ON dolphin quays development – BRIDGE AND subsurface structures

1.Purpose of the Report and Policy Context

1.1To approve the issue of a licence in relation to the Dolphin Quays development to authorise a high level footbridge link across Fishermans Road, construction above the ground level footway along the Quay frontage and a number of sub-surface structures within the highway of Fishermans Road, The Quay and Old Orchard.

1.2Policy context – none.

2.Recommendation

2.1It is recommended that a licence be granted to Orb Developments under Sections 177 and 179 of the Highways Act 1980 authorising:

a)The construction of a high level footbridge link over Fishermans Road at second floor level.

b)The construction at first floor level and above over the footway on the Quay frontage.

c)The formation of subsurface structures within the public highway in FishermansRoad, The Quay and Old Orchard.

3.Background – Footbridge and Footway

3.1The approved development for Dolphin Quays includes a second floor level footbridge across Fishermans Road linking the residents car park in the east to the main development on the Old Pottery Site. It also includes the reservation of a footway route within the structure at ground level along the quay frontage, the footway remaining public highway.

3.2Section 177 of the Highways Act 1980 states that a licence is required from the Highway Authority before any building shall be constructed over part of a highway maintainable at public expense. The licence may contain such terms and conditions as the highway authority thinks fit.

3.3The minimum clearance for vehicles as laid down by the Highways Agency in their publication “The Design Manual for Road and Bridge Works” is 5.3 metres. As designed the bridge will have a clearance above carriageway level of 8 metres. The minimum clearance for footways is 2.6metres. As designed the footway will have a minimum clearance in excess of 3 metres.

Background – Subsurface Structures

4.1The ground conditions in the area are such that all major construction needs to be piled. The foundation requirements for the new development dictate the construction of a below ground concrete structure to tie groups of piles together and provide a suitable base for the main building. These structures, which lie approximately 500mm below the final surface level, project forward of the above ground building line by between 1 and 2 metres. The locations of the pile caps are shown on the attached plan – Appendix A.

4.2Section 179 of the Highways Act 1980 states that the consent of the local authority is required before any part of a building shall be constructed under any street for which the Authority is responsible for.

4.3The installation of pile caps below the surface of the highway will not be detrimental to the use of the highway – it is, however, intended that the licence includes a clause requiring the removal of the pile caps in the event of the building being demolished.

5.Financial Implications

5.1The costs associated with the preparation of the licence will be paid by the developer upon execution of the licence.
