The export of items, commercial software, and encryption code is subject to export control regulations. The Department of Commerce’s Export Administration Regulations (EAR) makes an exception to licensing requirements for the export or re-export of certain consumer equipment and software such as computers, smartphones, monitors, flash-drives, and similar devices as long as the criteria to which you are certifying below are met. The exception does not apply to any technology, nor does it apply to high performance computing equipment or any EAR-satellite or space-related equipment, components, or software, or to any technology associated with high-level encryption products. In addition, this exception does not apply to items, technology, data or software regulated by the Department of State’s International Traffic in Arms Regulations.

Generally available to the public by being commercially sold without restriction at retail and designed for installation by the user without further substantial support by the supplier.

2. I will not provide the equipment or software to officials of the Cuban Government or the Cuban Communist Party, or to the Government of Sudan;

3. I will not take any item or software incorporating UA-developed, non-commercial strong encryption source code outside the borders of the United States unless I have received approval from UA’s Export Control Program in writing.
