The terms and conditions for this secondment will be those as detailed in your substantive contract of employment. Any variations are as detailed in this agreement.
Restructuring Provision
If during the secondment the substantive position of the secondee at the home organisation is disestablished, or is under review, they will be fully consulted with by the host organisation and covered by the terms and conditions of their contract of employment.
Performance Appraisal
Normal appraisal arrangements will apply during the period of secondment. Appraisal of performance will be undertaken by XXXX in consultation with Northumberland Tyne and Wear NHS FoundationTrust.
Performance Management
Any concerns about the work performance (capability or conduct) of the secondee during the secondment will be discussed with your line manager at XXXXand any action will be agreed with that person.
Misconduct
The host organisation will notify NTW of any difficulty of a disciplinary or other nature arising in respect of a seconded employee during their secondment, and NTW shall be entitled to deal with such difficulties in accordance with its disciplinary and grievance procedures.
Sickness Absence
The reporting of sickness absence during the secondment should be reported in line with both XXXXand NTWsystems.
Annual Leave
You will retain your current entitlement to annual leave and public holidays subject to local arrangements. The host organisation manager will be responsible for managing any annual leave taken and for informing NTW of any leave that has been taken.
Travel and Allowances
Where the duties of the secondee require travel, travel related expenses shall be covered on a no loss/ no gain basis for the secondee in a manner consistent within the secondee’s terms and conditions and consistent with the host organisation’s policy. The expenses should be paid by NTW and reimbursed via invoice byXXXX
Training and Development
The secondee and their host manager will address any training needs in relation to the seconded position. XXXXagrees to pay for any training that the secondeeundertakes in relation to their seconded position.
ApplyingforPositions
NTWrecognisesthat the secondeeisentitledtoapplyforadvertisedpositionsineitherorganisationorexternallyduringthesecondmentperiod.
Iftheychoosetoapplyforanypositionsinthehostorganisationduringtheperiodofsecondment thentheywoulddoso as anNTWemployee.
The secondeewillinformbothparties oftheirresignationinwritingiftheyareasuccessfulapplicantforapositionoutsidebothorganisations.
CodesofConduct,Policies,ProceduresandPractices
Duringthetermofthesecondmentthe secondeewillabidebytherequirementssetoutintheCodesofConduct,Policies,Procedures andPracticesofbothNTWandthehostorganisation. Ifthereare perceiveddifferencesininterpretationofthe CodesandPoliciesofthetwoorganisations,theyshouldberaisedanddiscussedbyallpartiestotheagreement.

Anyactualorpotentialconflictofinterestwillbebroughttothehostorganisationsattentionfordiscussion,whichmayalsoinvolveNTWifrequired.
Confidentiality
The secondeewillnotdiscussordisclose anyinformation,processes,materials,documents,costsorprivileged informationrelatedtoanyaspectofthebusinessofNTWorthehostorganisationwithout theexpressagreementoftherelevantorganisation.
The onlyexceptioniswherethatdiscussionordisclosureofinformationislegitimatelyrequiredaspartoftheirperformance,dutiesand responsibilitiesinrelationtoherworkforbothorganisations.
CopyrightandIntellectualProperty
Unlessotherwiseagreedinwriting,allworkproducedbythe secondeeinthecourseoftheirsecondmentdutiesandcopyrightofthat workshallbelongtothehostorganisationandwillcontinuetodosoaftertheterminationofthissecondment.
SecondeeResponsibilities
The secondee willberesponsiblefor:
•Completingallworkobjectivesandlearningdevelopmentgoals.
•Takingappropriatesteps to ensuretheirownsafetyandtoavoidharmto others,includingbringinganyhealthandsafetyissuesintheworkplaceto thehostorganisation'sattention.
•KeepingintouchwithNTWonaregularbasis
•Identifyingchangedexpectationswith host and home before returningtoNTW.
NHCFTResponsibilities
Thehostorganisationwillberesponsiblefor:
•Thegeneralinductionof the secondeeintotheorganisation'sbusinessandprovidinghimwith theresourcesheneedstoperform thetasksrequired.
•Agreeingwiththe secondee clearperformanceexpectationsandprocessesforperformancefeedbacktothem and host and home leads forrecordingandassessingtheirdevelopmentinlinewiththehomeorganisationAppraisalPolicy.
•ProvidingregularbriefingsforNTWonthe secondee’sperformanceandprogressduringthesecondment.
•Identifyinglearningopportunitiestodevelopindividuallearninggoals.
•WorkingwithNTWtoprovideasupportiveenvironmentforthem.
•Discussinganyconcernsordifficultiesrelatedtothesecondmentwiththe secondee andNTWassoon astheyarise,inthefirstinstancewith the secondeeandthehomemanager.
•ProvidingandmaintainingasafeworkingenvironmentthatmeetstherequirementsoftheHealthandSafetyinEmploymentAct1992.
NTWResponsibilities
NTWwillberesponsiblefor:
•Keepingthe secondeebriefedonworkrelatedactivitiesandeventsoccurringatNTWduringtheirsecondment(e.g.byextendinginvitationstomeetings,providinginformationoninternalpolicies,businessplanningprocessesandsocialevents).
•Maintainingcontactwiththe host managerandsecondee byparticipatinginreview meetings.
•Nominatingamanagertoliaisewith the secondeeduringthetermoftheir employment.
•Ensuringanappraisaliscarriedoutannuallyduringtheperiodofthesecondment
Notice
A minimum period of notice in writing of 28 days will be given and is required in the event of early termination of secondment by either party.
Health and Safety
The host organisation,XXXXwill be responsible for ensuring any Liability Insurance and have a duty of care under the relevant Health and Safety Legislation of the secondee. If a secondee is carrying out duties within a location agreed by the host employer with a responsibility for that location, the Employers Liability insurance covers employers’ liability.
General Obligations
Information of a personal or confidential nature concerning the host organisationshould not be divulged to anyone without the proper authority first having been given. If you are in any doubt whatsoever as to the authority of a person or body asking for information you must seek advice from the identified manager. Failure to observe these obligations will be regarded by your employer as serious misconduct that could result in disciplinary action being taken against you including dismissal. You may also be liable to prosecution for an offence under the data protection legislation or an action for civil damages.
