This Agreement will form part of the Agreement arrangements between Swanwick Lodge and the Placing Authority which will apply in its entirety. It details the Care and Services provided to ______(Name of young person) and where possible must be completed prior to admission, once approval for a placement has been agreed. When the admission is urgent, it should be completed as soon as possible, or in any event within 2 working days. It must be agreed and signed by both parties and appended to the child/young person’s Care Plan & LAC Forms or other authorised documents.

1.Commencement Date and Contract Period:

This contract shall commence on ______20__ and authorisation for this placement has been given initially by Court Order until: ______and shall continue until:

  • the end date of the current Secure Order(this date will be taken as formal notice of termination of this contract) or
  • until a contract variation/extension has been agreed in writing by authorised representatives of each party or
  • when the Service Purchaser notifies the Service Provider in writing that the placement is to cease.

  1. Extra Staff in Unit
/ £25.00 per hour (to include night rate) / If the situation arises when the young person requires 1:1 or 2:1 levels of care, (to include managing any high risk mental health episodes) or if the young person leaves the premises to go to hospital/appointments which may include 3:1. These costs will be agreed with the Local Authority in writing before being implemented, unless in an emergency situation resulting in immediate need of staffing.

/ Approx. £500 per return journey to local hospital / If a private ambulance is required on more than 2 occasions during any one month period.

/ Price to be agreed in consultation with Swanwick Lodge / Any mobility or transition plan will be planned between the Local Authority and the Team Manager responsible for the young person. Any costings for this will be devised on an individual basis and agreed by both party’s.
*Note additional services must be agreed with the placing authority before they are added.

3.Payment Procedure:

3.2Invoices will be raised monthly in arrears for ongoing placements or services, or immediately on completion of time limited work or placement cessation.

5. Obligations:

5.1Swanwick Lodge Secure Children’s Home shall be registered or approved by or under the provisions of one of more of the following Acts of Parliament and any subsequent amendments:-

the Registered Homes Act 1984

the Children Act 1989 & 2004

the Education Act 1996

the Care Standards Act 2000 and Children’s Homes Regulations 2015

the Secretary of State, where it is required.

5.2Swanwick Lodge shall provide the appropriate level of care and support for each young person, treating each individual with respect, dignity, recognising their individual cultural, social and religious needs.

6.Care Plan:

6.1The Placement Authority’s Social Worker shall draw up a Care Plan for the young person within 5 working days of the young person’s admission. The care provided will be in accordance with the young person’s care plan. The Care Plan will identify the purpose and objectives of the placement.

6.2The placement authority will ensure that all reviews that are required through regulations are undertaken in Swanwick Lodge and we will provide appropriate facilities for these meetings.

7.Policies and Procedures

7.1All the home’s staff (including agents and part time), volunteers and regular visitors with substantial access to young people in the home are subject to full safeguarding procedures, including an enhanced DBS check. All other visitors to the home will be adequately supervised.

7.2Swanwick Lodge will have procedures in place which can ensure that the Placement Authority will be notified immediately of any events defined under the Children’s Homes Regulations 2015 as “significant” or if abuse occurs or is suspected in relation to any young person resident in the Home. This includes any allegations of unprofessional conduct.

7.3 Swanwick Lodge must inform the Placement Authority if they or Ofsted gives notice of intent to cancel registration.

8.Signatures:

The Placing Authority and Swanwick Lodge agree to the placement in Swanwick Lodge of the named child/young person in accordance with the details set out on in this document.

A stabilisation Model is used at Swanwick Lodge which is a ‘whole team’ relationship-based approach to supporting a young person to achieve improved emotional stability and behavioural control through the provision of a safe environment in which to explore, understand and develop improved resilience. CARE

We work on a ratio of 1 staff member to 2 young people. If we have to provide a 1:1 ratio to ensure the young person’s safety, and that of other young persons we would advise you of the appropriate rate per circumstance

Hobbies not currently provided can be bought in at an additional cost

Interpreter/Advisor to meet young person’s needs (arrangements and costs need to be agreed in advance with Swanwick Lodge)

Transport and staffing costs for visits outside of Hampshire.

Escort for Court Visits.

Damage to Swanwick Lodge property over the value of £200 in total during the period of the young person’s stay is not included.

PART A – Placement Plan
Placement Contract – Swanwick Lodge

Placement standards applicable to all young people placed on welfare/permissive orders

Spot Purchase Placements and those from within Hampshire Children’s Services – termination of placement will occur in response to persistent non-compliance with the contract terms.

Block Purchase Placements – default on any standard within the placement contract to be brought to the attention of the purchasing authority’s authorising officer.

Referral Information – placement within Swanwick Lodge will not be accepted unless the referral form is fully completed. On accepting a placement within Swanwick Lodge the placing Area/Authority will ensure that:

Documentation:

The following documentation will be provided to Swanwick Lodge prior to the young person’s admission:

  • Signed copy of the Contract
  • Court Order/ 72 hour Director’s Approval
  • Latest Care Plan

The following information will be provided to Swanwick Lodge within 48 hours of admission:

  • Authorised contacts –Please provide the name, relationship, address and phone number of any authorised contacts for the young person.

