I. Findings
This court held a hearing upon a motion for an order requiring respondent to participate in inpatient residential treatment as a part of community supervision. The motion is based on the requirements set forth in RCW 13.40.200 and RCW 13.40.020(5)(e). Based on the motion, declarations, and evidence presented the court makes the following findings of fact:
1.1 Residential Treatment is Necessary: Substance abuse, mental health, and/or co-occurring disorders have been identified in an assessment by a qualified mental health professional, psychologist, psychiatrist or chemical dependency professional. The court finds that inpatient residential treatment is:
a)necessary to rehabilitate the respondent;
b)necessary to protect the public and/or the respondent;
c)in the best interests of the respondent;
d)necessary as respondent has previously been given the opportunity to engage in less restrictive treatment and has been unable or unwilling to comply; and
e)the least restrictive action consistent with the respondent’s needs and circumstances.
A funded bed is either available or will become available during supervision.
1.2 Residential Treatment is Not Necessary: Court-ordered inpatient residential treatment is not necessary at this time under the terms of RCW 13.40.020(5)(e).
II. Order
2.1 Residential Treatment Ordered: The order of disposition is modified to require respondent to participate in residential treatment as a condition of community supervision. The treatment shall be inpatient residential placement in a facility approved by the qualified treatment provider and/or supervising probation officer consistent with this court’s findings, including the availability of a funded bed during the period of community supervision.
A review hearing shall be held in this courtroom no later than sixty (60) days after the respondent begins inpatient residential treatment, and additional hearings will be held every thirty (30) days thereafter, for as long as the respondent remains in inpatient residential treatment.
A funded bed is available at this time. The first review hearing shall be held no later than 60 days from today on (date): ______at (time):______a.m./p.m. The respondent must appear but may appear telephonically as necessary.
A funded bed is not yet available. The court shall issue a review hearing to further discuss the availability of a funded bed to be held on (date) ______at (time):______a.m./p.m. The respondent must appear, but may appear telephonically as necessary.
2.2 Motion denied: The motion requesting this court-ordered inpatient residential treatment under RCW 13.40.020(5)(e) is DENIED.
