23 – Hours of Work/Overtime / Open / Status Quo Language Proposed 1-25-10 / The PBA has proposed that unit employees who have reached the maximum limit for accumulated regular compensatory leave credits be given 1st consideration for leave requests to reduce regular compensatory leave credits so that such credits are not forfeited. The PBA has proposed that if such requests cannot be accommodated, then forfeiture of regular compensatory leave credits shall not occur. The PBA also questioned whether correctional officer lieutenants and captains meet the federal definition of exempt status for overtime work.

Proposed 12-23-09 / Currently, unit employees are only permitted to accumulate a maximum of 240 hours, per 60L-34.0043(1), Florida Administrative Code.
The State reviewed the exempt status for overtime purposes of correctional officer lieutenants and captains and determined that these classes of positions meet the criterion and exemption from the Fair Labor Standards Act for overtime. The State also estimated that it would cost a minimum of $1.6 million annually if the exemption status of these classes were changed.

Proposed 12-23-09 / The current minimum call-back hours is two (2) hours.
25 – Wages / Open / From each agency’s available funds in the salary and benefits category, each agency head is provided the authority to grant non-recurring lump sum performance bonuses for permanent employees in order to recruit, retain and reward quality personnel. Each eligible employee may receive a non-recurring one-time lump sum bonus payment of up to $1,500 plus applicable taxes. Eligible employees are employees who are, at minimum, meeting their performance standards. No lump-sum bonus shall be paid prior to June 1, 2011.

Proposed 1-28-10 / The PBA proposed:
1) a one-time $1,500.00 loyalty bonus for unit employees with one or more years of service with the department, effective July 1, 2010. The PBA’s justification was that employees have gone three (3) years without pay increases.
2) 5% Competitive Pay Adjustment effective October 1, 2010.
3) to continue emergency deployment pay in the appropriations bill or put in the collective bargaining agreement.

27 – Insurance Benefits / Open / Status Quo Language Proposed 1-25-10 / The PBA proposes:
1) to maintain health insurance benefits, deductible and employee health insurance premiums at the current levels
2) to study the cost to implement individual health retirement accounts for unit employees, funded through the payment of sick leave credits at the end of each fiscal year.
