Freedom of Information request 263838 APPEAL
I am writing to you about your request for a review of a Freedom of Information 2000 (FOIA) response dated 26July2013 and your original information request made on 28 June 2013
Your request has been assigned to me to investigate and review and the result of my review is contained in this letter.
I have investigated the Council’s response made to you on 26July2013
The information you requested was as follows:
- 1.Total cost to Liverpool City Council in the case O'Keefe vLiverpool City Council/Adult Social Care for their investigation by (1) Social Worker and (2)Officer from February 2013 to date
- Two separate costing required as two separate investigation took place one by social worker one by officer in that period.
- Please list total internal costs of people at Liverpool City Council/Adult Social Care/complaints department who worked on this case i.e. officers at all levels.
- Please list man hours worked on this case by (1) social worker (2) officers (3) complaints department.
- Please list all other related costs - home visits/agency visits - phone calls to outside agencies. The City Council Solicitors proof reading the report.
In addition I require the costing to re-send the report by adult social care to carer.
We provided the following response:
- The City Council is unable to provide the information you have requested as we do not hold it in a reportable format
To clarify; we do not record this type of information on a case by case manner and officers are not required to routinely apportion/record their time between different tasks and cost accordingly.
Section 12 (1) Section 1(1) of the FOIA places a duty on public bodies to provide data as requested. However, it does not oblige a public authority to comply with a request for information if the authority estimates that the cost of complying with the request would exceed the appropriate limit. The appropriate limit is considered 18 hours
The City Council is only required to provide information which it holds and not create new information to meet a specific requestors needs.Your request has been considered and as this work would take in excess of the 18 hours identified in the Freedom of Information Act and Data Protection Act (Appropriate Limit and Fees) Regulations 2004 we are refusing this element of your request as this would require a disproportionate effort by the authority.

For the purposes of clarity I will be conducting our internal review based on the following statementreceived by the City Council on the 5 August
- I attach a link to a previous FOIA asking for similar information I requested in September 2012 - this request was successful - there is no difference between each FOIA other than date.
In order to ensure completeness I have revisited our original response, contacted all parties previously involved in the information gathering process and also contacted any other relevant, or partly relevant, department of Liverpool City Council who may hold relevant information.
This search has allowed me to confirm the following:
- Our original response provided the information we held at the time. My subsequent enquiries regarding this matter have confirmed that since February 2013 Liverpool City Council has not spent any money on this matter.
It is in accordance with this that I can confirm that we have no additional information to provide in relation to your request other than what has previously been supplied.
In light of this I can confirm that the City Council upholds its decision to provide the response it did but acknowledges that further explanationcould have been provided as part of the response.
As I have now reviewed your original response, you have exhausted the Council’s appeals process for the purposes of this request. Accordingly, should you remain dissatisfied, please contact the Information Commissioner’s Office, via the following:
