Gym Waiver 2016
Release and waiver of liability, assumption of risk and indemnity agreement (“agreement”)
In consideration or participating at Windsor Gymnastics Academy for Trial’s, Birthday Parties, Slumber Parties, Open Gym and Classes. I represent that I understand the nature of the activity and that I am qualified, in good health and in proper physical condition to participate in such activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the activity.
I fully understand that this activity involves risk of serious bodily injury, including but not limited to permanent disability, paralysis and/or death, which may be caused by my own actions or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the “release” named below; and that there may be other risks either not known to me or readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, cost, and damages I incur as a result of my participation in the activity. Each participant must have medical insurance to participate in the gym.
I hereby release, discharge, and covenant not to sue Windsor Gymnastics Academy , it’s respective administrations directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owners and leasers of premises on which the activity takes place, ( each considered one of the “RELEASEES” herein) from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or in part by the negligence of the “releases” or otherwise, including negligent rescue operations and future agree that I, despite this release, waiver, of liability, and assumption of risk I, or anyone on my behalf, makes, claim against any of the Releases, I will indemnify, save, and hold harmless each Releases from any loss liability, damage, or cost which any may incur as the result of such claim.
Open gym: Proof of an open gym waiver card must be shown to the front desk before participating in open gym. I agree that I have read the rules and regulations of open gym and by signing this form I am agreeing to its terms and conditions.
I have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that I any portion of this agreement is held to be invalid the balance, not withstanding, shall continue in full force and effect.

PARENT CONSENT
AND I, the parent and/ or legal guardian, understand the nature of the above referenced such activities and the minors experience and capabilities and believe the minor to be qualified to participate in such activity, I hereby Releases, discharge, covenant not sue and AGREE TO INDEMNIFY SAVE AND HOLD HARMLESS each Releaseses from liability, claims, demands, losses or damages on the minors account caused or alleged to have been caused in the whole or in part by the negligence of the “releases” or otherwise, including negligent rescue operations and future agree that I, despite this release, waiver, of liability, and assumption of risk I, the minor, or anyone on the minors behalf, makes, claim against any of the Releases, I will indemnify, save, and hold harmless each Releases from any litigation expenses, attorney fees, loss liability, damage, or cost any Releasee may incur as the result of any such claim. In an event of an injury at Windsor Gymnastics Academy, the injured parties insurance would be considered the primary insurance, then WGA as the secondary insurance.

RULES FOR OPEN GYM
1. One Person on the tramp at a time
2. No high bar
3. No chalk
4. No horse play
5. No sitting in the pit, digging holes or throwing items. Never dive in on your head, knees or stomach. This can result in serious injury.
6. No pitting at the foam squares
7. Keep your hands to yourself
8. No climbing on top of the tunnels
9. No jumping off of the vault or high beam
10. No playing tag
11. No jumping to the rings, no rope climbing
12. Watch out for students who are taking private lessons
13. Food, drinks or gum is not allowed in the gym
14. Spotting can only be done by a WGA coach
15. No flipping without approval from a WGA coach
16. Never be on any of the equipment without a WGA coach present
17. Parents must stay with their child at all time during preschool open gym. Parents are not allowed in the gym at the 4-6p time
18. Parents are not allowed on the equipment
19. All children must wait inside the building before and after class until their parents pick them up. No one can ever wait outside.
20. Children must stay inside the gym are during class at all times.
21. Always be respectful to other including coaches, use respectful language or you will be asked to leave.
22. Everyone must have a signed gym waiver on file in order to participate.
