Fraternal Order of Eagles

To all Aeries & Auxiliaries,
Many Aeries in MN with gaming licenses are unaware of the Grand Aeries change in the charity dept. For years we have made donationsdirectly to the individual charities since they were all 501 (c) 3. Now, they fall under the umbrella of the "Fraternal Order of Eagles Foundation, Inc"' which is a 501 (c) 3.
How this came to light to me was the 6th District made a donation to the Jimmy Durante’s Children Fund and through a compliance review by the MN Gambling Control Board, and was denied as a legal donation because the JD Children's Fund in NO LONGER A 501 (c) 3. What they had to do was get a refund and resubmit the donation to: The FOE Eagles Foundation, Inc, for the JD Children's Fund. See the attachment below.

The Grand Aerie only has three (3) valid 501 (c) 3 charities that donations can made out to, per MN State Gambling Laws. There are attachments of the IRS determination letters.
This information needs to get out to ALL AERIES with gaming licenses to prevent many potential headaches for them when it would get caught during a compliance review. I think that Kyle Bemiller's letter of explanation, as to the three 501 (c) 3 Grand Aerie Charity's, and what’s gets donated to each of them, is well written and explains it all.
I am requesting that you forward this information to all Aeries you have email address for and print and sent it to those that don't.

The Memorial Fund

This part of the charity provides benefits to the children of members who lost their life in the performance of their job and provides educational scholarships

H.O.M.E. Fund

This Fund is for all contributions which are earmarked for a specific project that DOES NOT MEET THE CRITERIA of the Charity Foundation Funds, but for which the local or state Aerie would like to be recognized and acknowledged. The contribution is submitted with a Grant form completed and the donation is turned around immediately.
