SUBJECT: Establishing aBlanket Purchase Agreement (BPA)

1. The Government of the United States is considering establishing a pre-priced BPA(s) for the supplies or services described below:

2. Understanding a BPA: A BPA is not a contract, but a simplified method of satisfying anticipated repetitive requirements for supplies or services by establishing "charge accounts" with qualified vendors. BPAs are designed to reduce the administrative costs associated with small purchases by eliminating the need to issue individual purchase documents. The Government and the vendor agree in advance to all of the terms and conditions applicable to individual purchases made under a BPA. The Government is only obligated to the extent of authorized purchases actually made under the BPA and there is no minimum monetary amount the Government is obligated to purchase.

3. BPA Pricing: A BPA may be pre-priced or prices for covered supplies or services may be negotiated between the Government and the vendor at the time orders are placed. For pre-priced BPAs, the vendor submits a signed itemized price list for the covered supplies or services to the Contracting Officer (CO) for approval. The period during which prices are effective (such as January 1, 2004 through December 31, 2004) must be stated on the face/cover of the price list. The CO reviews the price list to determine which supplies or services qualify to be included in the BPA and if prices for qualifying items are fair and reasonable. The CO may approve none, some or all of the items in the price list. At any time during the life of the BPA, the vendor may submit revised prices subject to the approval of the CO.

4. Period of Agreement: The BPA may be written for a period of up to 5 years.

6. If after reviewing this letter and the attached documents you are interested in entering into a BPA for the supplies or services described therein, please submit a price list as described in paragraph 1(ii) of the attached Terms and Conditions not later than ____5 January 2005____

Submitting a price list may not result in a BPA being issued at all. In addition the CO may issue BPAs to more than one vendor for the same supplies or services.
