The Lessee shall pay in advance a rental fee of $______, a deposit fee of $______and an administrative fee of $75. The deposit fee, rental fees and administrative fee shall accompany this Lease Agreement with check or money order only, payable to:Wilder Creek Conservation Club. Deposit fee is refundable if conditions of this agreement are adhered to by Lessee.

Lessee is renting the premises for the purpose of ______and for no other purpose, without written consent of WCCC.

The Lessee using the facility hereby agrees to hold wilder Creek Conservation Club and its elected and appointed officials, employees and volunteers harmless from any and all liability and all claims for damages of any nature or kind including all costs and legal expenses that may result from by reason of any act or omission on part of said group or individual, or its agents while on the Wilder Creek Conservation Club property. In consideration of this contract, and the conditions contained within the Lease Terms and Conditions found on the WCCC website at it is hereby agreed upon by both parties.

In consideration of this contract, and the conditions contained within, it is hereby agreed upon by both parties as follows:

1. The deposit and rental fees shall accompany this Lease Agreement. Make payments with check or money order only, payable to: Wilder Creek Conservation Club. Deposit fee is refundable if conditions of this agreement and schedule of cleanup are adhered to by Lessee.
2. The Lessee shall not assign, transfer, or sublet this Lease on said premises, or any part thereof, without the
written consent of Wilder Creek Conservation Club.
3. THE Lessee agrees to so conduct its activities upon the premises so as not to endanger any person lawfully on the property and to indemnify and save harmless WCCC against any and all claims of injury to person or property (including claims of employees of lessee or any contractor, sub-contractor, or invitee) arising out of the activities contracted by the Lessee, its agents, members or guests, or invitees.

4. Lessee shall comply with all laws of the United States, of the state of Michigan, and all ordinances, rules and regulations of Calhoun County and Eckford Township, and Lessee will not suffer to be done anything on WCCC property in violation of any such laws, ordinances, rules and regulations.The Lessee agrees to pay for any permitsand licenses required by any governmental authority and to pay any tax or taxes incidental to the use of the leased premises under this agreement.
5. WCCC reserves the right to eject from the leased premises any person or persons deemed by it to be objectionable. WCCC reserves the right to deny rental to any individual or group espousing violence or discrimination towards individuals, groups, race or cultures. The Lessee waives any and all claims for damages against WCCC.
6. The Lessee shall not admit to said premises more than 250 persons for a banquet or more than 300 persons for a meeting in the main clubhouse building.
7. The Lessee will permit no chair or moveable seat to be or remain in the passageways and will keep passageways clear at all times. No portion of the sidewalks, entries, passages, vestibules, hallways or stairways, or access to public utilities of WCCC property shall be obstructed by the Lessee, or used for any purpose other than for ingress to and from the premises. The doors, stairways, or openings that reflect or admit light into the building, and registers and house lighting attachments shall not be covered or obstructed by the Lessee except with the prior written approval of WCCC when necessary to provide proper lighting effects for performances. The bathrooms and other water apparatus shall not be used by the Lessee, its agents or employees, guests and invitees for any purpose other than that for which it was intended. The Lessee shall not put up or operate any engine or motor inside the premises, or use oils, kerosene, naphtha, or gasoline for either mechanical or other purposes. The moving of folding chairs or tables to the outdoors is not permitted without written approval from WCCC.

8. No provisions of this contract shall be waived or altered, except by writing endorsed hereon or attached hereto in writing and signed by an authorized agent of WCCC, and by the person signing this agreement for the Lessee, or some duly authorized agent for the Lessee. This agreement shall bind all persons claiming under the parties hereto in whatsoever character or capacity, as fully as if they were in every instance herein named. The invalidity of any particular clause, provision or covenant be and remain valid in all respects as fully as the law will permit. This agreement shall not be assignable without the prior written consent of WCCC.
9. WCCC shall have the right to terminate and rescind this agreement in its entirety or in part, at the option of WCCC, immediately upon the happening of the failure by the Lessee to perform, keep and observe any of the terms, covenants, and conditions herein contained, and attachments thereto, on the part of said party to be performed, kept, and observed. The cancellation or rescission of this contract shall not relieve the Lessee of any liabilities or obligations hereunder which shall have accrued prior to the effective date of cancellation or rescission.

