On motion of Mr. Zahn, seconded by Ms. Lee-Sheng, the following resolution was offered:

RESOLUTION NO.127571

A resolution recognizinga donation to Patrons of Lafreniere Park, Inc. (Council District 4)

WHEREAS,Art. VII, Sec. 14(C) of the Louisiana Constitution of 1974 provides that for a public purpose, the State and its political subdivisions may engage in cooperative endeavors with each other, with the United States or its agencies, or with any public or private organization, corporation or individuals; and

WHEREAS, the public purpose of the Cooperative Endeavor Agreement with Patrons of Lafreniere Park, Inc. is described as: To provide enhanced recreational facilities at Lafreniere Park for the benefit of all citizens of Jefferson Parish, consistent with the powers granted in the Jefferson Parish Charter §1.01 (15); and

WHEREAS, Jefferson Parish and Patrons of Lafreniere Park, Inc. have entered into a Cooperative Endeavor Agreement which is in effect; and

WHEREAS, Patrons of Lafreniere, Inc. is a private, non-profit corporation that was organized exclusively for the charitable purposes of providing public support to Lafreniere Park which support is provided through the solicitation of community support and contributions for capital improvements to Lafreniere Park; and

WHEREAS, Ingeborg Zimmer Peterson made a donation in the form of a legacy to the Patrons of Lafreniere Park, Inc. for the beautification of the park, and not for normal maintenance; and

NOW THEREFORE, BE IT RESOLVED by the Jefferson Parish Council of Jefferson Parish, State of Louisiana:

SECTION 1. That the Parish of Jefferson hereby recognizes the legacy of Ingeborg Zimmer Peterson

SECTION 2. That the expenditure of the funds donated by Ingeborg Zimmer Petersonto the Patrons of Lafreniere Park, Inc. is controlled by the Cooperative Endeavor Agreement between the Parish of Jefferson and the Patrons of Lafreniere Park, Inc. and shall only be used for beautification of Lafreniere Park and not for normal maintenance.

SECTION 3. In the event that the Patrons of Lafreniere Park, Inc. dissolve, or cease to provide support to Lafreniere Park, the legacy shall be remitted to the Parish of Jefferson for beautification of Lafreniere Park, and not for normal maintenance.

SECTION 4. That the Chairman of the Jefferson Parish Council, or in his absence the Vice-Chairman, be and they are, hereby authorized to execute any and all documents necessary to give full force and effect to this resolution.

The resolution having been submitted to a vote, the vote thereon was as follows:
