VILLAGE OF CARDINGTON COUNCIL MEETING

April 13, 2015

Mayor Peyton opened the meeting at 7:00 p.m. with the Pledge of Allegiance and a moment of silent meditation.

Mayor Peyton asked for a roll call: Deskins,Christian , Nippert & Wise – absent with excuse,Morris,Graham RC: 5 PRESENT1 EXCUSED ABSENCE

Mayor Peyton asked for approval and/or changes to the agenda.

Mayor Peyton asked to add Resolution 2015-09 to the agenda.

Christian moved to approve the agenda as amended. Morris seconded. RC: 5YEAS

Mayor Peyton asked for a motion to approve the minutesof the March 16, 2015Council Meeting.

COMMUNITY PARTICIPATION

Sylvia Rickett of 147 Union Street requested that the Village provide a backflow valve and basement floor sanitizing due to the recent sewer backup. Also asked that council consider each case individually rather than go with protocol that it is not the Villages responsibility.

Danny Wood responded that the problem with this house is that the sewer lines in the basement are very near to the same level of the sewer lines in the street and typically a backflow preventer would have been installed at construction.

After discussion Council recommended that she contact the Health Department for possible assistance.

Wayne Cole addressed Council about the need for him to have a solicitor’s permit to sell produce in the Village. He stated this will be his tenth year selling produce and has never been required to have a permit.

Mayor Peyton responded that the Village ordinance states that produce purchased and then brought into the Village to be resold requires a permit. Produce that is personally grown and sold does not require a permit.

FINANCE

FISCAL OFFICER’S REPORT

Deb Fry presented the most current accounts payable listing for Council to approve.

Deskins made the motion to pay the bills. Seconded by Graham. RC: 5YEAS

The Summary of Revenue report as well as the month end Cash Summary by Fund report for Marchwas presented.

Most of the onsite work by the state auditors has been completed.

PERSONNEL AND INSURANCE

POLICE AND FIRE

Police Chief Report

  • The Cardington Police Department has taken 271 calls for service. This time last year the Police Department recorded 293 calls for service.
  • Received a report of a bomb threat at the high school.
  • Assisted Marion City Police in apprehending a suspect with an outstanding warrant.
  • Executed a search warrant in the Village.
  • Solved the break-in at Family Dollar

Resolution 2015-09 – A resolution accepting the resignation of Phil Norris from the positon of part time police officer for the Village of Cardington.

Nippert made the motion to accept the resignation. Seconded by Morris. RC: 5 YEAS

Mayor’s Court Report – nothing to report

Fire Chief’s Report - nothing to report

UTILITIES

Resolution 2015-07 – A resolution accepting the recommendation of the Village Administrator to enter into an agreement with Precise Boring of Ohio, LLC for Directional Drill Services for Repair of a Waterline.

Danny Wood reported that a water leak was discovered at the river crossing off of North Fourth Street. The water line is encased in cement so a repair is not possible. Valves have been placed at each end to stop the leak. He contacted 6 directional drillers to obtain bids. Precise Boring has been on site and submitted a bid.

Resolution 2015-08 – A resolution accepting the recommendation of the Village Administrator to enter into an agreement with Krock Esser for the completion of the Whetstone Creek – Total Dissolved Solid Evaluation Testing.

BUILDINGS, EQUIPMENT & STREET

Ordinance 2015-10 – An ordinance accepting the recommendation of the Village engineer to accept the bid of Mid-Ohio Paving for the 2015 Paving Program, authorizing the Mayor and Fiscal officer to enter into a contract and declaring an emergency.

Motion by Morris. Seconded by Nippert. RC: 5 YEAS

COMMUNITY IMPROVEMENTS, ZONING AND PARKS

3rd Reading Ordinance 2015-04 – An ordinance amending sections of the codified ordinances of the Village of Cardington regarding household pets.

Motion by Morris. Seconded by Deskins. RC: 5 YEAS

Morris moved to adopt. Seconded by Graham. RC: 5 YEAS

VILLAGE ADMINISTRATOR

  • Hatches were removed off of the detention tanks-holes rusted in them that need to be addressed prior to painting. Tanks will need to be sand blasted prior to painting and the tower will only require spot grinding. Due to unforeseen additional work needing to be done, the estimated price will be more than anticipated. Deb Fry stated that the additional amount is available in the fund. Requested permission from council to proceed with the necessary paperwork prior to putting the painting job out for bids; council approved.

VILLAGE MANAGER

  • Finalizing the newsletter and annual water quality report to go out this week.
  • Rec Board requested that the Village grant them a free pool fill again this year.

Motion by Nippert to allow the pool fill. Seconded by Christian. RC: 5YEAS

MAYOR’S COMMENTS -

EXECUTIVE SESSION: Mayor Peyton requested that council go into executive session. Mayor Peyton stated the reason for the executive session is for ORC 121.22 (G) (2) To consider the purchase of property for public purpose, or for the sale of public property at competitive bidding.

Nippert moved to go into executive session. Seconded by Deskins. RC: 5 YEAS