10. It is agreed that Lessee, guests, and invitees shall not injure, mar, or in any manner deface said property and shall not cause anything to be done whereby the said premises shall be in any manner injured, marred or defaced, and will not drive nails, hooks, tacks, screws, or staples into any part of WCCC structures, and will not make any alterations of any kind therein, and that Lessee shall pay for or otherwise make good, or repair, all damage to the structures and property of WCCC caused by Lessee, its agents, employees, guests, or invitees during the tenure of this agreement.
11. Lessee may cancel this agreement, by written notice, directed to WCCC at least sixty (60) days in advance of the date scheduled for use by the Lessee, in order to qualify for refund of Rental and Deposit fees. Failure to adhere to this condition will result in forfeiture of Rental and Deposit fees.
12. Any violations on the part of the Lessee of any part of this agreement shall cause forfeiture of all fees, and violators could be prosecuted.
13. The Wilder Creek Conservation Club and/or any of its commissions or Boards have first priority for use of the Assembly Room and/or Kitchen. The WCCC Board has the authority to cancel a signed agreement if the facilities are needed for Club purposes. Rental and Deposit fees paid by Lessee will be refunded to Lessee in the case that the WCCC Board needs to exercise this section of this agreement.
14. An agent or agents of WCCC will perform a post inspection of the rented premises to make a determination of the condition of said premises, making notations in regards to the terms and provisions of this agreement, and will make recommendations to the Board as to whether any or all of the deposit monies shall be refunded. Any deposit fee to be refunded will be refunded at after the inspection is approved by a WCCC representative, or as agreed upon by both Parties. Any property damaged including but not limited to, missing tables/chairs, broken windows, building interior/exterior damage all actions of the attendees are the responsibility of the person named as the lease. If Damages exceed the deposit amount, the remaining amount will be billed to the responsible person named above.
15. Alcohol consumption, use or possession is not permitted during rentals at WCCC unless pre-approval from WCCC and/or its designated representative. The lessee will be subject to ejection and prosecution for the consumption of intoxicating beverages by minors, whether it is occurring with or without the lessee’s knowledge. Absolutely no sale of intoxicating beverages is allowed without a temporary Michigan Liquor License Permit. The lessee shall indemnify and hold the WCCC harmless for any liability introduced by the consumption of alcoholic beverages upon WCCC property during the rental period. If alcohol consumption as allowed the lessee shall provide insurance liability coverage for their event and provide proof, listing Wilder Creek Conservation Club as additional insured, showing time, location and scope of event prior to agreement being signed. Further, it is understood that the Lessee shall obtain or secure insurance covering on all incidents that may arise from the use of any and all, but not limited to alcohol furnished and/or supplied by the Lessee, its agents, members or guests, or invitees. $1,000,000.00 minimum liability for event coverage along with agent’s contact information is to be included.

16. Smoking is not permitted within 200 feet of any building or structure at WCCC.

17.Any and all problems or emergencies may be directed to public safety by dialing 911. Any and all problems and or emergencies shall also be immediately reported to WCCC and or its designated representative. WCCC club does not have an emergency phone or system designed to contact public safety on the premises. The lessee is required to have at least one operational cellular phone in his or her possession at all times during the period of the rental that has the ability to call 911. The lessee also forfeits the ability to deny access and consents to the entry and inspection of, but not limited to WCCC property, buildings and structures during the rental period by any law enforcement agency, fire department personal and or WCCC representative.

18. Food and non-alcoholic beverages are permitted at WCCC. You may contract with a caterer of your choice or provide your own; WCCC assumes no responsibility from anything arising from it. If any items, but not limited to, food or beverages are to be sold at WCCC , the lessee shall first obtain all the legal licensing such as, but not limited to, food permits, inspections and permission from WCCC and /or its representative prior to the sale of any such items.

19. All events must conclude by 11:00pm unless otherwise approved by WCCC and or its designated representative.

20. The following activities are prohibited during WCCC rental periods: Hunting, discharging or reckless display of firearms, reckless or careless vehicle operation, any and all off road vehicles, any and all motorized boats, disorderly or destructive behavior, abusive language or fighting, intoxication, illegal drug possession or use.

Lessee Responsibilities:

______Chairs and tables stacked/returned as found. Rolling of tables across floor is not acceptable
______All decorations removed, all decoration fasteners taken down/staples or clips removed
______Floors swept of debris, liquid spills mopped up, bathrooms checked for litter
______Kitchen cleaned, utensils washed and put away, sinks washed out and drains cleaned
______Parking area free of litter, trash picked up from grounds, no vehicles left in parking lot
______All garbage/waste must be removed from the premises
______All water shut off, all lights turned off
______All doors securely closed and locked, front gate closed and locked

______Bathrooms cleaned and re-stocked