The following information will be provided to Swanwick Lodge within 5 working days of admission:

  • Clear details of the objective of the placement. Please also note that a firm transition plan (with an appropriate and suitable placement) must have been found at least 14 days prior to the young person leaving Swanwick Lodge. Community mobility for the young person will not be supported by Swanwick Lodge until a full transition plan back to the community has been identified. Swanwick Lodge will then work with the transition plan to ensure community mobility supports integration into the community and progression to the next placement.
  • The postal address of the young person’s parent/guardian if a parent’s pack is required to sent to them.
  • A signed copy of the Parent/Carers Consent Form (for activities/medical treatment).
  • Authorised family visitors - Please confirm the name, relationship, contact details and date of birth for any authorised visitors.

All other appropriate Looked After Children information is completed and available to Swanwick Lodge within three working days of the placement commencing. The placing Area/Authority will also ensure that Looked After Children reviews are completed within the statutory time scales.

Meetings:

  • All Planning Meetings and Reviews will be held between the following designated times: 10.00 – 12.00 am or 3.00 – 5.00 pm.
  • Wherever possible a note-taker can be provided for these meetings during the following times – Mon-Wed 10-5, Thurs 10-4 and Fri 10-3. Outside of these times and when this is not possible, you will be notified so that you are able to arrange your own note-taker.
  • The Case Holder will attend a Placement Planning Meeting within three working days of the placement commencing. It will be the Case Holders responsibility to ensure attendance by any other appropriate persons at the meeting.
  • The Independent Regulation 15 Review of the placement within Secure Accommodation takes place within twenty eight days of admission and at intervals of no more than three months thereafter. The date of this meeting will be established at the Placement Planning Meeting.
  • The Case Holder will attend a pre-discharge meeting ten days prior to cessation of placement to ensure continuing care plans and arrangements are in place.
  • A four week post Secure Accommodation Review will also be arranged at a pre-discharge meeting to be chaired by the Secure Accommodation Reviewing Officer to monitor the use of appropriateness of post Secure Placements.

Visits:

  • A young person placed at Swanwick Lodge is visited weekly by the Case Holder or another identified person on behalf of the Area/Authority.
  • All visitors to the young person are agreed through the Placement Planning Meeting process and introduced to the unit by the Case Holders letter of introduction.

Additional:

  • The placing Area/Authority will accept all additional costs necessary to sustain the placement as detailed within the Care Service Costs information provided at the time of referral.

Swanwick Lodge will:

  • Ensure that the Case Holder is kept fully aware of a young person’s progress at Swanwick Lodge through monthly reports being provided to the Case Holder. Notification of any incident, restraint, self-harm, medical emergency, hospital admission or significant change will be notified to the Case Holder within 48 hours of the occurrence. Swanwick Lodge encourages the Case Holder to contact the home if any further update is required.
  • Further information such as the current risk assessment, chronology, behaviour management plan and health care plan are available on request, if required by the local authority.
  • Ensure that a young person has access to all services available within Swanwick Lodge, appropriate to his/her needs.
  • Provide the placing Area/Authority with a monthly summative report on the young person which accurately reflects all work undertaken within the period of the placements.

Placement at Swanwick Lodge may be terminated by means of a notice period of five working days in the placing Area/Authority where there is a persistent failure to comply with the agreed placement terms. In this case ‘persistent’ is defined as failure to provide information or contact, which Swanwick Lodge regard as essential to the Placement Plan.

  1. Commencement and Duration

This Contract shall commence on the date referred to in paragraph 1 of the Schedule ("the Commencement Date"). This Contract shall continue for the period referred to in paragraph 1 of the Schedule ("the Contract Period"), unless a written contract variation/extension is signed by both parties or it is terminated in accordance with the terms of the Contract.

The Service to be provided and the standards which it shall meet shall be as described in the Service Specification.

  1. Fundamental Responsibilities
  2. The Service Provider shall provide the Service in accordance with the terms of this Contract.
  3. In consideration of the provision of the Service, the Service Purchaser shall pay the Price in accordance with the terms of this Contract.

4.Price and Payment

The Price for the Service shall be that set out in the Schedule. The procedure for payment of the Price shall be as referred to in the Schedule.

5.Representative of the Parties

5.1 Upon the commencement of this Contract, the Service Purchaser and Service Provider shall appoint a Representative whose name shall be recorded in the Form of Contract completed by the parties. Each party's Representative shall have full authority to act on behalf of that party in connection with the Contract and any reference to any party in the Contract shall include a reference to their Representative.

5.2Any party may change their Representative at any time provided that they give notice as soon as practicable to the other party of the name, address and telephone number of the new Representative.

  1. Confidentiality

6.1For the purposes of this Clause “Confidential Information” shall mean all information (whether commercial, financial, technical or otherwise) obtained from the other party under or in connection with the Agreement which is designated as confidential or which is by its nature clearly confidential.

6.2Both parties must ensure that:
