ACTION:
ON MOTION of Member Jacob, seconded by Member Cox, the Air Pollution Control Board of the San Diego County Air Pollution Control District approved the Statement of Proceedings/Minutes for the meeting of March 28, 2006, on Consent.

OVERVIEW:
This letter requests authority for the Air Pollution Control District to accept and administer a settlement amount of $180,000 from Equilon Enterprises LLC for a Natural Gas Hybrid Demonstration Project. The project will partially fund the acquisition by San Diego Metropolitan Transit System of a natural gas hybrid demonstration bus. The bus will be powered by a piston engine in combination with an electric motor.Natural gas will fuel the piston engine and batteries will power the electric motor.
San Diego Metropolitan Transit System, as the recommended project recipient, will be the public agency designated to purchase, operate, and maintain the hybrid bus. The project is intended to demonstrate the viability of alternative fuel technology in a hybrid bus application and provide immediate benefits to air quality, including a reduction of harmful air contaminant emissions.
FISCAL IMPACT:
This request is not included in the Fiscal Year 2005-06 Operational Plan. The funding source is Equilon Enterprises LLC settlement money paid to the County of San Diego, to be deposited in the Air Quality Power Generation Mitigation Fund ($180,000). If approved, this request will result in one-time costs and revenue use of $180,000, and no subsequent year costs or revenue. It will require no additional staff years and no net General Fund cost.RECOMMENDATION:
AIR POLLUTION CONTROL OFFICER1. Authorize the Air Pollution Control Officer to accept and administer $180,000 in settlement money paid by Equilon Enterprises LLC to the County of San Diego and deposit that amount into the Air Quality Power Generation Mitigation Fund.
2. Establish appropriations of $180,000 in the Air Quality Power Generation Mitigation Fund for the Natural Gas Hybrid Demonstration Project based on settlement revenue received from Equilon Enterprise LLC. (4 VOTES)
3. Approve the recommended project to provide $180,000 in funding to the San Diego Metropolitan Transportation System for acquisition of a natural gas hybrid demonstration bus.
4. In accordance with Board of Supervisors Policy A-87 Competitive Procurement, item (1)(C), General Provisions on Exemptions from Competitive Procurement Policy for Goods or Services Acquired for Other Governmental Agencies, authorize the Director of the Department of Purchasing and Contracting to award the contract to San Diego Metropolitan Transit System subject to negotiations and approval of the Air Pollution Control Officer.

APCB2. / SUBJECT: / ELECTRIC LAWN MOWER TRADE-IN PROGRAM (DISTRICT: ALL)
OVERVIEW:
For the past six years, the Air Pollution Control Board has held the highly successful Mowing Down Pollution Lawn Mower Trade-in event. Regional air pollution is reduced as gasoline-powered lawn mowers are exchanged for new cordless rechargeable electric mowers. Some gasoline mowers emit 40 times more pollution per hour than a single late model automobile, while the replacement electric mowers offered by the Board emit zero pollutants. This is a request to direct the Air Pollution Control Officer to hold this year’s Mowing Down Pollution event on May 6, 2006, and make available up to 400 cordless electric lawn mowers for San Diego County residents.FISCAL IMPACT:
This request is included in the Fiscal Year 2005-06 Operational Plan. The funding source is $105,000 from penalties received for violations of air quality laws. Up to 400 lawn mowers will be purchased for $96,000. The remaining $9,000 will be used for other event costs. If approved, this request will result in no increase in current year costs and revenues and no increase in subsequent years’ costs and revenue. This will require no net General Fund cost and no additional staff years.RECOMMENDATION:
SUPERVISOR ROBERTS:1. Direct the Director of Purchasing and Contracting to negotiate a contract with Black and Decker not to exceed $96,000 for up to 400 lawn mowers.
2. Direct the Air Pollution Control Officer to hold a Lawn Mower Trade-in Event that exchanges up to 400 gasoline-powered lawn mowers for new, non-polluting cordless rechargeable mowers for $150 each.
3. Direct the Air Pollution Control Officer to hold this year’s Lawn Mower Trade-in Event on May 6, 2006, and authorize $9,000 for event costs.
