Recommendation:Approval
Request:Amend Section 2.7.15D.5 of the Land Use and Development Regulations (LUDRs) to extend the sunset date for parking standards in the South Cape Downtown (SC) District from August 20, 2017 to August 20, 2025.
Background
In 2012 the City adopted a new zoning district and rezoned much of the land in the Community Redevelopment Area (CRA) to the SC District. The SC District includes properties previously zoned as the Downtown Core, Edge, and Gateway Districts. Like all other zoning districts, on-site parking for the Downtown Core, Edge, and Gateway Districts were regulated by LUDR, Section 5.1.
A key change to the SC District regulationsis parking. The SC considers lot frontage and area when determining the minimum number of parking spaces for a site for a particular use. These standards were developed in recognition of the preponderance of sites with small areas in the CRA. This constraint makes providing parking challenging to many business owners. With this factor in mind, the SC parking standards were intentionally developed to lessen the parking requirements for most uses on small sites. This provision of code was adopted with a sunset date of August 20, 2017.
Options
The current sunset date of August 20, 2017 in LUDR, Section 2.7.15D5 can be extended or allowed to expire.
Option #1
The date for which the number of parking spaces required for nonresidential uses by Table SC-5 could be extended from August 20, 2017 to August 20, 2025.
Option #2
The date for which the number of parking spaces required for nonresidential uses by Table SC-5 can be allowed to expire. If this option is selected, parking standards for the SC would be determined by LUDR, Section 5.1. While this action would not create any nonconformities with previously approved parking, the new standards would generally require more parking for most sites.
Recommendation
Staff recommends Table SC-5 continue to be utilized for determining parking required for sites in the SC District, and therefore, recommends the sunset datebe extended from August 20, 2017 to August 20, 2025. Staff is not aware of any parking shortages or problems that have resulted in the CRA since 2012 from administering parking requirements with Table SC-5. However, an extended sunset date of 2025 is recommended in case development in this part of the City changes appreciably in the future warranting a more stringent standard.
