the late fee noted in #3 above.

7. I understand should the HEPA vacuum or included accessories fail due to normal usage, I will not be

held responsible for the cost of replacement. I understand that if the HEPA vacuum or accessories are

missing or broken due to misuse or neglect, I will be responsible for the replacement cost and it will

result in forfeiture of my deposit.
