Note: All potential vendors will be juried by the Fall Fantasy Faire Committee. No "Independent Consultants". We prefer non-commercial, handmade, artisan products that fit the theme of the event. Space is limited. After we receive this application/contract you will be contacted with an acceptance or denial asap.
GENERAL TERMS AND CONDITIONS
1.) Exhibitor agrees to abide by all applicable laws, ordinances and regulations pertaining to health, fire prevention and public safety.
2.) Exhibitor agrees that all items sold must be listed and described on the attached vendor application.Crescent Moon Gifts/Fall Fantasy Faire reserves the right to deny sale of any items not listed on your application. Exhibitor is solely responsible for the collection and payment of any/all applicable sales tax.
3.) Exhibitor agrees to set up designated booth before 9:00am on Saturday September 17, 2017 and be open for business by 10am. The Vendor must remain open until 6pm on Saturday unless otherwise approved. Vendors will be permitted to start setting up at 8:00am Saturday and must be broken down and offsite by 7:30pm
4.) Exhibitor shall keep the booth area in a clean and sanitary condition at all times. Vendor shall be responsible for removing any and all trash from their booth and surrounding area, and disposing it in the
designated recycling or trash container provided on site.
5.) Exhibitor agrees to stock sufficient inventory, supplies or commodities to fill their table. Exhibitor understands that there is in no way a guarantee of sales during the event.
6.) Exhibitor is responsible for providing the entire contents, decorations, costumes and fixtures needed to complete their booth. Vendor is required to decorate their booth in accordance to the theme of the event; nothing can be affixed, stapled, taped, nailed or hung from the walls. All exhibitors and staff must be appropriately dressed/costumed for the duration of the event.
7.) Exhibitors with children- all parents shall supervise or provide adult supervision for their children. Parents shall be responsible for any damages to persons/property caused by lack of supervision. Exhibitors found having unattended children will be asked to leave the festival and will not be invited back. If you cannot comply with this rule, please do not apply for space.
8.) Exhibitor agrees to indemnify and hold harmless Crescent Moon Gifts/ Fall Fantasy Faire, its presenters, agents and employees from any and all claims, causes of action suits, damages, theft, injuries and losses to any person or goods arising out of or in any way connected with the renting of space in the festival. Exhibitor agrees that this is intended to be a full and final compromise and release of any claims, demands, causes, actions and causes of actions known or unknown.
9.) Crescent Moon Gifts/ Fall Fantasy Faire will not be liable for refunds or any other liabilities whatsoever for the disruption of the festival due to reason of enclosure in which the festival is to be produced, being before or during the festival, destroyed by fire or other calamity, or by any Act of God (including but not limited to weather), public enemy, strikes, statutes, or any other cause. Crescent Moon Gifts has the option to cancel the festival by September 1, 2017 and will return 100% of booth fees to exhibitors if canceled.
10.) Exhibitor agrees to maintain the dignity and integrity of Spring Fairy Festival and will not perform any acts of a harmful nature. Crescent Moon Giftsreserves the sole right to ask any exhibitor or its employees to leave the festival that they feel are not acting in the best interest of the festival.
11.) Exhibitor understands that upon confirmation and payment, vending booth fees are non-refundable.
12.) Sales or Distribution of the following items will be strictly prohibited: Illegal Substances such as drugs or drug paraphernalia, Animals / pets, Guns, or other mechanical weaponry - No WEAPONS may be sold whatsoever.
13.) This agreement constitutes the entire contract between Crescent Moon Gifts/ Fall Fantasy Faire and the exhibitor. No changes shall be valid unless agreed to by both parties in writing.
